CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. In a 4-3 ruling issued last month, the state court said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.

Donald J. Trump might one day have to pay E. Jean Carroll the $83.3 million she was awarded, but that day is not today. Mr. Trump called the jury’s decision “Absolutely ridiculous!” and vowed to appeal the verdict, a process that could take months or more. And while he is waiting for an appellate court to rule, Mr. Trump need not cut Ms. Carroll a check. Mr. Trump can pay the $83.3 million to the court, which will hold the money while the appeal is pending. This is what he did last year when a jury ordered him to pay Ms. Carroll $5.5 million in a related case.

CNN —The parents of Ethan Crumbley, the teenager who in 2021 opened fire at his high school in Oxford, Michigan, are set to go on trial for manslaughter in a case that will test the limits of who is responsible for a mass shooting. Opening statements in Jennifer Crumbley’s trial are set for Thursday, and James Crumbley’s trial is tentatively scheduled to start March 5. They also say the parents did not mention the gun to school officials in a meeting to discuss Ethan’s disturbing drawings just hours before the fatal shooting. According to a prosecution filing from last year, Jennifer Crumbley “placed blame” on her husband in the shooting, leading to the split. Jennifer Crumbley later posted on her social media, “mom and son day testing out his new Christmas present,” prosecutors said.

In a unanimous decision, the Maine Supreme Judicial Court dismissed Bellows' appeal of the order requiring her to await the U.S. Supreme Court decision before withdrawing, modifying or upholding her decision to keep Trump off the primary ballot on Super Tuesday. NEW YORK (AP) — U.S. regulators have barred TurboTax maker Intuit Inc. from advertising its services as “free” unless they are free for all customers, or if eligibility is clearly disclosed. The order also bars Intuit from “misrepresenting any material facts about its products or services,” including refund policies and price points. There was no financial penalty in the FTC's order, but Intuit has previously faced hefty charges over the marketing of “free” services. In a 2022 settlement signed by the attorneys general of all 50 states, Intuit agreed to suspend TurboTax’s “free, free, free” ad campaign and pay $141 million in restitution to nearly 4.4 million taxpayers nationwide. Those impacted were low-income consumers eligible for free, federally-supported tax services — but paid TurboTax to file their federal returns due to “predatory and deceptive marketing,” New York Attorney General Letitia James said.

CNN —The federal appeals court in Washington, DC, declined to rehear arguments over whether former President Donald Trump can be prohibited from talking about witnesses and court staff while he awaits trial in the special counsel’s January 6 criminal case. Trump has unsuccessfully tried to challenge the gag order placed on him by Judge Tanya Chutkan late last year through appeals. The 11 judges from the DC Circuit Court of Appeals on Tuesday declined to touch the case after a three-judge panel previously upheld the gag order against Trump. Trump can appeal the ruling to the Supreme Court, and his attorneys have previously indicated that they would appeal the matter to the nation’s highest court if necessary. New York CNN —The Federal Trade Commission ruled in a final order and opinion Monday that TurboTax, the popular tax filing software, engaged in deceptive advertising and banned the company from advertising its services for free unless it is free for all customers. By running ads for “free” tax services that many customers were not qualified for, the tax filing software violated the FTC Act and deceived consumers, the agency said. The FTC had first sued Intuit, TurboTax’s owner, for its deceptive advertising in 2022. Intuit cannot advertise or market any goods or services as free unless it’s free for all customers, the FTC ordered. The FTC added if the service isn’t actually free for the majority of consumers, TurboTax could state that as well.

CNN —Italy’s high court has ruled that fascist salutes are legal at rallies unless they threaten public order or risk reviving the country’s outlawed fascist party. Several members of Italy’s opposition parties and Jewish community leaders have criticized the ruling and plan to rally against it, according to local media reports. The ruling comes nearly two weeks after a video showed more than 150 men performing the fascist salute – sometimes called the “Roman salute” – in central Rome to commemorate the January 7, 1978 killing of two members of a far-right youth group. The high court ruling, handed down Thursday, is not related to the recent January 7 rally, which took place in front of the former headquarters of the neo-fascist Italian Social Movement (MSI) party, where Italian Prime Minister Giorgia Meloni began her political career. CNN —New York’s top court has dismissed an appeal from Donald Trump’s lawyers to remove the gag order placed on the former president in the New York Attorney General’s civil fraud trial. New York’s appellate court had reinstated the order from Judge Arthur Engoron, which prohibited Trump and his attorneys from making public statements about the courtroom staff in the $370 million trial that wrapped up this month, in November, 2023. Tuesday, the New York’s Court of Appeals dismissed the appeal, stating that “no substantial constitutional question is directly involved.”The order, initially issued by Engoron in October, bars Trump from making public statements about court staff after Trump made numerous comments about a clerk, who the former president said is biased against him. The judge had twice fined Trump for violating the order. The judge last year found that Trump is liable for fraud in the civil case, and he plans to issue a full decision in the bench trial by the end of this month on damages and six additional claims.

Kenneth Eugene Smith’s attorneys on Monday asked the 11th U.S. The question of whether Alabama will ultimately be allowed to attempt the nation’s first execution using nitrogen gas could end up before the U.S. Supreme Court. An appeals court upheld the disorderly conduct convictions Friday of actor Jussie Smollett, who was accused of staging a racist, homophobic attack against himself in 2019 and lying about it to Chicago police. Smollett, who appeared in the TV show “Empire,” challenged the role of a special prosecutor, jury selection, evidence and many other aspects of the case. Engoron had imposed that order on Trump, and later his attorneys, after they repeatedly targeted the judge's principal law clerk, Allison Greenfield. In its order Thursday, a four-judge appellate panel lifted a temporary suspension of the gag order, which was put in place while Trump appealed the speech restrictions.
