The rooftop solar installer SunPower has filed for bankruptcy, after struggling for months in the face of high interest rates and allegations of misconduct in its reporting practices. SunPower stock fell 32% to 55 cents per share Tuesday. SunPower listed assets and liabilities between $1 billion and $10 billion in its Chapter 11 protection filing late Monday in U.S. Bankruptcy Court for the District of Delaware. SunPower plans to sell its remaining assets through the bankruptcy process, the company said. But SunPower's stock has also been under pressure due to allegations of misconduct in its reporting practices.

New York CNN —Elon Musk filed a new lawsuit against OpenAI and CEO Sam Altman Monday, re-opening a legal battle in his fights over artificial intelligence. He then dropped the lawsuit in June, without explanation, after OpenAI published old emails from Musk that revolved around OpenAI’s creation. The new lawsuit, filed against OpenAI, Altman and co-founder Gregory Brockman, made the same claims. Morgan Stanley on Friday told its army of financial advisors that it will soon allow them to offer bitcoin ETFs to some clients, a first among major Wall Street banks, CNBC has learned. The firm's 15,000 or so financial advisors can solicit eligible clients to purchase shares of two exchange-traded bitcoin funds starting Wednesday, according to people with knowledge of the policy. Those funds are BlackRock's iShares Bitcoin Trust and Fidelity's Wise Origin Bitcoin Fund, the people said. The move from Morgan Stanley, one of the world's largest wealth management firms, is the latest sign of the adoption of bitcoin by mainstream finance. In January, the U.S. Securities and Exchange Commission approved applications for 11 spot bitcoin ETFs, heralding the arrival of an investment vehicle for bitcoin that is easier to access, cheaper to own and more readily traded.

Anne Wojcicki, CEO of 23andMe , has submitted a proposal to take the genetic testing company private as its stock price continues to hover below $1. The proposed price of 40 cents per share reflects an 11% premium to 23andMe's closing stock price from April. 23andMe went public in 2021 via a merger with a special purpose acquisition company, which valued the company at around $3.5 billion. New York CNN —Bill Ackman, billionaire hedge fund manager and chief executive of Pershing Square Capital Management, is seeking $2 billion to take the company’s investment fund public. In a letter to strategic partners last week, Ackman said that he expected to raise between $2.5 billion to $4 billion. The company will offer 40 million shares priced at $50 apiece, according to a Tuesday filing with the US Securities and Exchange Commission. That would be an additional $300 million value for the investment fund, Pershing Square USA. They’re tinkering in the shadows, doing a thing most normies either don’t understand and/or believe is a scam. “Bitcoiners are looking for political validation after years in the wilderness,” said Eric Soufer, a political adviser to major crypto companies. But running against Vice President Kamala Harris, now the presumptive Democratic nominee, may change the calculus. New York CNN —Federal prosecutors in California on Friday charged prominent investor Andrew Left with multiple counts of securities fraud involving “a long-running market manipulation scheme” yielding at least $16 million in profit. Short-sellers, including Left, often present themselves as researchers sniffing out misleading or fraudulent businesses through independently published reports on their targets. Left, 54, was charged with one count of engaging in a securities fraud scheme, 17 counts of securities fraud, and one count of making false statements to federal investigators. Each securities fraud count carries a maximum prison sentence of 20 years. Separately, the SEC on Friday accused Left and his firm of running a $20 million scheme to defraud his social media followers by publishing false and misleading reports.

Federal prosecutors have criminally charged the well-known short seller and analyst Andrew Left with securities fraud related to allegedly using his public platform to illegally profit to the tune of at least $16 million from manipulating stock market activity contrary to positions he presented to the public from 2018 through 2023. The indictment notes that Left is a frequent guest commentator on CNBC and other business cable news channels. Prosecutors said that Left used Citron's online platform to comment on publicly traded companies and claim that their stock was incorrectly valued by the market. Left, who previously lived in Beverly Hills, California, is charged in the indictment with one count of engaging in a securities fraud scheme, 17 counts of securities fraud, and one count of making false statements to federal investigators. Franklin Templeton is one of the nine spot ether ETF applicants which got approval Tuesday from the Securities and Exchange commission. CEO Jan Van Eck expects spot ether ETFs will help investors diversify, but he sees a different energy level for spot ether ETFs. "I don't think they're going to be the same, same kind of hit [as spot bitcoin ETFs]" Van Eck said. Long-term, Morningstar's Ben Johnson considers the volumes for spot ether ETFs as normal because they're roughly proportional to the relative market cap of ether versus bitcoin .
