The actor Alec Baldwin appeared Monday in a Santa Fe courthouse as his lawyers sparred with prosecutors over what evidence could be shown to the jury when he goes on trial this week for the fatal shooting of a cinematographer on the set of the film “Rust.”Wearing a suit with a gray striped tie and glasses with thick dark frames, Mr. Baldwin, who is facing a charge of involuntary manslaughter, appeared to pay close attention to the proceedings, taking notes and leaning over to speak with a lawyer. Mr. Baldwin was indicted by a grand jury for his role in the fatal shooting of the cinematographer, Halyna Hutchins, who was killed on Oct. 21, 2021, when a gun he was rehearsing with discharged a live bullet. He has pleaded not guilty, saying he was told the gun did not contain live ammunition. He has also said he did not pull the trigger before the bullet fired, which prosecutors dispute. The judge in the case, Mary Marlowe Sommer of the First Judicial District in New Mexico, ruled on Monday that prosecutors could not argue that Mr. Baldwin’s role as a member of the production team — he was one of the film’s producers in addition to being its leading man — had made him more culpable for the death of Ms. Hutchins.

To be sure, the president turned in a more energetic performance than he had on that woeful debate night, when he sometimes appeared lost and incoherent. “I just had a bad night, I don’t know why.”“And how quickly did it come to you that you were having a bad night?” Stephanopoulos asked. Only 42% said the same about Trump, 78, whose own terrible debate performance was eclipsed by Biden’s meltdown. Three separate polls conducted by CNN, The New York Times and the Wall Street Journal after the debate all showed Biden trailing Trump by six points nationwide. Previous polls have shown Biden trailing in nearly all the battleground states he narrowly won in 2020.

Under the University of Virginia Center for Politics' current projections, there are five true toss-up states: Michigan, Wisconsin, Pennsylvania, Arizona, and Nevada. The reality is that if Biden is stuck playing defense in states Democrats usually win, Trump's return to the White House will be a foregone conclusion. The only question then will be how many Electoral College votes would the former president win. "If Biden's position gets worse, that's when you see maybe a Virginia or New Mexico get in play," Kondik said. President Biden and his advisers rushed to stem the first serious defections inside the Democratic Party since his shaky debate last week, as leading Democrats lent legitimacy to questions about his mental acuity and raised the specter of replacing him atop the ticket. Mr. Biden’s operation hoped to assert fresh control on Wednesday, holding a call with a group of Democratic governors, in person and virtually, as he seeks to shore up support after days of private hand-wringing went public in sudden and quick succession. On Tuesday, Mr. Biden suffered his first formal call to resign from the race from a Democratic member of Congress. But a private set of polls from a pro-Biden super PAC leaked to the news site Puck showed the president losing ground — around two percentage points — across all the most important battleground states. He was also now trailing in New Mexico, New Hampshire and Virginia, three states that were not seen a year ago as likely even to be contested seriously by Republicans.

Lightning Is Blamed for Deadly New Mexico Fire

Lightning sparked the larger of the two wildfires that have scorched southern New Mexico, leaving at least two people dead, destroying 1,400 structures and ravaging more than 25,000 acres, the authorities said on Wednesday. The blaze, known as the South Fork fire, began June 17 amid sweltering temperatures and was 87 percent contained on Wednesday evening, the Bureau of Indian Affairs said in a news release. “The identification of the point of origin and all evidence and data support lightning as the cause of the fire,” the agency said in a statement. “Human activity and factors did not contribute to the cause.”On June 23, the F.B.I. said that it was offering a reward of up to $10,000 for information leading to the arrest and conviction of the “person or persons responsible for starting” the South Fork fire and the Salt fire, the other major fire in New Mexico.

Setbacks in orbitSeveral more helium leaks were identified while the craft was en route to the International Space Station along with the thruster issues. That’s why Boeing and NASA teams then chose to leave the Starliner spacecraft safely docked with the space station while they worked to learn as much as possible about those issues. The first Starliner test mission took place without a crew in December 2019. That’s at the core of the mysteries Boeing and NASA are seeking to unravel during the Starliner spacecraft’s extended mission. Boeing's crew flight test represents the first time Starliner is carrying people, flying NASA astronauts Butch Wilmore and Suni Williams. Before launching on June 5, Boeing and NASA planned for Starliner to be in space for nine days. As of Friday, the Starliner flight has tallied 24 days and counting. NASA and Boeing say the delay for testing is solely to gather more data about the spacecraft's performance, in particular its thruster system. The Starliner crew flight test represents a final major step before NASA certifies Boeing to fly crew on operational, six-month missions.

The shooting occurred at 1:46 p.m. that day at the Bonanza Creek Ranch, a family-owned Old West movie set about 20 miles southeast of Santa Fe that had been rented out by “Rust,” an independent film that Baldwin was both starring in and producing. The bullet he inadvertently fired passed through the upper body of the film’s cinematographer, Halyna Hutchins, and lodged near the spine of Joel Souza, the director. Souza was taken by ambulance to a hospital in Santa Fe; Hutchins was airlifted to a trauma center in Albuquerque and died a short time later. She had been an assistant district attorney specializing in violent crimes when her boss made a bid for Congress. She ran to succeed him — her first foray into electoral politics — and won easily, inheriting a jurisdiction that covers three counties: Los Alamos, Rio Arriba and Santa Fe.
