Fresh from a devastating loss to Donald Trump, Vice President Kamala Harris may now head to Capitol Hill to defy him in what could be her last major act in office. As the president of the Senate, Harris wields the constitutional power to provide a tie-breaking vote. “We are going to use the lame duck to confirm judges. GOP senators can slow the process down, but Democrats need a simple majority to overcome any obstruction and confirm judges. The senior administration official declined to discuss whether Biden has talked to Harris or Schumer about lame-duck confirmations.

Law enforcement missed critical opportunities to prevent a 2022 mass shooting at an LGBTQ+ nightclub in Colorado, a pair of lawsuits filed over the weekend allege. The suits claim that the massacre at Club Q in Colorado Springs, which killed five people and injured at least 19, could have been averted if authorities had enforced Colorado’s red flag law. The El Paso County Board of County Commissioners and former El Paso County Sheriff Bill Elder are named as defendants in the suits, which accuse them of negligence and, in the case of the deceased victims, wrongful death. A spokesperson for El Paso County declined to comment on the allegations, citing the pending litigation. The El Paso County defendants “willfully and wantonly ignored the shooter’s warning signs,” the legal documents say.

Senate Democrats who pulled off victories even as President-elect Donald Trump won their states believe the Democratic Party can learn some lessons from their races as it grapples with losing control of Washington. Democrats still lost the Senate majority despite those victories, with Republicans flipping seats in Montana, Ohio and West Virginia. Democrats acknowledged Harris faced some headwinds in running a protracted campaign after taking over the ticket in late July. And while his party lost the White House, the House and the Senate, Schumer touted the Senate victories as more evidence that the party should be focused on the economy. Sometimes Democrats may be a little too solution-oriented, and people want to, first before you get to the solutions, hear empathy.

“We’re expecting this holiday period to be very consistent with that,” he said. Retailers, including Walmart, are contending with a mixed bag of factors this holiday season. The holiday season is also shorter this year and parts of the U.S. have had unseasonably warm weather, two dynamics that could hurt retailers. That would be lower than the 3.9% year-over-year jump from the 2022 to 2023 holiday season, when spending totaled $955.6 billion. Rainey said the holiday period is “off to a pretty good start.”He said items like TVs, Apple AirPods, Beats headphones and even tires have been selling.

And now, as Trump continues to fill out the upper echelons of his transition and administration, some key donors appear to be in the fray. Chris Wright, the Liberty Energy CEO tapped to be Trump’s energy secretary, gave the campaign and affiliated committees more than $235,000. Marc Rowan, the billionaire CEO of Apollo Global Management, gave $1 million to Right for America, a pro-Trump super PAC. The super PAC also ran a controversial program that gave away $1 million checks to swing-state voters who signed Musk's petition. (His father, Charles Kushner, who was pardoned by Trump, gave that same amount, plus another $1.2 million to a pro-Trump super PAC).

COLUMBIA, S.C. — Susan Smith, who shocked the nation 30 years ago when she rolled her car into a lake with her two children inside and watched them drown, will ask a parole board Wednesday to release her from prison. As of Monday, 471 people had written to the South Carolina Department of Probation, Parole and Pardon Services regarding Smith's hearing. Former lead prosecutor and current South Carolina State Rep. President-elect Donald Trump is now receiving intelligence briefings after having declined them during his campaign, according to a source with knowledge of the matter and a former U.S. official. “ODNI is acting consistent with the tradition, in place since 1952, of providing intelligence briefings to the President-elect,” an ODNI spokesperson said. The office would not comment specifically on whether Trump was actually accepting the offer of the briefings. A Trump transition team representative was not able to confirm that Trump had begun receiving the briefings. Before the election, Trump had said he did not want to get the intelligence briefings to avoid any chance he would be accused of leaking information.

For “Interior Chinatown” star Jimmy O. Yang, playing an invisible Chinatown extra in the new series hit close to home. “Interior Chinatown,” based on the National Book Award-winning novel of the same name by Charles Yu, is technically a show within a show. His character, Willis, sneaks into “Black and White” by disguising himself as the tech guy and the Chinese food deliveryman, using these stereotypes to his advantage. Though Willis learns to jump between the worlds of “Black and White” and Chinatown, Fatty stubbornly refuses to leave the Chinese restaurant where the two friends work. “We were really strategic with when to highlight the fact that I came from both worlds,” Bennet said.

Walmart’s CFO John David Rainey said the retailer would likely have to raise prices on some items if President-elect Donald Trump’s proposed tariffs take effect. “We never want to raise prices,” he said in an interview with CNBC on Tuesday. Beauty CEO Tarang Amin told CNBC in an interview earlier this month that the company could be forced to raise prices if the higher duties take effect. The majority of goods Walmart sells are not at risk of tariffs. The home improvement retailer addressed the potential levies as it reported earnings on Tuesday.

At 34, he was the city’s youngest ever mayor, and he campaigned on a promise of self-determination for the predominantly Black city. It’s an ongoing factor in Mississippi politics,” said Leslie McLemore, a former Jackson State University political science professor who also once sat on the Jackson City Council. That was on top of years of boil-water notices that eroded residents’ trust in the city’s water supply. In April, a push by conservative legislators to strip local control of the city’s water system failed for the second time in the House. Rogelio V. Minnesota Democratic party chair Ken Martin has formally announced his bid to lead the Democratic National Committee, as the party attempts to piece itself together following a stinging defeat against Donald Trump. Martin, a DNC vice chair and leader of the Association of State Democratic Committees, has gained early traction with some delegates according to interviews with several state DNC members. Martin is a big backer of the DNC acting as an umbrella organization that strengthens state parties across the board. “Whoever the next DNC chair is really has to, I believe, have a fierce commitment to making sure that they support the 57-state party strategy itself.”Nebraska Democratic Party chair Jane Kleeb is among those backing Martin, saying in an earlier interview that she was interested in seeking the ASDC chair post that Martin now holds. Wisconsin Democratic Party Chair Ben Wikler is also interested in a run.

New York City declared a drought warning on Monday, its first in 22 years, as the Northeast deals with severe dry conditions and brush fires during a historically dry autumn. The last drought warning in New York City was issued in 2002. Under a warning city agencies adopt drought protocols and voluntary water conservation is encouraged for New Yorkers. New York City's water supply needs almost 8 inches of rain to reach normal levels, officials said. Kathy Hochul also declared a statewide drought watch on Monday citing “a historic shortage of rainfall” and elevated 15 counties in the Mid-Hudson region and New York City, to a drought warning.

Severe weather is set to hit opposite ends of the country this week, with a powerful low pressure system — followed by an atmospheric river — set to bring damaging winds, heavy rain and snow to the Pacific Northwest, while storms and possible flooding are headed for the Gulf Coast. ET update that a "rapidly strengthening and extremely powerful" weather system could bring winds of 70 mph across northern California and parts of Washington and Oregon from Tuesday. Satellite images show a weather system approaching the Pacific Northwest on Tuesday morning. Further south, the eastern and central Gulf Coast is due to receive heavy rain and possible flash floods, with eastern Louisiana to the western Florida Panhandle the area most at risk, the NWS said. Elsewhere, a deep low pressure system will bring moderate to heavy rain across the Plains region, with a marginal risk of severe thunderstorms.

Nebraska’s Dan Osborn is returning to work Tuesday as a steamfitter after his unsuccessful Senate run, but his political career isn’t over. Osborn, who ran as an independent, is launching a political action committee, called the Working Class Heroes Fund, to support working-class candidates of all parties. And he isn’t ruling out another run for office after his loss to GOP Sen. Deb Fischer. Osborn said his PAC will support candidates of any party, and he said he didn’t expect to have many policy litmus tests, apart from supporting campaign finance overhaul and rejecting corporate donations. His Senate campaign raised $7.9 million through mid-October, according to the latest campaign finance reports, and he said it ultimately raised more than $14 million.

But planning ahead to take advantage of them is getting harder, and that’s largely thanks to Amazon. NBC News’ Holiday Price Check is tracking the online prices of five gift items, each in a popular product category, to determine when the best deals hit. Already, it’s clear that Amazon is often setting the pace. Target, for example, has narrowed the online price gap with Amazon in key product categories since last year, Profitero found. But for retailers, the race for shoppers’ holiday dollars is increasingly a discounting competition.

Vacant federal office space in downtown Washington is costly to maintain and a deep source of frustration to Mayor Muriel Bowser. She told reporters last week that she had requested a meeting with President-elect Donald Trump and that top on her agenda is pushing federal workers to return to downtown Washington. All told, the U.S. has roughly 2.2 million federal workers. With fewer people in the office, the cost of excess federal office space has become a concern. In 2004, a little over 750,000 federal workers were eligible to work from home.

WELLINGTON, New Zealand — Tens of thousands of New Zealanders rallied in front of Parliament on Tuesday in one of the country’s largest ever protests to oppose a bill, which opponents say seeks to dilute the rights of Maori and threatens to set race relations back decades. Massive crowds estimated by the police at 42,000 gathered at Parliament, where the Treaty Principles Bill was introduced earlier this month by legislators who want to reinterpret a 184-year-old treaty signed between the British and Indigenous Maori. “I’m here for my grandchildren, my children and for their children,” said Hoana Hadfield from Wellington, who was marching in a protest for the first time. Helmut Modlik, a leader in the Ngati Toa tribe, told the crowd that it was too late to divide the country. The Pennsylvania Supreme Court on Monday ordered election officials in the state to stop counting mail-in ballots marked with the wrong date or missing dates from their outer envelopes. The court order specifies that Bucks, Montgomery and Philadelphia counties, where Republicans argue that officials have opted to count mail-in ballots with errors on their outer envelopes, must adhere to the high court's earlier rulings, which said undated or misdated mail-in ballots should not be counted. “David McCormick and the national Republicans are working to throw out provisional ballots cast by eligible Pennsylvania voters and accepted by county boards. McCormick leads Casey by 17,408 votes with 99.7% of the vote in and 24,000 ballots still to be counted. HONG KONG — A Hong Kong court sentenced dozens of leading pro-democracy figures to up to 10 years prison Tuesday in the single largest trial under a national security law that critics say has been used to all but eliminate political dissent in the Chinese territory. Lawyers for the defendants have argued that such action was within the bounds of Hong Kong law. In March, Hong Kong’s opposition-free legislature also enacted local national security legislation. Among the 47 are “second-tier pan-democrats” who were previously active members of the Hong Kong legislature, Burns said. After having called more than 30 witnesses, the prosecution in the manslaughter trial of Daniel Penny, who is charged in the chokehold death of Jordan Neely, rested its case Monday. Penny put him in a chokehold that lasted about six minutes, prosecutors have said and evidence presented at trial has shown. Penny’s attorneys have said he acted to protect himself and other subway riders from “a seething, psychotic” Neely. Again and again, Harris answered that she believed the chokehold was the most probable cause of Neely’s death. Harris testified Friday that she based her ruling on her autopsy findings, coupled with the video and the investigative information about it.

CNN —China rejected a meeting with Defense Secretary Lloyd Austin during a conference in southeast Asia this week, marking the latest turn in a tumultuous relationship between the two countries’ defense leaders. But China did not accept the offer, pointing to a recent Taiwan arms sale as their rationale, a senior defense official told reporters traveling with Austin in Laos. The Chinese rejection of the meeting in Laos comes just days after US President Joe Biden and Chinese President Xi Jinping met in Peru for their final meeting under Biden’s administration. China has often used the cancellation of meetings and lines of communication as a way of registering displeasure with the United States. After then-House Speaker Nancy Pelosi visited Taiwan in 2022, China cut off a number of lines of communication with the US, including on military issues and climate.
