Bitcoin soared 6% on Tuesday after Grayscale won its crypto case against the SEC. Grayscale sued the SEC in 2022 after the agency rejected its application to turn its bitcoin trust into an ETF. New York CNN —The price of bitcoin surged Tuesday after a US court cleared a path for the nation’s first bitcoin exchange-traded fund. The ruling is a breakthrough moment for crypto investors and a setback for the Securities and Exchange Commission, which has been trying to rein in the industry. The three-judge panel for the DC Court of Appeals overruled an SEC decision denying Grayscale Invesments permission to launch a bitcoin-focused ETF. A bitcoin ETF would allow investors to have exposure to the digital asset without actually owning it. Bitcoin prices, which have been especially volatile in recent weeks, rose about 5% to $27,445.

The price of bitcoin surged Tuesday after the U.S. Court of Appeals for the DC Circuit ruled that the Securities and Exchange Commission was wrong to deny crypto investment giant Grayscale permission to convert its popular bitcoin trust into an ETF. "Today's decision reaffirms that a bitcoin ETF in the U.S. is a matter of when, not if," said Steve Kurz, Global Head of Asset Management at Galaxy, which filed with Invesco for its bitcoin ETF. Grayscale initiated its lawsuit against the SEC in June 2022 after the agency rejected its application to turn its bitcoin trust, better known by its ticker GBTC, into an ETF. The company decided to pursue the ETF, which would be backed by bitcoin rather than bitcoin derivatives, after the SEC approved ProShares' futures-based bitcoin ETF in October 2021. The Grayscale Bitcoin Trust itself jumped 16%.

A federal appeals court struck down the SEC's order denying the conversion of the Grayscale Bitcoin Trust (GBTC) into an exchange traded fund. The decision does not guarantee that investors will be able to freely trade a bitcoin ETF anytime soon, however. Another impact could be for the bitcoin futures ETFs that are already on the market, led by the $940 million ProShares Bitcoin Strategy ETF (BITO) . Those funds could see outflows if investors choose the spot bitcoin products instead. Consider Valkyrie's attempt to change its bitcoin futures product into a broader crypto fund that also holds ether futures.

On Tuesday, the court sided with Grayscale in a lawsuit against the Securities and Exchange Commission which had denied the company's application to convert the Grayscale Bitcoin Trust to an ETF. A spot bitcoin ETF would be traded through a traditional stock exchange, although the bitcoin would be held by a brokerage, and would allow investors to gain exposure to the world's biggest cryptocurrency without having to own the coin themselves. Many crypto bulls believe that approval of a spot bitcoin ETF will lead to more mainstream institutional adoption. Bitcoin , ether and other major cap crypto coins surged on the news, and Coinbase , which is listed as the custodian partner in multiple spot bitcoin ETF applications, was up more than 14% on Tuesday. The company decided to pursue the ETF, which would be backed by bitcoin rather than bitcoin derivatives, after the SEC approved ProShares' futures-based bitcoin ETF in October 2021.

Cryptocurrency prices jumped on Tuesday after the industry’s largest fund manager scored a legal victory in its long-running attempt to make it easier for investors to put Bitcoin in their portfolios. The U.S. Court of Appeals for the D.C. Circuit ruled that the Securities and Exchange Commission had improperly denied an application from the asset manager, Grayscale Investments, to create a Bitcoin exchange traded fund, calling the rejection “arbitrary and capricious.”Grayscale is seeking to create the fund to give investors exposure to the cryptocurrency via traditional brokers and markets rather than digital asset exchanges. has already approved funds that bet on Bitcoin futures, or price fluctuations in the cryptocurrency, but it has denied numerous requests for an E.T.F. holding Bitcoin itself, arguing that the markets are subject to fraud and manipulation.

It then slipped to a two-month low of $26,172 during Asian trading hours on Friday, its lowest since June 16 . It was lifted in June by BlackRock applying to launch a spot bitcoin exchange-traded fund (ETF) in the United States. Some investors interpreted that move as an indication that the U.S. Securities and Exchange Commission would approve spot bitcoin ETF applications from various asset managers, including Grayscale.

Ark Invest CIO Cathie Wood told Bloomberg News earlier this week that she expected the SEC to make a decision on multiple funds at once. Crypto investment firm Grayscale is still awaiting a court decision after the SEC repeatedly rejected its proposal to convert the Grayscale Bitcoin Trust into an ETF. The Cboe BZX exchange filed with the SEC for a rule change in April that would allow the listing of the Ark21 spot bitcoin fund. The filing has since been amended several times and now includes a surveillance-sharing provision that was introduced in BlackRock's filing for a bitcoin fund. The SEC has rejected dozens of prior applications to create a spot bitcoin ETF, and SEC Chair Gary Gensler appeared to be leading a crackdown against the crypto industry earlier this year.

While a decision from the Securities and Exchange Commission on the future of spot bitcoin ETFs could come as soon as this weekend, Bitwise Asset Management CIO Matt Hougan warns that crypto investors might have to wait a while longer. "In every case since 2016, [the SEC] has taken up to or entirety of the 240 days they have to review these applications," Hougan told CNBC's Bob Pisani on "ETF Edge" on Monday. Besides Ark, eight other organizations including Hougan's firm, Bitwise, have filed applications for a spot bitcoin ETF. Grayscale has also filed to convert its Grayscale Bitcoin Trust into a spot fund. "I think there should be a fair playing field that allows us to have multiple spot Bitcoin ETFs that compete in the market," Hougan said.

Crypto firm DCG appoints M&A specialist Mark Shifke as CFO

July 31 (Reuters) - Digital Currency Group said on Monday it had appointed Mark Shifke, a former JPMorgan Chase (JPM.N) and Goldman Sachs executive, as its chief financial officer. Shifke has almost four decades of experience in the financial industry, specializing in mergers and acquisitions, the company said in a statement. The appointment comes at a time when DCG is facing legal battles with cryptocurrency exchange Gemini, the largest creditor of DCG's bankrupt crypto lending firm Genesis. DCG owns a portfolio of crypto companies in addition to Genesis, including crypto news and events site CoinDesk and New York-based Grayscale, a major digital asset manager. "Mark brings deep finance and fintech experience, strategic vision, and overall presence as a leader to the role," DCG founder and CEO Barry Silbert said.

The dollar index, which usually moves inversely with bitcoin, also hit its lowest level in more than a year last week, and bitcoin didn't budge. "It wasn't until the bitcoin halving a year later, in the spring of 2020, that we saw a market recovery transform into a sustained rally. Investors tend to expect seasonal gains in the fourth quarter, which has brought bitcoin a 93.38% return on average since 2013. The Ripple case also gives the industry hope that the SEC "takes its foot off of the enforcement pedal," Canaccord Genuity said. "Until the next difficulty adjustment, which will happen in about two weeks, miners' selling pressure will likely continue," Hasegawa added.

It's an opportunity worth watching for investors, and crypto speculators have recently been doing just that. Grayscale Investments recently highlighted three potential risks posed by AI that crypto could potentially limit – identity verification, centralization and data ownership and privacy. Accredited U.S. investors can gain direct exposure to AI-related crypto protocols by investing in private venture fundraising rounds, he added. "So far in 2023, venture capitalists have invested $422 million in crypto applications related to AI, privacy, and identity," according to Grayscale. "In total, the crypto-AI intersection represents more than 10% of total crypto venture capital (VC) funding to date, including two out of the four largest funding rounds."

The lending unit of crypto firm Genesis filed for bankruptcy in January after the collapse of key counterparties including FTX caused it to freeze customer redemptions in November. Its largest creditor is Gemini, founded by billionaire identical twins Cameron and Tyler Winklevoss who are also former U.S. Olympic rowers. A bankruptcy court appointed a mediator in April to help Genesis, DCG and its creditors agree on a restructuring plan, but the parties have yet to reach a deal despite several extensions. Under the offer, DCG would retain the proceeds from the sale of Genesis' lending unit. If Silbert and DCG do not agree, Gemini will sue Silbert and DCG, and file a motion to place DCG in default and demand immediate debt repayments, Winklevoss said.
