Former President Donald Trump's lawyers told a court Tuesday that they are appealing a narrow gag order imposed on him in his federal 2020 election interference case. But Chutkan, who was appointed by President Barack Obama, said Trump can't mount a “smear campaign” against prosecutors and court personnel. At rallies and in social media posts, Trump has repeatedly sought to vilify Smith, other prosecutors, likely witnesses and even the judge. Smith’s team argued that Trump knows that his incendiary remarks could inspire his supporters to threaten or harass his targets. The case, which accuses Trump of scheming to subvert the results of the election, is scheduled to go to trial in March.

Insider Today: Tech workers are bummed

AdvertisementAdvertisementIn today's big story, we're looking at why some tech workers don't love their jobs anymore. Many factors led to the shift, from significant layoffs in Big Tech to in-office mandates and financial pressure due to high interest rates. AdvertisementAdvertisement(Interestingly enough, Terrazas writes that workers in non-tech roles — like human resources and marketing — report the highest job satisfaction at Big Tech companies.) But it feels like tech workers themselves will end up having to do a bit of recalibration. Working in Big Tech has become a job like any other corporate gig.

Trump is now facing a limited gag order after a federal judge's ruling on Monday. Judge Tanya Chutkan's order will limit Trump's attacks on potential witnesses, prosecutors, and court staff. Trump has repeatedly criticized special counsel Jack Smith, including saying he "looks like a crackhead." AdvertisementAdvertisementFederal judge Tanya Chutkan on Monday imposed a limited gag order that if it stands would force the end of former President Donald Trump's social media barrages against special counsel Jack Smith and his team. The former president's attorneys had argued that imposing such a restriction would unfairly limit Trump's First Amendment rights, an argument Chutkan strongly rejected.

At one point, Chutkan asked prosecutor Molly Gaston to define which of Trump's statements about the case would qualify as "disparaging," and therefore be barred under the gag order. Lauro also argued that a gag order would adversely impact Trump's 2024 presidential campaign. "I do not need to hear any campaign rhetoric in my court," Chutkan chided Lauro at one point. Trump himself has repeatedly railed against the prosecutors' request for a partial gag order, accusing them of trying to "silence" him. During the hearing itself, Trump posted, "The TRUMP GAG ORDER that the CORRUPT Biden Administration is trying to obtain is totally Unconstitutional!"

The gag order fight underscores the unprecedented complexities of prosecuting the former president as he tries to retake the White House while fighting criminal charges in four cases. The defense had claimed Chutkan's comments about Trump in other cases raised questions about whether she had prejudged his guilt. But Chutkan said her comments were mischaracterized and there was no need for her to step aside. Prosecutors noted in a recent motion that Trump's incendiary rhetoric has continued even after their initial gag order request. Prosecutors have said their proposal would not impact Trump's ability to campaign or prevent him from publicly declaring his innocence.

October 15 - Joe Burrow tossed a pair of first-half touchdowns and the Bengals' defense intercepted two passes to lead Cincinnati past the visiting Seattle Seahawks 17-13 on Sunday. The Bengals appeared ready to hold the Seahawks to a field goal but safety Nick Scott was called for pass interference on Tyler Lockett in the end zone. Jason Myers' 55-yard field goal narrowed Cincinnati's lead to 14-10 at the half. Evan McPherson connected on a 52-yard field goal with under 12 minutes left to put Cincinnati ahead 17-13. The Bengals lost their starting left tackle Orlando Brown Jr. to a groin injury late in the third quarter.

Judges can threaten gag order violators with fines or jail time, but jailing a presidential candidate could prompt serious political blowback and pose logistical hurdles. A gag order may also slow down the case because it's likely Trump either violates it and the judge will want to punish him or Trump will challenge the order in advance, he said. In one case, a federal appeals court in 1987 lifted a gag order on U.S. Rep. Harold Ford Sr., a Tennessee Democrat charged in a fraud case. Ford’s gag order prohibited him from even sharing his opinion of or discussing facts of the case. He said he was dubious that Trump’s attacks, “while in very poor taste,” posed the kind of danger to merit a gag order.

It is a problem that five U.S. state and federal judges are wrestling with as Trump faces four upcoming criminal trials and a civil fraud case. New York state Justice Arthur Engoron already has faced off with Trump on the issue. Trump has cast doubt on Chutkan's ability to give him a fair trial and called her "highly partisan." Ahead of his civil fraud trial, Trump, without providing evidence, accused the U.S. Justice Department of coordinating with New York state Attorney General Letitia James to damage his presidential campaign. One notable exception to Trump's criticism is the judge presiding over the classified documents criminal case in Florida.

MARSEILLE, France, Oct 12 (Reuters) - England coach Steve Borthwick looks set to make radical changes for Sunday's World Cup quarter-final against Fiji by dropping George Ford and starting Marcus Smith at fullback, strengthening his midfield defence and injecting some energy into the attack. However, while his defence and aerial skills are superior to Smith's, Steward has shown little in attack - though he is far from alone there. Defence generally has not been the issue for England as they racked up four wins in a row. Before the Samoa game they had the best defence in the tournament and had conceded only one try. England have made the second-fewest carries (108.8) for the second-fewest metres (461.3), they rank sixth for defenders beaten (22.5) and last for offloads (5.8).

(AP) — One of the people being sued by the Mississippi Department of Human Services over allegations of misspending welfare money has filed a separate lawsuit against Gov. Austin Garrett Smith filed the suit Wednesday and described himself in court papers as “politically powerless.” Smith's suit says Reeves should sue Republican former Gov. The ongoing suit seeks to recover more than $20 million of the roughly $77 million in welfare money that the state auditor said had been misspent between 2016 and 2019, during Bryant's second term as governor. Smith is a nephew of former Mississippi Department of Human Services executive director John Davis. The Democratic nominee for governor, Brandon Presley, said Reeves is tainted by the welfare misspending that occurred when Reeves was lieutenant governor and had power to oversee how the Department of Human Services was operating.

They pointed to Trump's recent disparagement of the clerk of the New York judge overseeing a civil case against him that caused the judge to issue a limited gag order. Smith's team wants the judge to issue a written questionnaire to weed out potential jurors before jury selection begins in the case scheduled for trial in March. "Such a precaution is not only necessary to ensure that all parties handle sensitive juror information responsibly, but also so that the Court can assure prospective and seated jurors in this case that no party will improperly use their names or other identifying information," prosecutors wrote. After he left the White House, former President Donald Trump allegedly shared sensitive information about U.S. nuclear submarines with an Australian billionaire who is a member of his Mar-a-Lago club, according to a pair of reports published on Thursday. Trump shared the information with Anthony Pratt during an April 2021 conversation at the Palm Beach, Fla., golf club, according to ABC News, which first reported the development. The New York Times also confirmed the former president shared the information with Pratt, citing two people familiar with the matter. Trump shared the number of warheads that U.S. submarines typically carry and how close they can get to Russian submarines without being detected, according to both ABC and the New York Times. WASHINGTON (AP) — Lawyers for former President Donald Trump have asked a judge to postpone his classified documents trial until after next year's presidential election, saying they have not received all the records they need to review to prepare his defense. The trial on charges of illegally hoarding classified documents, among four criminal cases the Republican former president is facing, is currently scheduled for May 20, 2024, in Florida. In a motion filed late Wednesday, Trump's lawyers urged U.S. District Judge Aileen Cannon to push back the trial until at least mid-November 2024. The presidential election is set for Nov. 5, 2024, with Trump currently leading the GOP field in the months before the primary season. The defense lawyers say Trump's two co-defendants in the case, his valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira, are joining in the request.

Trump, president from 2017 to 2021, has regularly made sweeping claims of immunity both while in office and since leaving the White House. The U.S. Supreme Court in 2020 spurned Trump's argument that he was absolutely immune from state criminal investigations while president. The judge said Trump's actions leading up to the riot, casting doubt on the election results, were not official responsibilities. The case is one of four criminal prosecutions Trump, 77, faces as he seeks to retake the White House. Trump has asserted that impeachment, where the U.S. Congress can charge and try presidents for misconduct, is the appropriate way to hold presidents accountable for official actions.

Lawyers for former President Donald Trump are slamming prosecutors' request for a narrow gag order in his 2020 election subversion case in Washington, calling it an effort to “unconstitutionally silence” his political speech. In court papers filed late Monday, attorneys for Trump urge U.S. District Judge Tanya Chutkan to deny the proposal to bar the Republican ex-president from making inflammatory and intimidating comments about witnesses, lawyers and other people involved in the criminal case. "If the prosecution wishes to avoid criticism for abusing its power, the solution is simple: stop abusing its power. Prosecutors told the judge that a “narrow, well-defined” order was necessary to preserve the integrity of the case and to avoid prejudicing potential jurors. There's a high bar for recusal, and Smith’s team has said there is no valid basis to have the judge removed from the case.
