Trump Georgia prosecutor wants 'speedy trials' done together

The Atlanta district attorney prosecuting the Georgia election interference case against former President Donald Trump and 18 others asked a judge Tuesday to order that defendants granted so-called speedy trials be tried together. Fulton County DA Fani Willis also asked Judge Scott McAfee to set a deadline for defendants in the case to file requests to sever their cases. McAfee has discretion on whether to sever the cases for separate trials. But defendants soon could make similar speedy trial requests, which would require their trials to begin by Nov. 3. In her court filing Tuesday, Willis said she opposed, "at this juncture," severing the cases of defendants so that they would be tried either in 19 separate trials or in smaller groups.

In the Georgia case, the question of whether to change the venue — a legal maneuver known as removal — matters because it would affect the composition of a jury. A judge in Atlanta set a Friday morning hearing for Harrison Floyd, a co-defendant in former President Donald Trump's election interference case in Georgia who has been held in custody since Thursday afternoon. Floyd, like most of the 19 co-defendants in Atlanta District Attorney Fani Willis' sprawling RICO case, surrendered at Fulton County jail this week ahead of a Friday deadline. Floyd did not do this and therefore "is in custody at the Fulton County Jail," the Fulton County Sheriff's Office said in a statement Thursday. The booking of former President Donald J. Trump at the Fulton County Jail on Wednesday is only the start of a long legal battle, made more complex by the case’s large number of other defendants. The next step is arraignment — a formal first appearance before a judge to be formally charged, set bail and enter a plea. The Fulton County district attorney, Fani T. Former President Donald Trump on Thursday opposed a request by an Atlanta prosecutor that he stand trial starting Oct. 23 in his Georgia election interference criminal case. Trump attorney Steve Sadow, in a court filing, also notified a judge that Trump soon will file another motion to sever his case from co-defendant Kenneth Chesebro, who on Wednesday demanded a speedy trial in Fulton County Superior Court. Fulton County District Attorney Fani Willis earlier Thursday asked Judge Scott McAfee to schedule the trial of Trump, Chesebro and the 17 co-defendants to begin Oct. 23. Attorney John Eastman on Monday was ordered to pay a $100,000 bond in the Georgia criminal case where he is accused of conspiring to overturn former President Donald Trump's loss in the state's 2020 election, a court filing shows. He is also accused of one count of criminal solicitation and one count of filing false documents. The bond for the racketeering charge was set at $20,000, while Eastman's remaining charges each carry a $10,000 bond, according to the court filing in Fulton County Superior Court. A consent bond order can be crafted in advance of a defendant's surrender so that they are not held in jail while the conditions of their release are worked out. A judge set former President Donald Trump's bond at $200,000 in the Georgia criminal case accusing him of conspiring to overturn his loss in the state's 2020 election, a court filing showed Monday. Fulton County Superior Court Judge Scott McAfee set Trump's bond for the racketeering charge at $80,000, while the remaining 12 counts each received bond amounts of $10,000, the court filing shows. McAfee set a $100,000 bond for John Eastman, the pro-Trump lawyer who is charged with nine counts in the Georgia case. Kenneth Chesebro, another pro-Trump lawyer and co-defendant, had his bond set at $100,000 on one count of racketeering and six counts of criminal conspiracy. Ray Smith's bond was set at $50,000, while the judge set a $10,000 bond for Scott Hall.

This means the former president’s surrender is expected next week – not Thursday or Friday – before the August 25 deadline. The Fulton County sheriff has said that all 19 defendants in the case, including Trump, are expected to surrender at the Fulton County jail, as is common procedure. The former president’s surrender and arraignment will look different in Georgia than in his previous three criminal cases. However, the authorities in Fulton County will need to coordinate with the Secret Service and Trump’s attorneys about the logistics of the former president’s surrender. The initial court appearance for Trump and other defendants is expected to be set by Fulton County Superior Court Judge Scott McAfee, who has been assigned to the historic case.
