Trump has denied wrongdoing in all the cases, saying “the witch hunt continues” in response to the Georgia state court indictment on alleged interference in the 2020 election results. This is true purely as a practical matter, regardless of what Republicans or anyone else think of the merits of the legal cases against him. Paradoxically, the state cases could be an even bigger problem in this area than either of special counsel Jack Smith’s. If convicted of a state crime, Trump wouldn’t possess even the theoretical ability to pardon himself after the election. Unless the reality of the political danger these indictments pose soon sets in, Republicans could be sleepwalking toward disaster in 2024.

Throughout the inquiry into former President Donald J. Trump’s handling of classified material, his insular world at Mar-a-Lago was rife with intrigue, anxiety and competing motives as investigators sought testimony and evidence from his some of his closest aides, advisers, lawyers and even members of his Secret Service detail. Some reporters were granted access to the courtroom through a lottery system. No cell phones or laptops were allowed in the courthouse, leaving us to rely on an old-school journalism approach of pay phones and notepads. Here I was, reporting what happened inside a room that only about 100 people would witness. Journalists with the closest access to the Trump arraignment were inside the courtroom, within feet of the former president. But in the case of the new indictment by the special counsel, Jack Smith, “no worse” comes with an additional twist. Trump’s case is not the first high-profile instance of a senior public official mishandling classified information. Hillary Clinton comes to mind, and while the Department of Justice might be able to prosecute Trump under facts similar to those in Clinton’s case, it should not.
