CNN —A historic ruling by the United Nations’ top court in a genocide case against Israel on Friday was welcomed by the three main parties it involved: Israel, South Africa and the Palestinians. The International Court of Justice in The Hague, the Netherlands, ordered Israel to “take all measures” to prevent genocide in Gaza after South Africa accused Israel of violating international laws on genocide in its war in the territory. Part of Israel’s defense is to prove that whatever politicians may have said in public was overruled by executive decisions and official orders from Israel’s war cabinet and its military’s high command. The court, the U.N.’s highest judicial body, began hearing arguments in the case this month, and is expected to provide an initial response to South Africa’s petition — in which it could call for a provisional cease-fire — as soon as Friday.

Friday's ruling will not deal with the core accusation of the case - whether genocide occurred - but will focus on the urgent intervention sought by South Africa. Israel rejects the accusations from South Africa and says it has a right to defend itself following the Oct. 7 attack on Israel by Palestinian Islamist group Hamas, which governs Gaza. South Africa has asked for nine emergency measures, which act like a restraining order while the court hears the case in full, which could take years. The court is not bound to follow South Africa's requests and could order its own measures if it finds it has jurisdiction at this stage of the case.

Tel Aviv CNN —The Israeli military has desecrated at least 16 cemeteries in its ground offensive in Gaza, a CNN investigation has found, leaving gravestones ruined, soil upturned, and, in some cases, bodies unearthed. CNN’s analysis of satellite imagery and videos showed that Israeli bulldozers turned multiple cemeteries into staging grounds, leveling large swaths and erecting berms to fortify their positions. Depending on the angle from which you view it, the genocide case against Israel at the International Court of Justice can embody either the promises or the failures of one of the primary aims of the international human rights project: making rights a matter of law, not just of power. Last week, the court, which is the United Nations’ top judicial body, heard initial arguments in the case brought by South Africa in late December, which accuses Israel of “acts and omissions” that are “genocidal in character” against Palestinians in Gaza. This is only the fourth time that a country has brought a genocide case before the I.C.J. And the other three have been filed in just the last four years: a 2019 case against Myanmar alleging genocide against the Rohingya minority; a 2022 case alleging Russia had abused the Genocide Convention as a pretext for an illegal invasion of Ukraine, and that Russia appeared to be planning acts of genocide in Ukraine; and the current case against Israel. Israel categorically denies the accusation, and the 17 judges sitting in this case are now deliberating whether to order “provisional measures,” a temporary order that would ask Israel to take proactive steps to ensure genocide doesn’t occur in the future, while the case is pending.

It’s true that in recent days, Israel has signaled a certain shift in its war strategy, using fewer troops and focusing more on central and southern Gaza. These steps appear partly driven by the need to keep down Israeli losses in the close quarters of urban combat, to offer some relief to Israel’s suffering economy — and possibly in preparation for an escalation on Israel’s northern border. Such shifts don’t seem intended to dial back the snowballing regional tensions, nor will they prevent the increasing humanitarian suffering. The first and most critical shift required is for the administration to embrace the need for a full cease-fire now. The Biden administration does not need to support the South African claims, but it can and should commit to being guided by any findings of the court.

In recent decades, as many as three million people perished in a famine in North Korea that was mainly government-induced. It’s obscene because it politicizes our understanding of genocide, fatally eroding the moral power of the term. The war between Israel and Hamas is terrible — as is every war. But if this is genocide, what word do we have for the killing fields in Cambodia, Stalin’s Holodomor in Ukraine, the Holocaust itself?

NAIROBI, Kenya (AP) — Tanzania on Monday announced it had withdrawn approval for neighboring Kenya's flagship carrier Kenya Airways to operate a passenger service between the countries beginning next week. A statement from the Tanzanian Civil Aviation authority said the move was in response to Kenya Civil Aviation Authority denying Air Tanzania the approvals it needed to operate all cargo flights between the two countries. The statement said the ban on Kenya Airways passenger flights will start on Jan. 22. South Africa's legal case accusing Israel of committing genocide against Palestinians in Gaza has "global support," the country's Finance Minister Enoch Godongwana told CNBC Monday. A two-day hearing last week at the International Court of Justice in the Hague, Netherlands, saw South African lawyers lay out arguments alleging that Israel's bombardment of Gaza that has caused massive casualties was tantamount to genocide. "Supporters of Israel of course, including the U.K., will say our application is nonsense but there is global support for our view that in fact, our case was substantive and we have argued our case." Turkey, Jordan, Brazil, Colombia, Bolivia, Pakistan and Malaysia are among the states that have publicly supported South Africa's application, along with the Organization of Islamic Cooperation. The Saudi-based organization consists of 57 member states, 48 of which are Muslim-majority countries.

JOHANNESBURG—South Africans this week rallied around their government’s decision to take Israel to the International Court of Justice for alleged genocide in the Gaza Strip, with many saying they were motivated by their own country’s struggle against apartheid. Its case at the United Nations court in The Hague, Netherlands, has drawn support from many human-rights organizations and other developed countries. South Africa is asking the ICJ to issue provisional orders for a cease-fire in Gaza while proceedings on the genocide claim, likely to take years, move forward.
