They’ve zeroed in on what may sound like a nerdy legal theory, but one that could have huge implications: the tyranny of the intermediary, middleman companies that abuse their role by squeezing out competition or creating artificially expensive moats. The Justice Department has already made one high-profile strike along these lines, suing to break up Ticketmaster and Live Nation. It is reportedly investigating at least two others. One is RealPage, a property management company that uses artificial intelligence to suggest prices and has already been sued by renters accusing it of facilitating a new type of collusion. The second is UnitedHealth Group, the health care conglomerate that owns a cobweb of businesses that include an insurer and another unit that employs about 10,000 physicians in the United States.

Two teenagers were reported missing in the waters off Jacob Riis Park in Queens on Friday evening, setting off an hourslong search into the night along a shoreline notorious for rip currents that prove deadly year after year. The authorities received reports of a possible drowning around 6:30 p.m. The officers responding to the scene were told that two teenage boys, ages 16 and 17, had been seen struggling in the water before they disappeared from view, according to the New York Police Department. Emergency responders with the police, New York City Fire Department and the U.S. Coast Guard, including rescue swimmers and divers, searched the churning waters, but as of about 11 p.m. Friday no one had been found, according to the police. Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

The Biden administration on Friday outlined its plans to curb new American investment in critical Chinese technology industries that could be used to enhance China’s military, further straining economic ties with Beijing at a time when trade tensions are rising. The proposed Treasury Department rules would prohibit certain U.S. investments in Chinese companies that are developing semiconductors, quantum computers and artificial intelligence systems. The Biden administration is trying to restrict American financing from helping China develop advanced technology that could be used for weapons tracking, government intelligence and surveillance. CNN —The Biden administration is taking the unprecedented step of banning US companies and citizens from using software made by a major Russian cybersecurity firm because of national security concerns, Commerce Department Secretary Gina announced Thursday. Thursday’s announcement comes after CNN reported in April that the Biden administration was preparing to issue an order that would prevent US companies and citizens from using Kaspersky software. US government agencies are already banned from using Kaspersky Lab software, but action to prevent private companies from using the software is unprecedented. Founded in Moscow in 1997, Kaspersky Lab grew into one of the world’s most successful anti-virus software companies alongside American rivals like McAfee and Symantec. Some of the speculation and suspicion from US officials about the Russian company centers around Eugene Kaspersky, a charismatic computer expert who co-founded Kaspersky Lab in Moscow in 1997.

CNN —The House Ethics Committee announced Tuesday that it will continue to investigate certain allegations surrounding Rep. Matt Gaetz, including whether the Florida Republican engaged in sexual misconduct, while ending other portions of the probe. In a rare statement updating its work, the bipartisan committee stated some of the allegations against Gaetz “merit continued review” and it has “also identified additional allegations” that warrant investigating. But McCarthy has repeatedly denounced those accusations and has said Gaetz worked to oust him because of the ethics probe. The University of Michigan and the City University of New York mishandled complaints of discrimination on campus during widespread protests over the war in Gaza, the Education Department announced on Monday. The department’s Office for Civil Rights has opened dozens of investigations into antisemitism and anti-Arab discrimination as students held rallies and set up encampments in support of Palestinians and called for their schools to divest from Israel. Sony Pictures Entertainment is acquiring Alamo Drafthouse Cinema and will manage its 35 locations, a rare example of a traditional Hollywood studio’s owning a theater chain. The deal, announced Wednesday, followed the Justice Department’s decision in 2020 to rescind the so-called Paramount consent decrees — movie distribution rules dating to 1949 that forced the largest Hollywood studios to sell off their theater holdings. The Police Department is seeking to revoke former President Donald J. Trump’s license to carry a concealed weapon after his conviction in his New York hush-money case, according to two people with knowledge of the matter. Mr. Trump had a concealed carry permit in New York and had three pistols registered under the permit, the people said. It is unclear whether it is still in Mr. Trump’s possession. The Police Department will complete an investigation that is likely to lead to the revocation of Mr. Trump’s concealed carry permit, according to the people with knowledge of the matter. Mr. Trump has the right to file a challenge to the move.

The sophisticated scheme boosted revenue flowing into the coffers of The Epoch Times, the Justice Department said. Western-trained pilots can teach Chinese military personnel everything from air combat tactics to how to land on an aircraft carrier, according to a US official. Former western pilots — which number at least in the dozens — are training Chinese military officials who then return to China and, in turn, train more pilots there, this person said. An indictment in 2017 alleged that Duggan trained Chinese pilots while he was still a US citizen, between November 2009 and November 2012. That same month, the UK Ministry of Defense issued a security alert after several of its military pilots were also found to have been training the PLA Air Force. In a new complaint, the department alleges Best Practice, a staffing agency, sent the child to work at SMART Alabama, which provided car parts to Hyundai. The complaint alleges all three companies were responsible for employing the child. “We are reviewing the new lawsuit and intend to vigorously defend the company,” Hyundai said in a statement provided to CNN. The complaint, filed in an Alabama federal court, seeks an order requiring the companies to release any profits related to the use of child labor as well as an order to stop any future use of child labor. Hyundai and its suppliers had been the subjects of a series of investigations by news service Reuters into the use of child labor in Alabama.
