Russian actors "manufactured and amplified" a recent viral video that falsely showed a person tearing up ballots in Pennsylvania, the FBI and two other federal agencies said Friday. In the video, a person is seen destroying what are purported to be filled-out ballots in Bucks County, Pennsylvania. “The Bucks County District Attorney’s Office will not tolerate any voter suppression, intimidation, or fraud,” the statement added. Darren Linvill, co-director at Clemson University’s Media Forensics Hub, attributed the viral video to the Russian disinformation production team known to researchers as Storm-1516. The video’s quality and the use of actors who appear to have West African accents to pose as Black Americans were characteristic of the Russian campaign, Linvill said.

A federal appeals court ruled Friday that a Mississippi law allowing mail-in ballots to be counted if they are postmarked before Election Day — but received up to five days after Election Day — is pre-empted by federal law. It does, however, pave the way for a possible challenge that could go up to the U.S. Supreme Court, which could have ramifications for states that do allow ballots postmarked before Election Day to be counted. The appeals court ruling says that no such ballots should be counted. "Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days," the ruling said.

A federal judge on Friday granted a Department of Justice request to block Virginia from systematically removing alleged noncitizens from the voter rolls this close to an election. "All of the eligible voters who were wrongfully purged from the voter rolls will now be able to cast their ballots," Snow said. The Justice Department said in a previous filing that 43 people removed from rolls in Prince William County were likely U.S. citizens. States are barred from systematically removing people from voters rolls within 90 days of an election under the National Voter Registration Act. During a special election in Wisconsin over the summer, a group of partisan poll watchers showed up at a handful of precincts in Glendale, a suburb of Milwaukee, and created chaos by contesting every absentee ballot that was cast. After they were reminded repeatedly about the rules against making meritless ballot challenges, the groups of poll watchers “turned disruptive,” according to Glendale Mayor Bryan Kennedy. They didn’t, and the police were called,” Kennedy told CNN, adding that once police arrived, the observers left peacefully. CNN —US intelligence has assessed that Russian operatives were behind a fake video purporting to show someone destroying mail-in ballots in Bucks County, Pennsylvania, that circulated on social media Thursday. CNN reported earlier Friday that US investigators suspected that Russian operatives were behind the fake video, according to two sources briefed on the matter. The Board of Elections in Bucks County, north of Philadelphia, was quick to debunk the video on Thursday. But the video was hatched by Russian operatives, according to Darren Linvill, an expert on Russian disinformation campaigns at Clemson University. Russian operatives have tried to denigrate Harris’ campaign, Iranians have tried to undercut Trump’s, while China has largely focused on down-ballot races.

CNN —A panel of three Donald Trump-appointed judges said Friday that Mississippi was violating federal law by counting mail ballots that arrive after Election Day, but stopped short of blocking the policy before the election, in a ruling that could nevertheless impact voting-related lawsuits this fall. The ruling from the 5th US Circuit Court of Appeals is a victory for the Republican National Committee and others who brought the case in Mississippi, a non-battleground state with very little mail-in voting, seeking a ruling by a far-right circuit court friendly to their arguments. “Voters deserve nothing less than a fair and transparent election which ends on November 5th. “Congress statutorily designated a singular ‘day for the election’ of members of Congress and the appointment of presidential electors,” the 5th Circuit panel said. “That is not to say all the ballots must be counted on Election Day,” the opinion states.
