Both chambers usually gavel in for pro forma sessions even during times of recess specifically to prevent the president from making recess appointments and bypassing congressional approval. President Barack Obama once tried to use recess appointments and was rebuked by the Supreme Court, which said in 2014 that recesses needed to be 10 days or longer for recess appointments to be legal.
