☆ Insurance should pay for over-the-counter birth control, White House proposes

The Biden administration is proposing a rule that would provide women with private insurance access to over-the-counter birth control pills and other contraceptives at no cost, the White House said on Monday. “This rule, once finalized, will expand contraception coverage for 52 million women of reproductive age with private health insurance,” White House Gender Policy Council Director Jennifer Klein said during a briefing. “For the first time ever, women would be able to obtain over-the-counter contraception without a prescription at no additional cost, and health plans would have to cover even more prescribed contraceptives without cost sharing,” she said. Perrigo Co.’s Opill is currently the only daily birth control pill approved for sale without a prescription by the Food and Drug Administration, but the proposed rule covers other forms of over-the-counter contraceptives, including emergency contraception such as morning after pill Plan B, spermicides, birth control sponges, and condoms. The rule will also require that health plans cover all FDA-approved contraceptive drugs and some devices, including IUDs, without cost sharing in many cases.

With voters citing the economy and inflation, abortion, immigration and democracy as top issues in this election, the survey tested a series of policy proposals on those topics, offering clues about which policies could move voters. The survey did not identify which party or candidate is associated with the proposal. While economic policies could move voters toward a candidate, the survey also finds that election denialism could turn them off. Voters across swing groups, including suburban women, independents, moderates and seniors, say they are less likely to support a candidate who denies the election results. The NBC News poll of 1,000 registered voters, 898 of whom were reached by cellphone, was conducted Oct. 4-8.

CNN —Texas death row inmate Robert Roberson sat praying in a cell Thursday night, just feet from the execution chamber where he was set to die by lethal injection for the “shaken baby” death of his toddler. Just over 90 minutes before Roberson’s execution was set to begin, the House committee was able to secure a temporary restraining order against the state, pausing the execution. Roberson’s case is called into questionAdvocates for Roberson insist the diagnosis that his daughter died from shaken baby syndrome is inaccurate and has been discredited. Shaken baby syndrome is accepted as a valid diagnosis by the American Academy of Pediatrics and supported by child abuse pediatricians who spoke with CNN. Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to the National Registry of Exonerations.

CNN —A Travis County judge granted a Texas House committee’s last-minute temporary restraining order request against the state just 90 minutes before Robert Roberson was scheduled to be executed Thursday. Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

WASHINGTON — The Supreme Court on Wednesday allowed the Biden administration at least in the short term to enforce its latest attempt to curb climate-harming carbon emissions from coal- and gas-fired power plants that contribute to climate change. The Supreme Court is often skeptical of major agency actions but it has bucked that reputation in recent weeks. Under the proposed rule, the EPA wants to require “carbon capture,” a technique that uses solvents to remove carbon dioxide from a power plant’s emissions. The appeals court in July declined to block the regulation, saying the major questions doctrine did not apply on this occasion. In court papers, the challengers sought to portray the new regulation as being essentially the same as the one the Supreme Court struck down.

CNN —Special counsel Jack Smith told a federal judge on Wednesday that the Supreme Court’s decision limiting some obstruction charges against those who stormed the US Capitol on January 6, 2021, should not apply to Donald Trump in the election subversion case against the former president. One primary reason the obstruction charge against Trump should stand, prosecutors argue, is that – unlike in the case involving a rioter that was before the Supreme Court – Trump is directly accused of creating false evidence though the plot to insert fake electors in the certification process. Trump is arguing the ruling should result in Judge Tanya Chutkan throwing out the case against him. “The defendant’s supplement ignores entirely that the superseding indictment includes allegations that involve the creation of false evidence,” prosecutors wrote Wednesday, namely, “the fraudulent electoral certificates.”Smith also urged the judge to ignore Trump’s claims of presidential immunity, calling them “deeply flawed” and “irrelevant” to the issue at hand and should wait to be argued in separate filings. But the surveys also reveal a noticeable gap in support between the pro-abortion rights amendments and the Democratic presidential and Senate candidates who are campaigning on a pro-abortion rights platform. Pro-abortion rights ballot measures won in every state where they appeared on the ballot, including conservative-leaning ones, in the 2022 and 2023 elections. Similarly in Arizona, a proposed amendment to enshrine abortion rights in the state’s constitution has clear majority support. In Montana, there’s little evidence that the presence of an abortion rights amendment has had a major effect on the race between three-term Democratic Sen. Jon Tester and Republican challenger Tim Sheehy. For example, in Missouri, public polling indicates broad support for a constitutional amendment to enshrine abortion rights, while Republican Sen. Josh Hawley and Trump hold strong leads in their races.

The federal election case was upended after the Supreme Court’s immunity ruling which found that Trump has some protection from prosecution related to official acts. Sean "Diddy" Combs wants to go to trial on sex trafficking charges next spring, the embattled hip-hop mogul's lawyers informed a judge Wednesday. "Mr. Combs continues to assert his right to a speedy trial and intends to request a trial date in April or May 2025, and as consistent with the Court’s trial schedule," the jailed rapper's lawyers wrote. Combs was charged last month with sex trafficking, racketeering and transportation to engage in prostitution in a sweeping indictment by the Southern District of New York. Combs' preference was mentioned in a joint letter from his lawyers and prosecutors. In the joint letter, U.S. government prosecutors said they have started submitting to defense lawyers some of the "voluminous" evidence in the case, including "several terabytes of electronic material" regarding Combs.

The billionaire philanthropist launched “Action for Women’s Health”, a fund through her organization Pivotal Ventures. Its webpage says that “women’s health has been underfunded, overlooked, and misunderstood” and that health inequities between men and women “not only impact women’s daily lives, but they can also hurt women’s futures.”“It’s clear we need to do a better job of addressing the barriers to women’s health. “We’re seeing the devastating impacts” of Roe v. CNN —The Supreme Court on Tuesday signaled a willingness to uphold a Biden administration regulation on “ghost guns,” mail-order kits that allow people to build untraceable weapons at home and that are turning up at crime scenes with greater frequency. The difference here, she said, is that the ghost guns are marketed to be built into guns and serve no other conceivable purpose. President Joe Biden’s administration told the court in briefing that police departments have faced an “explosion of crimes involving ghost guns” in recent years. In 2017, police submitted about 1,600 ghost guns recovered at crime scenes for tracing. After that decision, a lower court stepped in to block the regulations as applied to two manufacturers.
