Michail Chkhikvishvili, a 21-year-old man from the Republic of Georgia, was indicted on four charges, including soliciting hate crimes and acts of mass violence, according to a statement from the US Department of Justice. In November 2023, Chkhikvishvili began planning a “mass casualty event” for New York City on New Year’s Eve, prosecutors said. “The scheme involved an individual dressing up as Santa Claus and handing out candy laced with poison to racial minorities and children at Jewish schools in Brooklyn,” the Department of Justice statement said. He “drafted step-by-step instructions to carry out the scheme” and shared with the undercover officer “detailed manuals on creating and mixing lethal poisons and gases,” the statement said. “For example, and among other things, the handbook encourages its readers to commit school shootings and to use children to perpetrate suicide bombings and other mass killings targeting racial minorities,” the Justice Department statement said.

CNN —Special counsel Jack Smith said Wednesday that he is appealing a judge’s decision to throw out the indictment against Donald Trump concerning his handling of classified documents. This means the shock ruling would be reviewed by judges from the 11th US Circuit Court of Appeals based in Atlanta. Cannon in her ruling on Monday had said that Smith’s appointment as special counsel was unconstitutional, warranting the dismissal of the case against Trump. Her decision was at odds with the rulings of judges across the country that rejected attacks on the legality of special counsel appointments. Absent a move to speed the appeal in the Trump documents case, it will likely take several months for the appeal to play out in the Atlanta-based appeals court.

Rosenblatt declined to provide details of the plea agreement which was first reported by Stars & Stripes. A spokesperson for OSTC declined to comment on the possibility of a plea deal but said prosecutors did not object to delaying the Article 32 hearing. The day he crossed the border into North Korea, King was supposed to have boarded a flight back to Texas, but he instead left the airport after US Army escorts left him at the security checkpoint. He then went to Fort Bliss; when he arrived, Rosenblatt said, King was ordered into pre-trial confinement where he has remained since October 18.

CNN —Russian cybersecurity company Kaspersky Lab will “gradually wind down” its US operations and lay off its US-based employees after the Department of Commerce announced a ban on the firm selling its products in the United States, Kaspersky said Monday. The Commerce Department last month announced the ban of the sale and provision of Kaspersky software in the United States, citing national security concerns. More than 400 million people and 240,000 companies worldwide use Kaspersky Lab’s software products, according to the company. CNN reported in April that the Commerce Department was taking action against Kaspersky Lab. It appears that the United States is willing to hit Russia over its invasion of Ukraine a lot harder than the Europeans are. This week I interviewed Wally Adeyemo, the deputy Treasury secretary, who is the department’s point person on economic sanctions. Adeyemo, who immigrated from Nigeria as a child with his family, has a law degree from Yale and a broad remit that includes national security as well as economic inequality.

The Supreme Court’s decision on Friday that prosecutors had misused an obstruction law in charging hundreds of rioters who attacked the Capitol is the latest example of the persistent challenges the Justice Department has faced in grappling with the consequences of Jan. 6, 2021. By and large, the department has succeeded over the past three years in moving against members of the pro-Trump mob who sought to disrupt the certification of President Biden’s victory on Jan. 6, and in winning convictions on seditious conspiracy charges against members of two far-right groups that were instrumental in stoking the violence that day, the Proud Boys and the Oath Keepers. But lacking any established legal blueprint for addressing an assault on the foundations of democracy, prosecutors sometimes got creative with the law. And that has left them vulnerable to second-guessing by the courts on how they have pursued criminal cases both against the rioters and against former President Donald J. Trump, and contributing to a long series of challenges and delays. The court’s new ruling on the obstruction law will hardly cripple the Justice Department’s ability to go after the rioters, but it will constrain prosecutors by restricting the use of an important tool they have relied on to seek accountability against the most disruptive members of the mob.

CNN —Judge Aileen Cannon wants to hold additional hearings on Donald Trump’s attempts to challenge key evidence in his classified documents case and will allow the former president’s lawyers to question witnesses about the investigation and search of Mar-a-Lago. Those issues were argued in hearings on Tuesday, but Cannon did not rule on the matters. The judge did not say when additional hearings would be held. The special counsel’s office has strongly opposed the need for additional hearings and Trump’s attempts to cut out parts of the case. Cannon has not set dates for the additional hearings yet.

CNN —President Joe Biden is expected to pardon US veterans who were convicted by the military over a 60-year period under a military law that banned gay sex, three US officials told CNN. The granting of pardons won’t automatically change convicted veterans’ records but allows those impacted to apply for a certificate of pardon that will help them receive withheld benefits. A service member’s discharge status can determine what kind of Veterans Affairs benefits they are eligible for. “For decades, our LGBTQ+ service members were forced to hide or were prevented from serving altogether,” Defense Secretary Lloyd Austin said at the time. If a certificate of pardon is issued, the service member will then have to apply to their respective military department’s board of corrections to have their military records corrected.

Julian Assange, the founder of WikiLeaks, agreed to plead guilty on Monday to a single felony count of illegally obtaining and disclosing national security material in exchange for his release from a British prison, ending his long and bitter standoff with the United States. Mr. Assange, 52, was granted his request to appear before a federal judge at one of the more remote outposts of the federal judiciary, the courthouse in Saipan, the capital of the Northern Mariana Islands, according to a brief court filing made public late Monday. It was a fitting final twist in the case against Mr. Assange, who doggedly opposed extradition to the U.S. mainland. The islands are a United States commonwealth in the middle of the Pacific Ocean — and much closer to Mr. Assange’s native Australia, where he is a citizen, than courts in the continental United States or Hawaii. Shortly after the deal was disclosed, WikiLeaks said that Mr. Assange had left London.

New York CNN —Prosecutors are urging the US Justice Department to file criminal charges against Boeing for safety issues surrounding its 737 Max, although top Justice Department officials haven’t made a final decision, a source familiar with the development tells CNN. And this month a group of those family members wrote a letter to the Justice Department urging Boeing be hit with the maximum possible $24.9 billion fine. The charges against Boeing don’t mean any Boeing executive will face charges as an individual. It has posted core operating losses of $31.9 billion since the start of the 20-month grounding of the 737 Max that followed its second fatal crash in 2019. But if the company faces criminal charges, a new settlement is the most likely outcome.

CNN —A strange monolith found jutting out of the rocks in a remote mountain range near Las Vegas has been taken down by authorities. Members of the Las Vegas police search and rescue team found the object near Gass Peak, part of the vast Desert National Wildlife Refuge where bighorn sheep and desert tortoises can be found roaming. Then came sightings in Romania, central California, New Mexico and on the famed Fremont Street in downtown Las Vegas. Fish and Wildlife Service, is the largest wildlife refuge outside of Alaska and can cover the state of Rhode Island twice. The department said it “discourages anyone from venturing off marked trails or leaving objects and items behind.”“This poses a danger to you and the environment,” Las Vegas police said.

Two teenagers were reported missing in the waters off Jacob Riis Park in Queens on Friday evening, setting off an hourslong search into the night along a shoreline notorious for rip currents that prove deadly year after year. The authorities received reports of a possible drowning around 6:30 p.m. The officers responding to the scene were told that two teenage boys, ages 16 and 17, had been seen struggling in the water before they disappeared from view, according to the New York Police Department. Emergency responders with the police, New York City Fire Department and the U.S. Coast Guard, including rescue swimmers and divers, searched the churning waters, but as of about 11 p.m. Friday no one had been found, according to the police. Kaz Daughtry, the Police Department’s deputy commissioner of operations, told news crews at the beach that witnesses said the teenagers had been overtaken by a large wave that they tried to avoid by jumping, but it appeared to suck them under.
