Several top party donors have privately told Menendez's campaign that he should resign, according to a longtime past supporter who spoke with CNBC. The PAC so far has raised approximately $300,000 for Menendez's 2024 reelection campaign, according to its president, Dr. Ben Chouake. NorPAC has donated a combined $15,500 toward the Menendez campaign and separate leadership PAC since 2017, according to OpenSecrets data. Prudential Financial , the large insurer, has donated $35,000 through their PAC toward Menendez's political operation since 2017, according to OpenSecrets. A Prudential spokeswoman declined to comment when asked whether the company's PAC would continue to support Menendez following his indictment.

Menendez, also a Democrat, said on Monday that he would stay in the Senate and fight the charges. Democratic Senators John Fetterman, Sherrod Brown and Peter Welch have also called for Menendez to resign, as well as several Democratic elected officials in Menendez's state of New Jersey, including Governor Phil Murphy. Menendez's legal troubles could complicate his party's efforts to maintain control of the Senate, though New Jersey has not elected a Republican to the seat since 1972. Following the announcement of the charges on Friday, Democratic U.S. Representative Andy Kim said on Saturday he would challenge Menendez for his seat.

The reporting lapses that federal prosecutors in Manhattan noted on his Senate financial disclosure forms might seem to pale in comparison. But they could also suggest an effort to hide his newfound wealth to evade notice by the Senate’s Select Committee on Ethics. “Knowingly and willfully filing a false personal financial disclosure report can result in a civil penalty of up to $50,000,” Brett Kappel, a Washington-based lawyer and expert in campaign finance, lobbying and government ethics, said in an email. “It may also be prosecuted as a violation of the False Statements Act — a felony punishable by up to five years in prison.”The first mention of gold on Mr. Menendez’s financial disclosure report came in March 2022, on a report amended to indicate that in 2020 his wife owned as much as $250,000 in bullion.
