ATLANTA (AP) — Lawyers for three Georgia Republicans, who falsely claimed that Donald Trump won the state and they were “duly elected and qualified” electors, are set to argue Wednesday that criminal charges against them should be moved from state to federal court. Shafer, Still and Latham have all indicated in court filings that they will not be present in court for the hearing. If their cases are moved to federal court, a jury would be drawn from a broader and potentially less Democratic pool than in Fulton County alone. Prosecutors allege that Shafer, Still, Latham — and the other Georgia Republicans who participated in that plan — “falsely impersonated” electors. Meadows, Clark, and several other defendants have asked to have their cases removed to federal court. "A federal court judge might be more sympathetic to some of their federal constitutional defenses that they might want to raise," Ratakonda told Insider. Tennessee’s House Republicans on Monday again silenced Representative Justin Jones, a Black Democrat who was expelled earlier this year in a gun control protest, after he was deemed to have violated new stringent rules of decorum. Democrats left the House chamber in protest after Mr. Jones was barred from speaking on the floor for the remainder of the day, while chants of “fascists” and “racists” broke out in the gallery overhead. Republicans ordered state troopers to clear the galleries. The uproar came when Speaker Cameron Sexton and chamber leaders decided that Mr. Jones, for the second time in the day, had breached the rules of the House by speaking out of turn. This time, Mr. Jones had suggested, during a debate about increasing the number of police officers in schools, that the state’s resources should be focused instead on mental health professionals and teacher pay — comments Mr. Sexton said were off-topic.

Removing a case to federal court requires persuading a judge that the actions under scrutiny were carried out by federal officers as part of their official business. Earlier this year, Mr. Trump failed in his attempt to move a New York State criminal case against him to federal court; his argument in that case was seen as particularly tenuous. Presiding over the hearing on Mr. Meadows’s motion Monday was Judge Steve C. Jones of United States District Court in Atlanta. The judge ruled that the law was clear that “state court proceedings continue” until a decision has been reached on removal.
