Former President Donald Trump will not head to trial next month alongside two of his co-defendants whose prosecutions in the sweeping Georgia election interference case were severed by a judge Thursday. But McAfee declined an effort by Chesebro and Powell to separate their cases from each other, meaning they are both set to head to the same trial on Oct. 23. The ruling is a blow to Georgia prosecutors who wanted to keep all 19 co-defendants together in the case. McAfee wrote in his order that severing Chesebro and Powell was "simply a procedural and logistical inevitability." "The Fulton County Courthouse simply contains no courtroom adequately large enough to hold all 19 defendants, their multiple attorneys and support staff, the sheriff's deputies, court personnel, and the State's prosecutorial team," McAfee wrote.

CNN —Fulton County Superior Court Judge Scott McAfee, who is presiding over the Georgia election subversion case against former President Donald Trump and 18 other co-defendants, will hold his first hearing Wednesday afternoon amid questions of how soon a trial could begin. The hearing could provide key insight into how much evidence Fulton County prosecutors have in their case against Trump and his allies who are accused of interfering in Georgia’s 2020 election results to try to flip the state away from Joe Biden. All 19 defendants charged in the sprawling Fulton County racketeering case – including Powell and Chesebro – have pleaded not guilty and waived their right to an in-person arraignment. Last week, Chesebro’s legal team filed a separate motion asking the Fulton County judge not to force him go to trial alongside his co-defendant Powell. Willis has said she wants to keep the case together and hold one massive trial for all the defendants beginning in October.

Ferguson Jr. U.S. WASHINGTON — Fulton County Judge Scott McAfee said Thursday that all court proceedings related to former President Donald Trump's election interference case will be streamed live for the public. The broadcasting of Trump's proceedings would give the public unprecedented access to what will be one of the most high-profile trials in American history. Earlier this month, congressional Democrats, led by California Rep. Adam Schiff, called for Trump's federal criminal trials to be televised. Trump, the current Republican presidential front-runner, is facing 13 felony counts including racketeering, soliciting false statements and criminal conspiracy.

A judge set bond Tuesday for the only defendant in the Georgia election interference case who was jailed after surrendering to authorities last week. All of the other defendants, including Trump, were released last week on bond after they were booked. Richardson also cited a pending case for Floyd, in which he allegedly assaulted a federal officer this year, as among the reasons she denied his bond request. Prosecutors in the Georgia case have accused Floyd, the former leader of Black Voices for Trump, of involvement in a scheme to pressure election worker Ruby Freeman into making false statements. Trump and other co-defendants in the case are scheduled to be arraigned on Sept. 6, though some have waived formal arraignments and already pleaded not guilty.
