The judge overseeing Trump's fraud trial imposed a partial gag order on Trump's lawyers. AdvertisementAdvertisementThe judge overseeing former President Donald Trump's fraud trial in New York expanded an existing gag order to bar Trump's lawyers from commenting on confidential communications between the judge and his staff. Judge Arthur Engoron's wider gag order came after Trump's lawyers made what the judge characterized as "on the record, repeated, inappropriate remarks" about his law clerk. They "falsely [accused] her of bias against them and of improperly influencing the ongoing bench trial," Engoron wrote. CNN —The judge overseeing Donald Trump’s civil fraud trial has expanded a gag order in the trial to extend to Trump’s attorneys after continued lengthy discussions about the judge’s communications with his law clerk during court this week. In a written order Friday, Judge Arthur Engoron prohibited Trump’s attorneys from making any further comments about confidential communications between the judge and his staff inside or outside of the courtroom. The second fine – $10,000 – came after Trump appeared to reference the clerk when speaking to reporters outside of the courtroom. Engoron said he has a right to seek counsel from his clerk and Trump’s legal team has no right to know what they are. “She’s a civil servant, she’s doing what I ask her to do.” Those notes are “confidential communications from my law clerk,” Engoron said Thursday, pounding on the bench.

Things grew heated when Amer apparently succeeded in undermining Eric Trump’s claims that he had little to do with his father’s financial statements. “I understand we had financials as a company,” Eric Trump said. Eric Trump replied: “It appears that way, yes.”In essence, both Trump sons are arguing that despite running the company, they knew nothing about its financial statements. In a bizarre passage of the trial, Trump attorney Chris Kise insisted: “I’m not a misogynist. The back-to-back appearances Thursday from Donald Trump Jr. and Eric Trump – who both helped run the Trump Organization while their father was in the White House – comes ahead of the former president’s own testimony on Monday. Donald Trump Jr. and Eric Trump are co-defendants in the case, along with their father, the Trump Org., and several company executives. Eric Trump acknowledged he provided information to former Trump Org. But he tried to distinguish between specific statements of financial condition – his father’s personal financial statements at the heart of the civil case – and general financial records for the company. A defense lawyer's late afternoon snipe about a law clerk sparked drama at the Trump fraud trial. The blowup came when Trump lawyer Christopher Kise snarked "ask your law clerk first," to the judge. ATLANTA (AP) — Some Republican lawmakers continued to press Wednesday for changes to protect Georgia's voting system from security weaknesses, but a deputy to Secretary of State Brad Raffensperger accused them of acting in bad faith and promoting lies that Georgia's 2020 election was stolen from Donald Trump. The dispute with some Republicans in the state Senate stems from vulnerabilities in Dominion Voting Systems equipment identified by J. Alex Halderman, an expert witness in a lawsuit challenging the constitutionality of Georgia’s election system. However, they say it's impractical to update all 40,000 electronic voting machines and scanners statewide before the 2024 election cycle begins. Senate Ethics Committee Chairman Max Burns, a Sylvania Republican, said at the end of the hearing he wanted to see changes. Fueling interest in voting changes are Republican Party activists who say that Georgia's 16 electoral votes were stolen from Trump in 2020.

Manhattan Supreme Court Justice David B. Cohen rejected Fox Corp. and Fox News’ attempts to subpoena George Soros, his son Alex Soros, and their philanthropic organization Open Society Foundation (OSF) for documents related to the election defamation case. Fox argued that Alex and George Soros, as well as OSF, possess material necessary to the network’s defense in the defamation trial. The documentation, Fox argued, would establish a connection between George Soros and Smartmatic. “I base that on the finding that the crux of Smartmatic’s claims is that Fox has asserted they were part of rigging [the election], not that Smartmatic was affiliated with George Soros, Alex Soros, or the OSF,” Cohen said. “We’re interested in the closeness of the relationship, what Soros has done for Smartmatic over time,” Marks said.

New York (CNN) — Ivanka Trump must testify at her father’s New York civil fraud trial, the judge overseeing the case ruled on Friday. Ivanka Trump’s attorney had argued that she should not be forced to appear after an appellate court removed her as a defendant in the case. The judge also said Ivanka Trump should have submitted an affidavit asserting that she does not live or work in the state presently. Ivanka Trump was still identified by the New York attorney general’s office as a potential witness they could call in the case. Another Trump attorney, Cliff Robert, said Eric Trump is willing to be the corporate representative for the Trump Organization because he’s going to be testifying at trial anyway.

Unnamed sources familiar with the situation told ABC News and Bloomberg that Meadows testified before a federal grand jury hearing evidence in the election interference probe. It was not clear what Terwilliger told ABC News was inaccurate. CNN —It’s raining “guilty” pleas in Trump-world. The rapid succession of guilty pleas not only marks a big blow to Trump, but also to the right-wing media apparatus that championed and disseminated his election lies to the masses. In the aftermath of the 2020 election, both Ellis and Powell toured across MAGA Media, becoming heroes to Trump’s fans as they sowed doubt about the legitimacy of the election. Fox News, which repeatedly hosted Ellis in the wake of the 2020 election, suddenly became disinterested in the former Trump lawyer. The result is that a good portion of the channel’s audience, made up of legions of viewers who willfully seclude themselves in right-wing media safe spaces, will likely miss the consequential news.

New York CNN —An apparent backtrack by Donald Trump’s ex-lawyer and fixer Michael Cohen threw the New York civil fraud trial into more chaos Wednesday afternoon. But after lunch, Cliff Robert, another Trump attorney, pressed Cohen further on his congressional testimony, and Cohen had a different response, saying that the testimony was not false. “The witness just admitted that we won the trial,” Trump told reporters in the hallway. “And the judge should end this trial immediately.”The New York attorney general’s lawyers asked Cohen in follow up questions to clarify his response. New York Attorney General Letitia James downplayed Cohen’s significance to her case against Trump in comments to reporters at the conclusion of Cohen’s two-day testimony.

“Mark Meadows always thought it was rigged, the whole thing was rigged,” Trump said. Trump was indicted by Smith in August in Washington, D.C., for attempting to overturn the 2020 presidential election and for inciting a riot at the Capitol on Jan. 6, 2021. The report from ABC News comes at a precarious moment for Trump, the GOP presidential primary front-runner who faces a total of 91 criminal charges stemming from four indictments. "If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges. He reiterated those points on social media, where Trump also posited that perhaps Meadows, after years of being pressured by Smith and other prosecutors, finally told Smith what he wanted to hear in order to secure his own immunity.

WASHINGTON, Oct 24 (Reuters) - A former lawyer for Donald Trump, Jenna Ellis, pleaded guilty on Tuesday to helping the then-U.S. president's efforts to overturn his 2020 election defeat in the state of Georgia and agreed to testify against Trump if called upon. "What I did not do and should have done, your honor, was to make sure that the facts the other lawyers alleged to be true were in fact true," Ellis told Fulton County Superior Court Judge Scott McAfee. Ellis, 38, pleaded guilty to aiding and abetting false statements and writings. Prosecutors said she attended a meeting with Georgia lawmakers where Trump personal lawyer and former New York Mayor Rudy Giuliani made false claims about voting irregularities. It is unclear what Powell, Chesebro and Ellis have told prosecutors or how broad their testimony could be.

Ellis pleaded guilty to one count related to her efforts to overturn Georgia's 2020 election results. She pleaded guilty to one count of aiding and abetting false statements, stemming from her falsely telling Georgia lawmakers that fake votes were counted in the 2020 election. With Trump sitting feet away, Trump’s one-time lawyer and fixer described how he manipulated Trump’s financial statements – “reverse-engineering” them to hit an arbitrary net worth. We’re not worried at all about his testimony,” Trump said during a lunch break. The tense questioning is going to continue into Wednesday, as Habba hadn’t even started on the substance of Cohen’s testimony in the civil fraud trial. In the July 2014 letter submitting a bid to buy the Bills, Trump claimed his net worth was $8 billion. Before Engoron’s ruling, the state attorneys and Trump’s lawyers clashed over Michael Cohen’s testimony about the letter.

CNN —In a slew of court filings late Monday, attorneys for Donald Trump filed several motions asking the judge overseeing the election subversion case in Washington, DC, to dismiss the charges against the former president on grounds that, among other things, they violate his First Amendment rights and are the product of a “selective and vindictive prosecution.”“Countless millions believe, as President Trump consistently has and currently does, that fraud and irregularities pervaded the 2020 Presidential Election,” his attorneys wrote. Within the plethora of legal arguments as to why the charges against Trump should be dismissed, his attorneys also argued that the prosecution itself essentially amounts to a political hit job. “Three days after President Trump formally announced his candidacy, the Special Counsel was put in place as part of a flawed effort to insulate Biden and his supporters from scrutiny of their obvious and illegal bias,” his attorneys wrote, adding that the prosecution against Trump for actions he took while president show a selective prosecution from special counsel Jack Smith. Trump’s attorneys, in their filings, also moved to strike allegations around the January 6, 2021, US Capitol attack mentioned in the indictment against him, arguing that Trump is not being charged “with responsibility for the actions at the Capitol” and that such mentions of the January 6 attack could be “highly prejudicial” against him. The former president pleaded not guilty in August.

But for Trump, Ellis' plea was especially damaging, since it underscored the steady evaporation of something Trump has demanded from staff and associates since his days as a New York businessman: loyalty. "If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges. The three former Trump lawyers who pleaded guilty in Georgia were facing some serious potential consequences, he noted, including not just time behind bars but the loss of their law licenses – and that may take priority over honoring Trump's demands for loyalty. "This is not about Donald Trump vs. Michael Cohen," Cohen said as he entered the New York courtroom. NEW YORK (AP) — A federal appeals panel wants to know why lawyers for former President Donald Trump didn’t try years ago to use a claim of absolute presidential immunity to shield him from a defamation lawsuit by a woman who accused him of sexual assault. He also insisted that absolute presidential immunity was a protection that cannot be surrendered by Trump or any other president. Kahn asked Madaio later in the arguments why absolute presidential immunity was not asserted sooner.
