☆ Opinion: Why Trump’s January 6 defense is even worse than it seems

Given that, Trump’s lawyers may well advise him to stay off the witness stand and avoid the risks of cross examination — but demure silence is hardly in his nature. In Trump’s cross examination, however, the prosecutors would be able to confront him with his false statements one after another, seamlessly telling their entire story of Trump’s duplicity in his own words. The lawyers, some of whom have been identified as unindicted co-conspirators, could assert the Fifth Amendment for themselves, but that would just undermine Trump’s defense. Even assuming there are still employees willing to stand by him, however, Trump’s cronies would not exactly be the most convincing witnesses. Although there would be a hearsay exception for statements showing Trump’s “state of mind,” that would only allow the witnesses to testify to Trump’s actual words.

Entrepreneur Vivek Ramaswamy acted as Trump’s stand-in, mining a deep seam of skepticism over the war among GOP grassroots voters. Chris Christie, who recently returned from Ukraine, warned: “This is the Vladimir Putin, who Donald Trump called brilliant and a genius. The debate underscored one of the tragedies of the war for Ukraine. They can’t control what Putin does, which means their fate will also be on the ballot in the US in 2024.

Washington CNN —President Joe Biden is preparing to blanket the airwaves with a $25 million television and digital ad campaign in battleground states this month, campaign officials told CNN, as Republicans are set to face off in their first presidential primary debate. That same poll found only 37% of Americans approve of Biden’s handling of the economy and even fewer – 30% – approve of his handling of inflation. Biden’s ad push, which will include several forthcoming ads, will run for 16 weeks on broadcast and cable television in the battleground states of Arizona, Georgia, Michigan, Nevada, North, Carolina, Pennsylvania, and Wisconsin, officials said. Still, the Biden campaign is taking steps to tie the GOP candidates on stage to Trump’s “MAGA” agenda” on both the airwaves and on the ground in Wisconsin, campaign officials said. The contrast between Biden saying America is still a democracy and Trump vowing to make it great again is more than a quirk of speechwriting. Both candidates, now in a dead heat in the 2024 presidential race, look to the nation’s past but through divergent lenses. It’s the difference between America as an ideal worth preserving and an illusion worth summoning. The message of “still” is that we remain who we are, but that this condition is not immutable, that America as Biden envisions it exists somewhere between reality and possibility.

Washington CNN —Special counsel Jack Smith’s office has asked former US officials about a February 2020 Oval Office meeting where then-President Donald Trump praised improvements to the security of US elections, according to multiple people familiar with the matter. Those details offer a stark contrast to the voter-fraud conspiracy theories Trump began spreading publicly just weeks later and continued to use to question the 2020 election results. The West Virginia Democrat’s model has served him well with repeated statewide wins in one of the most conservative pro-Trump states in the nation. For now, Manchin’s noncommittal answers are worrying some of his Democratic colleagues. Polls show that both Biden and Trump, the front-runner for the GOP nomination, are unpopular. It argues, therefore, that 79 electoral votes are potentially at risk for Biden from the involvement of a third-party challenger. Such a challenger would also need to win states where Biden won big, and at least some conservative bastions.

DeSantis has appointed far more extreme justices to the Florida Supreme Court than Trump did to the US Supreme Court. But DeSantis’ appointees to the Florida Supreme Court embrace the Thomas-Alito wing of the organization. DeSantis’ appointees, in contrast, have jumped at entrenching conservative electoral domination and curtailing Black political power. Imitating Thomas and Alito, DeSantis’ appointees have rushed into gratuitous political controversies, writing opinions heavy on theory and light on practicality. Thomas and Alito are in this vanguard, as are DeSantis’ appointees and some of Trump’s lower court appointees, with which DeSantis is aligned.

Perhaps no political promise is more potent or universal than the vow to restore a golden age. What these political myths have in common is an understanding that the golden age is definitely not right now. I and my colleague Daniel Gilbert at Harvard have found evidence for that bug, which we recently published in the journal Nature. We first collected 235 surveys with over 574,000 responses total and found that, overwhelmingly, people believe that humans are less kind, honest, ethical and moral today than they were in the past. Respondents of all sorts — young and old, liberal and conservative, white and Black — consistently agreed: the golden age of human kindness is long gone.

How we searched for proof of Trump’s storyCNN conducted a broad search for any proof for Trump’s story. These articles did not mention anything about South American mental health facilities being emptied under President Joe Biden, nor feature any quote from a doctor at any such facility. We then reached out to a pro-Trump super PAC asking for evidence for Trump’s “mental institution” story, but a spokesperson didn’t respond. We next turned to two groups that advocate for reduced immigration, the Center for Immigration Studies and the Federation for American Immigration Reform, which would be good candidates to be aware of any such evidence. As a last resort, we posted Trump’s quotes on Twitter and invited the public to try to find support for them.
