CNN —The Supreme Court agreed Wednesday to decide whether Donald Trump may claim immunity in special counsel Jack Smith’s election subversion case, adding another explosive appeal from the former president to its docket and further delaying his federal trial. The high court on Wednesday ordered that a lower court ruling against Trump remain on hold until it decides the issue. As is common when granting a case, the court released only a short order and did not indicate how the justices voted. Trump had filed an emergency request at the Supreme Court on February 12 asking the justices to block a lower court ruling that he was not immune from Smith’s election subversion charges. Trump and Smith filed dueling briefs at the Supreme Court over whether the decision should be put on hold.

Chesebro’s social media presence Pro-Trump attorney Kenneth Chesebro told Michigan investigators that he doesn’t have any social media accounts, including Twitter. But CNN uncovered a secret Twitter account that Chesebro used to anonymously post about the 2020 election in real-time. Yet in his interview with Michigan investigators, Chesebro said the very opposite, claiming that the entire electors plan was contingent on the courts. Some might not reach trial this year, while one is set to begin in a matter of weeks. In all, Trump faces 40 felony charges in the classified documents case. U.S. District Judge Aileen Cannon set a trial date of May 20, 2024, though she has signaled that it may be pushed back. Jack Smith, the special counsel prosecuting former President Donald J. CNN —Special counsel Jack Smith pressed the Supreme Court on Wednesday to let stand a lower court ruling that denied former President Donald Trump immunity from prosecution, urging the justices to allow the trial in his election subversion case to begin quickly. “The charged crimes strike at the heart of our democracy,” Smith told the Supreme Court. Smith asked that if the court orders a delay that it consider the request an appeal and set the case for expedited briefing and argument. Trump on Monday asked the Supreme Court to temporarily block that decision so he could appeal it. (AP) — Wilhelmenia Wiggins Fernandez Smith, a renowned soprano known for her performance in the 1981 French cult-classic film “Diva” and who sang through the U.S. and Europe during her operatic career, has died at age 75. Funeral services were held Friday for Fernandez Smith at a church in Lexington, Kentucky, where she had moved after residing for years in her native Philadelphia. CNN —In a fight over keeping the identity of witnesses protected in the criminal document mishandling case against Donald Trump, special counsel Jack Smith this week detailed myriad threats against prosecutors, judges and other witnesses. One threat against a witness has prompted a federal investigation, the special counsel’s office wrote in court filings. Possible witnesses against Trump are “routinely” being threatened in a way that could intimidate them from participating in the case, they added. Trump’s lawyers have sought to make public the witness names and related information in the case, since they have included them in court filings. “Their objective is plain—to delay trial as long as possible,” prosecutors wrote in a filing Thursday in the case.

The appeals court has set up a very fast schedule for Donald Trump to appeal their ruling rejecting his claims of immunity from criminal prosecution. The court is giving Trump until February 12 to file an emergency stay request with the Supreme Court, which would stop the clock while his attorneys craft a more substantive appeal on the merits. If he is successful with that, the criminal trial will not resume until after the high court decides what to do with his request for a pause. If Trump does not appeal the ruling, the case would be sent back to the trial-level court in Washington, DC, as soon as next week for his trial to continue. Federal prosecutors pushed back on Friday against former President Donald J. Trump’s contention that his prosecution over the handling of classified documents was motivated by a longstanding bias against him among the intelligence agencies and other government officials. The pushback by the office of the special counsel, Jack Smith, came in a 67-page court filing. The filing was intended to argue against Mr. Trump’s requests for additional discovery materials in the classified documents case. When Mr. Trump’s lawyers made those requests for materials last month, they signaled that they planned to place accusations that the intelligence community and other members of the so-called deep state were biased against Mr. Trump at the heart of their defense. But Mr. Smith’s team said that the former president’s requests for additional information were “based on speculative, unsupported, and false theories of political bias and animus.”

Washington CNN —The Washington, DC, trial date in the federal election subversion case against former President Donald Trump has been postponed because of ongoing appeals about the power of the presidency, according to a new court order in the case. Though not official until US District Judge Tanya Chutkan’s order Friday, it became increasingly less likely that the March trial date would hold. The federal case against Trump had been set to begin first among the criminal indictments he faces. The Mar-a-Lago documents case judge, Aileen Cannon, a Trump appointee in south Florida, has left open the possibility of revisiting the trial schedule at a hearing March 1. The state-level judge presiding over Trump’s 2020 election conspiracy in Georgia has yet to set a trial date.

Opening statements are scheduled in Brooklyn federal court for the murder trial of Karl Jordan Jr. and Ronald Washington, who prosecutors say killed the 37-year-old Jay over a drug deal in 2002.
