WASHINGTON (AP) — As billions of dollars for a global HIV/AIDS program credited with saving millions of lives remains in limbo, the George W. Bush Institute is urging the U.S. Congress to keep money flowing for it. In a letter sent to Congress on Wednesday, the former Republican president's institute pleaded with Congress to keep funding the U.S. President’s Emergency Plan for AIDS Relief, or PEPFAR. PEPFAR is credited with saving 25 million lives in 55 countries, including 5.5 million infants born HIV-free. "The reauthorization is stalled because of questions about whether PEPFAR’s implementation under the current administration is sufficiently pro-life," Bush wrote. "But there is no program more pro-life than one that has saved more than 25 million lives."

That's where the bipartisan $52.7 billion CHIPS Act comes in, with a goal of having the U.S. compete once again with countries like South Korea and Taiwan in semiconductors. "The CHIPS Act was a bipartisan recognition that is not an acceptable status quo." There is also funding from the CHIPS Act earmarked for worker development. However, as now more than a year has passed since President Joe Biden signed the CHIPS Act into law, many in the U.S. semiconductor industry are waiting for that money to flow into it. But she isn’t certain that it will be enough, even with her Social Security benefits. Charles Blahous, a former Social Security trustee, said the annual COLA announcement is a reminder about the program's stressed finances. Mary Johnson, Social Security and Medicare policy analyst at the Senior Citizens League, says her organization supports the Social Security Administration using whichever index is higher to best protect older people from inflation. The maximum amount of earnings subject to Social Security payroll taxes for 2023 is $160,200, up from $147,000 in 2022. Retirees who rely on Medicare for health-care coverage may see those benefits diminish in as soon as eight years. The program's hospital insurance trust fund, which pays for Medicare Part A benefits including inpatient hospital care, may only pay 100% of benefits through 2031, according to projections from Medicare's trustees. When it comes to repairing the programs' funds, Congressional lawmakers generally have two choices: raise taxes, cut benefits or a combination of both. "It's simple arithmetic: raise revenue or cut benefits," Whitehouse said of preserving Medicare. "If we abide by what seemed like a bipartisan commitment not to cut benefits," said Whitehouse, referring the State of the Union earlier this year, "we must safeguard Medicare by raising revenue."

All drugmakers of the first 10 medicines selected for Medicare drug price negotiations have agreed to participate in the talks, even after many of them sued to halt the process last month. The Centers for Medicare & Medicaid Services did not immediately respond to a request to confirm that all drugmakers agreed to the talks. President Joe Biden's Inflation Reduction Act, which passed last year, empowered Medicare to negotiate drug prices for the first time in the program's six-decade history. NEW YORK (AP) — A grant program for businesses run by Black women was temporarily blocked by a federal appeals court in a case epitomizing the escalating battle over corporate diversity policies. Circuit Court of Appeals temporarily prevents the Fearless Fund from running the Strivers Grant Contest, which awards $20,000 to businesses that are at least 51% owned by Black women, among other requirements. In a statement Sunday, the Atlanta-based Fearless Fund said it would comply with the order but remained confident of ultimately prevailing in the lawsuit. “We strongly disagree with the decision and remain resolute in our mission and commitment to address the unacceptable disparities that exist for Black women and other women of color in the venture capital space,” the Fearless Fund said. The Fearless Fund has enlisted prominent civil rights lawyers, including Ben Crump, to defend against the lawsuit.

A pharmacist holds a bottle of the drug Eliquis, made by Pfizer Pharmaceuticals, at a pharmacy in Provo, Utah, January 9, 2020. A federal judge on Friday declined to block the Biden administration from implementing Medicare drug price negotiations, upholding for now a controversial process that aims to make costly medications more affordable for older Americans. That date is the deadline for manufacturers of the first 10 drugs selected for negotiations to agree to participate in the talks. Newman also gave the Biden administration until Oct. 27 to renew its motion to dismiss the case. The ruling from Newman is a blow to the pharmaceutical industry, which views the process as a threat to its revenue growth, profits and drug innovation.

The Treasury Department subsequently kicked off a rule-making process to implement the order, and financial firms have been rushing to meet a Sept. 28 to provide input. "It could apply to companies that are outside of China but are subsidiaries of Chinese companies or controlled by a Chinese person." While the U.S. already has restrictions on some Chinese investments in the U.S. and U.S. investments in China, the order creates a new program. The program proposes exempting publicly traded securities and index and mutual funds, but financial firms want those securities to be more tightly defined. Financial firms say they support the administration's national security goals but worry about increased liability and the economic costs of restricting capital flows.

Manufacturers of the other eight drugs selected have until Oct. 1 to sign an agreement to participate in the process. The Inflation Reduction Act, which passed Congress last year in narrow party-line votes, empowered Medicare to negotiate drug prices for the first time in the program's six-decade history. U.S. District Judge Thomas Thrash during a hearing denied a request by Edward Blum's American Alliance for Equal Rights for a preliminary injunction blocking Fearless Fund from considering applications for grants only from businesses led by Black women. Blum's group had asked the judge to temporarily block the Fearless Fund's "racially exclusive program" while the court considered the merits of the case. Fearless Fund founders Arian Simone and Ayana Parsons in a joint statement said they were pleased that Thrash rejected Blum's attempt to shut down their grant program. According to the Fearless Fund, businesses owned by Black women in 2022 received less than 1% of the $288 billion that venture capital firms deployed. It also provides grants, and Blum's lawsuit took aim at its Fearless Strivers Grant Contest, which awards Black women who own small businesses $20,000 in grants and other resources to grow their businesses.

Those lawsuits accuse all three of violating Section 1981 of the 1866 Civil Rights Act, a law enacted after the Civil War that guarantees all people the same right to make and enforce contracts "as is enjoyed by white citizens." "All of our nation's civil rights laws - including the 1866 Civil Rights Act - enshrine the command that someone's race and ethnicity must never be used to help or harm them in public and private employment and contracting," Blum, who is white, told Reuters in an email. FREE SPEECH ARGUMENTFearless Fund has brought in prominent lawyers to defend it, including civil rights attorneys Ben Crump and Alphonso David, who during a news conference called Blum's use of the Civil War-era law "cynical." They argue that the rules for the grants are merely criteria for being eligible for a "discretionary gift" and do not create a "contract" subject to the civil rights law. Blum's group countered that Fearless Fund's argument would ironically undermine the very causes it favors by essentially invalidating Section 1981 and deeming racial discrimination protected by the First Amendment.
