CNN —A federal judge has dismissed Donald Trump’s counter defamation lawsuit against E. Jean Carroll, dealing another legal blow to the former president. Carroll said, “Oh, yes he did.”In throwing out Trump’s lawsuit, the judge wrote, “Indeed, the jury’s verdict in Carroll II establishes, as against Mr Trump, the fact that Mr Trump ‘raped her’, albeit digitally rather than with his penis. Trump is set to go to trial in January on another defamation lawsuit brought by Carroll in 2019 for statements Trump made while he was president. The former president has also appealed that jury’s verdict and other “adverse” rulings. CNN —The former head of counterintelligence at the FBI’s New York office is in talks to plead guilty to charges relating to work he allegedly did for a sanctioned Russian oligarch after leaving the government, according to a court order. Charles McGonigal was indicated earlier this year on charges, including violating US sanctions, conspiracy, and money laundering for working in 2021 with Russian oligarch Oleg Deripaska, who was sanctioned for interfering in the 2016 US presidential election. The same day McGonigal was charged in a separate case in Washington for concealing $225,000 he allegedly received from a former Albanian intelligence employee. McGonigal, who is one of the highest-ranking former FBI officials to be charged with a crime, has pleaded not guilty to both indictments. No further details were included in the brief court order setting the plea proceeding.

The additional arguments were made in a court filing Friday — following a hearing on Wednesday when prosecutors first asked the judge to detain the co-founder of FTX. “The defendant’s argument that the defendant did nothing other than exercise his First Amendment rights is a red herring. An indictment unsealed Thursday in New York charges Alexander Mashinsky with securities fraud, wire fraud and commodities fraud. “Mashinsky portrayed Celsius as a modern-day bank, where customers could safely deposit crypto assets and earn interest,” the indictment states. Earlier this year, the New York attorney general’s office also sued Mashinsky for fraud. In a counter claim filed Tuesday night, Trump alleges that Carroll defamed him when she appeared on CNN the morning after the jury awarded her $5 million in damages. Carroll was asked about the verdict finding Trump sexually abused Carroll but did not rape her as she alleged. The counter claim is the latest legal salvo in a multi-year legal battle between Trump and Carroll. Carroll first sued Trump for defamation in 2019 after he denied her allegation that he raped her in the mid-1990s in the dressing room of Bergdorf Goodman.

New York CNN —Lawyers for FTX founder Sam Bankman-Fried on Monday filed motions to dismiss the US government’s fraud charges against him. Bankman-Fried’s attorneys said the government failed to properly explain what offenses the former CEO of the bankrupt crypto exchange committed. Bankman-Fried has pleaded not guilty to the 13 charges. Prosecutors allege that Bankman-Fried stole FTX customer deposits to finance risky bets at his hedge fund, Alameda Research, and to funnel contributions to American politicians. Three of Bankman-Fried’s former business partners — Gary Wang, Caroline Ellison and Nishad Singh — have pleaded guilty to numerous charges and are cooperating with investigators.

CNN —The New York judge handling Donald Trump’s criminal case approved a protective order on Monday that limits the former president’s ability to publicize information on social media related to evidence in the investigation. The Manhattan district attorney’s office had submitted the protective order to restrict Trump’s ability to share information his attorneys receive in the discovery process in part because of Trump’s social media posts about Manhattan District Attorney Alvin Bragg and witnesses in the case. Trump’s attorneys had opposed the protective order, arguing that it infringed on Trump’s First Amendment rights as he makes another run for president in 2024. On Monday, the district attorney’s office filed a request for a conference to discuss the process for a US district judge to hear the motion. In its filing Monday, the district attorney’s office noted that the defense team’s request to move the case to federal court did not pause the state court’s schedule.

It comes just over a year since the NFL was warned by a coalition of six attorneys general to take “swift action” to improve conditions for female employees. The attorneys general on Thursday issued subpoenas to the NFL seeking relevant information, the statement said. “No person should ever have to endure harassment, discrimination, or objectification in the workplace,” said NY Attorney General James. “No matter how powerful or influential, no institution is above the law, and we will ensure the NFL is held accountable.”“California will not tolerate any form of discrimination,” California Attorney General Bonta said.

Trump’s attorneys contend that Bragg and former prosecutor Mark Pomerantz made “disparaging and obnoxious” comments about their client.
