CNN —The guilty verdict against Donald Trump in his New York hush money trial is a momentous news story in itself. What’s far less clear, and what no polling can predict, is the effect it will have on voters’ willingness to support Trump in the presidential election. Fifteen percent said they’d be more likely to vote for Trump and 17% that they’d be less likely to do so. Take the roughly one-quarter of Trump supporters in the NPR/PBS/Marist poll who said that a conviction would increase their chances of supporting him over President Joe Biden. The best gauge of any immediate, tangible effect on voters’ preferences might be polls of the presidential race.

I won’t even opine whether my flying the flag upside-down flag at my house would have constituted a violation of the Code of Ethics that binds me and all federal judges — except the justices. The fact is that, regardless of its legality, displaying the flag in that way, at that time, shouldn’t have happened. To put it bluntly, any judge with reasonable ethical instincts would have realized immediately that flying the flag then and in that way was improper. The same goes with the flying of an “Appeal to Heaven” flag at Justice Alito’s vacation house along the New Jersey shore. Like the upside-down flag, this flag is viewed by a great many people as a banner of allegiance on partisan issues that are, or could be, before the court.

The Ohio General Assembly adjourned on Wednesday without addressing an issue that the state’s top elections official said would prevent President Biden from being placed on the ballot there, escalating a partisan clash that could result in the president not being on the ballot in all 50 states in November. Frank LaRose, the Republican secretary of state, has said that he plans to exclude Mr. Biden from the ballot because he will be officially nominated after a deadline for certifying presidential nominees on the ballot. This is usually a minor procedural issue, and states have almost always offered a quick solution to ensure that major presidential candidates remain on the ballot. An earlier generation of Supreme Court justices seemed to possess the capacity for shame. In 1969, Justice Abe Fortas resigned his seat for accepting a $20,000 consulting fee (which he returned) from a foundation led by a man who was convicted of securities fraud. Whatever Justice Fortas believed about his own honor and morality, he understood that the Supreme Court is an inherently fragile institution, and that its nine justices cannot afford the slightest whiff of bias or corruption. They are saying, in effect, that they don’t care if any of this bothers you. To go by recent polls showing that this court’s public approval has approached record lows, it bothers many millions of Americans.

This was when I was a conservative constitutional litigator and occasional Republican Party activist, before my journalism career. Almost all of them showed Romney losing to Obama, and so conservative media started a movement to unskew the polls. There was even a website created, Unskewed Polls, that purported to fix the polling errors, and unskewed polls showed Romney winning. Conservatives believed that pollsters were deliberately undercounting Republican votes to discourage Republican voters and sway the results of the election. So to unskew the results, they reweighted the samples to include a higher percentage of likely Republican voters.
