CNN —Rudy Giuliani concedes he made defamatory statements about Georgia election workers Ruby Freeman and Shaye Moss in an effort to resolve their lawsuit against him and to satisfy a judge who has considered sanctioning him. The late-night Tuesday filing from Giuliani says he doesn’t contest Moss and Freeman’s accusations that he smeared them after the 2020 election. Yet the filing says he still wants to be able to argue that his statements about voter fraud in the 2020 election were protected speech. Notably, he also refuses to concede that his statements caused damages to Moss or Freeman. CNN has reached out to a lawyer for Freeman and Moss.

CNN —A federal judge ordered Friday that the trial in the classified documents case that special counsel Jack Smith brought against former President Donald Trump begin in May 2024. A Trump adviser told CNN that, given the trial date is currently set for the middle of primary season, they anticipate they’ll be able to delay the trial beyond the 2024 presidential election. “Today’s order by Judge Cannon is a major setback to the DOJ’s crusade to deny President Trump a fair legal process. The extensive schedule allows President Trump and his legal team to continue fighting this empty hoax,” Trump spokesperson Steven Cheung told CNN on Friday. CORRECTION: This story has been corrected to reflect that Cannon set the trial date to begin in a two-week period starting on May 20.

On Thursday, Trump aide Will Russell testified to the grand jury investigating the 2020 election aftermath, including the January 6, 2021, attack on the US Capitol. But Smith’s office has continued to investigate the handling of classified material after Trump’s presidency ended, with inquiries of witnesses and grand jury activity. The letter, first reported by ABC News, indicates prosecutors are exploring possible false statement charges related to the employee’s grand jury testimony. Trump also was indicted in late March by a Manhattan grand jury in connection with an alleged hush-money scheme. The special counsel’s office is seeking Kerik’s communications around the 2020 election, a source familiar with the matter told CNN.

In the classified documents case, Trump received a target letter from the special counsel’s office on May 19. Three days after that, on June 8, the grand jury returned an indictment against Trump and his co-defendant and aide Walt Nauta. The special counsel has also probed Trump’s knowledge that he lost the 2020 election, pressure within the Justice Department to help with efforts to overturn the election and fundraising efforts after the election. Giuliani’s lawyer, Robert Costello, told CNN that Giuliani has not received a target letter. The grand jury investigating 2020 election interference is meeting Tuesday at the federal courthouse in Washington, DC.

CNN —Jared Kushner, Donald Trump’s son-in-law, testified before the grand jury investigating the aftermath of the 2020 election and the actions of the then-president and others, a source familiar with the testimony confirmed to CNN. Former Trump aide Hope Hicks also went before the grand jury, according to two sources familiar, testifying in early June. Some of the questions being asked in the grand jury were about whether Donald Trump was told he had lost the election, according to one of the sources familiar. Kushner’s and Hicks’ appearances before the grand jury are notable because both were members of the former president’s inner circle. Several key Trump White House officials have also testified befoe the grand jury, including Pence, Trump’s former chief of staff Mark Meadows and former White House counsel Pat Cipollone, among others.

CNN —An attorney disciplinary committee has recommended Rudy Giuliani be disbarred in Washington, DC, for his efforts on behalf of then-President Donald Trump to overturn the 2020 election results. “He claimed massive election fraud but had no evidence of it,” the committee wrote. “By prosecuting that destructive case Mr. Giuliani, a sworn officer of the Court, forfeited his right to practice law. He should be disbarred.”The panel’s recommendation is not final; the case against Giuliani still must be considered by DC’s Board on Professional Responsibility and by the DC court of appeals. To the contrary, he has declared his indignation over being subjected to the disciplinary process,” the committee wrote in its report.

Multiple sources told CNN that investigators have asked several witnesses before the grand jury and during interviews about the meeting, which happened about six weeks after Donald Trump lost the 2020 election. Some witnesses were asked about the meeting months ago, while several others have faced questions about it more recently, including Rudy Giuliani. Prosecutors have specifically inquired about three outside Trump advisers who participated in the meeting: former Trump lawyer Sidney Powell, one-time national security adviser Michael Flynn and former Overstock CEO Patrick Byrne, sources said. They also discussed naming Powell as special counsel to investigate supposed voter fraud, and Trump invoking martial law as part of his efforts to overturn the election. The December 14 date is of particular interest to prosecutors, sources told CNN.

CNN —Nearly a month after Donald Trump and his aide were indicted in federal court, Walt Nauta is set to appear before a judge in Florida to say he is not guilty. Nauta served as a military valet in the White House under then-President Trump and traveled to Florida with Trump when he left office, eventually taking on the role of his personal aide. But the aide didn’t have a lawyer in Florida who could assist with his representation, delaying his initial plea. But the unprecedented nature of Trump and Nauta’s case, as Trump runs again for the White House, makes timing even more crucial with primary voting for the 2024 GOP nomination beginning early next year. Judge Aileen Cannon, the federal district judge overseeing the case in South Florida, initially set an August trial date, but prosecutors have already asked to begin the trial in December.

Washington CNN —The special counsel’s office is continuing to investigate around Donald Trump’s handling of documents after his presidency ended, multiple sources tell CNN. That includes continued grand jury activity in Florida and inquiries of witnesses, though it is not yet clear what aspects of the investigation the prosecutors are still pushing toward. Trump has pleaded not guilty, and Nauta is expected to enter a plea of not guilty next week. The two men are expected to head to trial as early as this year. A spokesman for the special counsel’s office declined to comment on Thursday.

That activity could signal that investigators are nearing at least some charging decisions in a part of the 2020 election probe, sources added. It is not clear if Trump is a target in the fake electors aspect of Smith’s ongoing criminal probe. Multiple 2020 election witnesses are scheduled for grand jury appointments in the coming days, sources say. Fake electors in NevadaThe fake electors scheme – one of the more public efforts to overturn Biden’s win in the 2020 election – now appears to be at the forefront for prosecutors, sources said. McDonald and DeGraffenreid previously declined to answer some questions about the fake electors scheme in the House inquiry.

Special counsel Jack Smith disclosed in a court filing Wednesday that investigators had more tapes of interviews with Trump conducted by non-government entities and recorded with his consent but did not say what the tapes said or how they were obtained. The new reporting provides more insight into how the special counsel conducted its investigation and what kinds of evidence it has. The special counsel previously revealed it obtained audio of an interview Trump gave at Bedminster for Mark Meadows’ memoir in which the special counsel says Trump shared classified information with visitors and aides. Sources familiar with the investigation told CNN the Trump team does not believe the additional recordings are as incriminating as the recording referenced in the indictment unsealed this month. Trump’s team and the special counsel’s office declined to comment.

CNN —Special counsel Jack Smith has begun producing evidence in the Mar-a-Lago documents case to Donald Trump, according to a Wednesday court filing that hints that investigators collected for the case multiple recordings of the former president – not just audio of an interview Trump gave at Bedminster for a forthcoming Mark Meadows memoir. Prosecutors in the filing used the plural “interviews” to describe recordings of Trump – made with his consent – obtained by the special counsel that have now been turned over to his defense team. The prosecutors’ update to the court on Wednesday night marks another swift move toward trial, which the Justice Department has said should happen quickly, and captures at least some of the extent of the evidence investigators secured to build their historic case against Trump. The first batch of evidence, provided on Wednesday, “includes the grand jury testimony of witnesses who will testify for the government at the trial of this case,” the special counsel’s office wrote. “Defense counsel can contact the government to arrange for inspection of unclassified items seized at Mar-a-Lago on August 8, 2022,” the filing said.

Miami CNN —Former President Donald Trump has pleaded not guilty to 37 charges related to alleged mishandling of classified documents. During the hearing, Trump sat hunched over with his arms crossed and a scowl on his face. The criminal charges in the Justice Department’s classified documents case escalates the legal jeopardy surrounding the 2024 GOP front-runner. What Tuesday’s hearing is aboutAttorneys Todd Blanche and Chris Kise represented Trump in court for the arraignment. The new charges in the DOJ documents case are drastically more serious and present the possibility of several years in prison if Trump is ultimately convicted.

Prosecutors have been examining any effort to obstruct the Justice Department’s investigation after Trump received a subpoena in May 2022 for classified documents. Subpoenas for surveillanceAgents first subpoenaed the Trump Organization for Mar-a-Lago surveillance footage last summer, before the August search by the FBI. But as more classified documents were found through the end of last year, investigators sought more surveillance footage from the Trump Organization, sources tell CNN. Corcoran found about three dozen classified documents, and he turned them over to FBI agents the following day when investigators came to Mar-a-Lago on June 3. In March, a judge ordered Corcoran, who has recused himself from representing Trump in the Mar-a-Lago case, to provide additional testimony.

The main takeaway for me: prosecutors must determine if classified information meets a sort of Goldilocks test. It is about criminalizing (the information) being kept outside of a protected area, even by somebody who is allowed to have classified information. … All of the discussion has been about how Trump and others may have handled documents after knowing there’s a criminal investigation that exists. We know there’s an obstruction of justice investigation around that. A key thing in an obstruction of justice investigation is knowing that there’s a proceeding that you could potentially be obstructing, like a criminal investigation.

On the recording, Trump acknowledges he held onto a classified Pentagon document about a potential attack on Iran. Over the course of the Justice Department’s investigation, prosecutors have expressed skepticism that all classified documents had been returned. The federal government recovered dozens of documents with classified markings from Trump at various points throughout 2022. The audio of Trump acknowledging he had a classified document undercuts Trump’s repeated claims that he declassified everything he took from the White House when he left office. Trump attorney Jim Trusty declined to say on CNN this week whether the document was ever returned to the National Archives.

It allows Pence to offer an additional contrast between himself and former President Donald Trump, his political rival who’s under serious investigation by the Justice Department and others. “The Federal Bureau of Investigation and the Department’s National Security Division have conducted an investigation into the potential mishandling of classified information,” the Justice Department wrote to Pence’s attorney. The Justice Department is still investigating the handling of classified records by Trump and Biden. Two months after Smith’s appointment, Garland appointed special counsel Robert Hur in January following reports that classified documents were found at Biden’s home and former private office. Biden’s team says that when the classified documents were first discovered last fall, they immediately notified the National Archives, which then informed the Justice Department.

The number of new funding deals so far this year is less than last year's Q1 total. The trend is in line with the larger VC funding slowdown in 2023, with the exception of AI deals. That's more than a 50% drop in the number of deals and total deal value from Q1 2022, which had 161 edtech venture deals totaling about $1.3 billion. Reach Capital recently raised a $215 million fund to fund both early and later stage edtech startups. Amid dismal funding for startups this year, the one bright spot has been for AI startups with some generative AI startups raising rounds well over $100 million.

Most people recall the “Access Hollywood” tape of Trump using vulgar language to argue that “stars” can grab women. It also adds his Bedminster club to the potential locations where Trump had classified documents after leaving office. In response to the report, a Trump campaign spokesman said “leaks” are meant to “inflame tensions” around Trump. (The document Trump references was not produced by Milley, CNN was told.) Besides the ongoing investigations into the aftermath of the 2020 election, here’s what else is looming over Trump.

The recording indicates Trump understood he retained classified material after leaving the White House, according to multiple sources familiar with the investigation. Meadows didn’t attend the meeting, sources said. The revelation that the former president and commander-in-chief has been captured on tape discussing a classified document could raise his legal exposure as he continues his third bid for the White House. On the recording and in response to the story, Trump brings up the document, which he says came from Milley. However, there’s no indication Trump followed the legally mandated declassification process, and his attorneys have avoided saying so far in court whether Trump declassified records he kept.

Fact-checking Trump’s CNN town hall in New Hampshire

CNN —CNN hosted a town hall with 2024 Republican presidential candidate and former President Donald Trump on Wednesday night in New Hampshire. 2020 ElectionJust minutes after the town hall began, Trump claimed the 2020 election was “rigged.”Facts First: This is Trump’s regular lie. Trump claimed Wednesday that he got gas prices down to $1.87 – and “even lower” – but they increased to $7, $8 or even $9 under Biden. The Presidential Records Act says that the moment a president leaves office, the National Archives and Records Administration gets legal custody and control of all presidential records from his administration. First, there’s no provision for negotiating over Presidential records at the end of a term.
The first scene of his reelection announcement video released last month showed smoke rising over the US Capitol and rioters with Trump flags. The legal complications facing Trump and GarlandGiven the fraught situation, the Justice Department’s next moves will be hugely significant. Thursday’s Proud Boys convictions are among the most significant of hundreds of successful Justice Department prosecutions of people linked to the US Capitol riot. So while a prosecution of Trump and his closest political associates over January 6 could be tough, it may not be impossible. So for now, at least with GOP primary voters, what doesn’t convict Trump, makes him stronger.
CNN —Prosecutors for special counsel Jack Smith have been asking questions in recent weeks about the handling of surveillance footage from former President Donald Trump’s Mar-a-Lago resort after the Trump Organization received a subpoena last summer for the footage, according to multiple sources familiar with the investigation. Prosecutors are expected to ask them about the handling of the surveillance footage and Trump employees’ conversations following the subpoena, according to the sources. Calamari Sr., the executive vice president and chief operating officer of the Trump Organization, has primarily overseen security operations for Trump and his properties during his decadeslong career working for Trump. His son, Calamari Jr., is director of security for the Trump Organization. An attorney for Calamari Sr. did not respond to a request for comment.
CNN —Former Vice President Mike Pence testified on Thursday to a federal grand jury investigating the aftermath of the 2020 election and the actions of then-President Donald Trump and others, sources familiar with the matter told CNN. The testimony marks a momentous juncture in the criminal investigation and the first time in modern history a vice president has been compelled to testify about the president he served beside. “I think that the vice president, you know, had his own case based on the Speech and Debate Clause. He was pleased that for the first time a judge acknowledged that it applied to the vice president of the United States,” Short said in an interview on NewsNation afterward. President, I don’t question there were irregularities and fraud,” Pence wrote that he told Trump.
CNN —Former President Donald Trump has lost an emergency attempt to block former Vice President Mike Pence from testifying about their direct conversations, in the latest boost to a federal criminal investigation examining Trump’s and others’ actions after the 2020 election. The former president has repeatedly tried and failed to close off some answers from witnesses close to him in the special counsel’s investigation. This latest order from the DC Circuit Court of Appeals likely will usher in Pence’s grand jury testimony quickly – an unprecedented development in modern presidential history. This is a breaking story and will be updated.
