New York CNN —New York’s water and parks are full of plastic waste. PepsiCo has downplayed the risks of its plastic packaging and created a public nuisance in the state, she alleged in a lawsuit filed against the company on Wednesday. Additionally, PepsiCo has failed to properly warn the public about where its plastic packaging ends up, according to the lawsuit, making it sound like recycling will effectively deal with plastic waste. Environmental advocates activists are hopeful that the complaint could help change the way lawmakers approach plastic pollution. Generally, lawsuits surrounding plastic pollution are brought by non-profits, not government officials, she said.

Among the catalysts are Palestinian and Jewish-led groups that have been active for years in opposing Israeli policies toward the Palestinians and who now demand a cease-fire in Gaza. The groups have roots in a movement known as BDS, which calls for the boycott, divestment and sanction of Israel. That campaign generated heated rhetoric long before Hamas militants attacked Israel on Oct. 7 and Israel launched its counteroffensive. Advocates wrote op-eds for campus newspapers with appeals to protect Palestinian human rights, often accusing Israel of colonialism and racism. Protests have led to disruptions on Capitol Hill, at a major train station in Chicago and New York City’s Grand Central Station.

New York CNN —Donald Trump is asking for a mistrial in his civil fraud case alleging the judge who will decide the case is biased against him. Engoron has already signaled that he will deny the motion, initially advising Trump’s attorney that he shouldn’t file it but then saying he could file it in writing. The judge has defended his communications with his law clerk saying he has an “unfettered right” to discuss legal issues with her and noted that when campaigning, which his clerk was at one point, there are different limits to political donations. Engoron’s gag order prohibits Trump and his attorneys from making any statements about court staff and specifically about communications he has with his law clerk. Donald Trump is now being held accountable for the years of fraud he committed and the incredible ways he lied to enrich himself and his family.

New York CNN —Federal Deposit Insurance Corporation Chair Martin Gruenberg testified Tuesday that he was unaware of the allegations of widespread sexual harassment and discrimination at the agency detailed in a Wall Street Journal investigation. “I did not know about the individual cases,” Gruenberg told him. Martin Gruenberg, chair of the Federal Deposit Insurance Corporation, told senators on Tuesday he was troubled by the allegations detailed in a Wall Street Journal investigation. The report also referenced a 2019 survey conducted by the inspector general that found 8% of the 2,376 respondents experienced sexual harassment between January 2015 to April 2019. The 2020 inspector general report made 15 recommendations to prevent and address sexual harassment at the agency, which Gruenberg said in his testimony on Tuesday had been implemented but acknowledged “didn’t change the culture” at the FDIC.

Judge Arthur Engoron sided with Donald Trump’s attorneys, overruling an objection from the New York attorney general’s office to admit a PowerPoint presentation showcasing the history of the Trump Organization. The presentation, titled “The Trump story,” also included photos of Donald Trump with his father, Fred Trump, as well as sleek photos of various Trump buildings. The PowerPoint included Trump's purchase of Mar-a-Lago in 1985, which Trump Jr. described as "one of the few sort of American castles." Assistant Attorney General Kevin Wallace objected to the presentation, claiming the text descriptions were coaching the witness. The judge has also sided with Trump's lawyers during the trial, but this signals the judge is going to give a lot of leeway to both sides in their presentation.

Trump, the frontrunner for the 2024 Republican presidential nomination, has testified along with his sons Donald Jr. and Eric Trump and daughter Ivanka Trump. The fraud trial is one of several legal battles Trump faces as he mounts a comeback bid for the White House.

It’s a list that includes powerful members of Mexico’s government. And, court records show, they were all recently under surveillance by the Mexico City attorney general’s office. At least 14 written orders reviewed by The New York Times show that the attorney general directed Mexico’s largest telecommunications company to hand over the phone and text records, as well as location data, of more than a dozen prominent Mexican officials and politicians. Telcel, the telecommunications company, acknowledged in a court filing reviewed by The Times that it had received the orders and handed over the records, which spanned from 2021 until earlier this year. The surveillance included both opponents of the governing Morena party and its allies.

Prime Minister António Costa of Portugal resigned unexpectedly on Tuesday, hours after the police raided government buildings as part of an inquiry into corruption and “influence peddling” and issued an arrest warrant for Mr. Costa’s chief of staff. Mr. Costa, who had been in power since 2015, said in televised remarks that he had been “surprised” to learn that he would be the subject of criminal proceedings and that “no illicit act weighs on my conscience.”“However, I believe that the dignity of the office of the prime minister is not compatible with any suspicion about your integrity, your good conduct and even less with the practical suspicion of any criminal act,” he added. “Therefore, in these circumstances, obviously, I presented my resignation.”A judge authorized police to search of 37 locations — including the office of Mr. Costa’s chief of staff, the Ministry of Environment, the Ministry of Infrastructure, a City Council office in the town of Sines and several private homes, according to a statement from the prosecutor general’s office.

Trump, wearing a navy suit, blue tie and an American flag pin, took the witness stand under oath in a Manhattan courtroom to face questioning from the New York attorney general’s office, which alleges he and his business engaged in a lengthy scheme to inflate the value of their assets for financial gain. The former president alternated between calmly responding to questions about his finances and drawing the repeated ire of the presiding judge, who reminded him the proceeding “is not a political rally.”

The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s attacks in a vacuum weren’t particularly remarkable – he’s used the same barbs throughout the course of the trial, which he’s attended repeatedly as a spectator. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.

Trump, at times seemingly unable to stop himself from melting into a temper tantrum, claimed repeatedly, “It's election interference.”“We have a very hostile judge,” he said at one point. I wanted a jury.”To be clear, this particular type of case proceeding – determining damages in a civil fraud case – doesn’t use juries. That narrative is a markedly different one than Trump’s two adult sons provided in testimony last week. But Engoron already dismissed that defense in finding Trump liable for fraud. The defense team is expected to call many of the witnesses who have already testified, including Trump himself and his two adult sons.

What to Know About Trump’s Civil Fraud Trial
  + stars: | 2023-11-06 | by ( Kate Christobek | ) www.nytimes.com   time to read: +1 min
Donald J. Trump’s trial will continue Monday in a New York courtroom with him on the witness stand, part of a proceeding that threatens the business empire that underpins his public persona and that fostered his run for the White House. The trial stems from a lawsuit brought by New York’s attorney general, Letitia James, which accuses Mr. Trump and other defendants, including his companies and sons Donald Jr. and Eric, of fraudulently inflating the value of assets to obtain favorable loans and insurance deals. For the past five weeks, lawyers from the attorney general’s office have argued that Mr. Trump’s employees arbitrarily assigned values to individual assets to arrive at the former president’s desired net worth. Mr. Trump’s attorneys have responded that the assets had no objective value and that differing valuations are standard in real estate. The judge, Arthur F. Engoron, ruled even before the trial that Mr. Trump and the other defendants were liable for fraud, and that their annual financial statements were filled with examples of such misconduct.
