The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s attacks in a vacuum weren’t particularly remarkable – he’s used the same barbs throughout the course of the trial, which he’s attended repeatedly as a spectator. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.

CNN —Ivanka Trump on Friday withdrew her appeal of a judge’s order requiring her to testify at her father’s civil fraud trial next week after an appellate court refused to pause her testimony. Ivanka Trump’s testimony comes after she was previously dismissed as a co-defendant in the New York case against former President Donald Trump, two of his adult sons and his company. On Thursday night, an appeals court denied Ivanka Trump’s request to postpone her testimony until her lawyers could make arguments before the panel that she shouldn’t be required to appear. Ivanka Trump’s brothers, Donald Trump Jr. and Eric Trump, appeared in court this week. The civil trial began in October, soon after Engoron found in September that Trump and his co-defendants were liable for “persistent and repeated” fraud.

CNN —The judge overseeing Donald Trump’s civil fraud trial has expanded a gag order in the trial to extend to Trump’s attorneys after continued lengthy discussions about the judge’s communications with his law clerk during court this week. In a written order Friday, Judge Arthur Engoron prohibited Trump’s attorneys from making any further comments about confidential communications between the judge and his staff inside or outside of the courtroom. The second fine – $10,000 – came after Trump appeared to reference the clerk when speaking to reporters outside of the courtroom. Engoron said he has a right to seek counsel from his clerk and Trump’s legal team has no right to know what they are. “She’s a civil servant, she’s doing what I ask her to do.” Those notes are “confidential communications from my law clerk,” Engoron said Thursday, pounding on the bench.

The back-to-back appearances Thursday from Donald Trump Jr. and Eric Trump – who both helped run the Trump Organization while their father was in the White House – comes ahead of the former president’s own testimony on Monday. Donald Trump Jr. and Eric Trump are co-defendants in the case, along with their father, the Trump Org., and several company executives. Eric Trump acknowledged he provided information to former Trump Org. But he tried to distinguish between specific statements of financial condition – his father’s personal financial statements at the heart of the civil case – and general financial records for the company. Some internal policies and methodologies “have been bolstered” since the investigation began, Trump Jr. said.

The judge said at the time failure to abide by the order would result in serious sanctions. “Requiring Ms. Trump, a non-party, nondomiciliary, to appear at trial in New York and provide live testimony without any limitations is unreasonable.

Eric Haren of the attorney general’s office showed the court several versions of internal spreadsheets from 2017 financial documents prepared by Trump Org. Ultimately the presidential premiums were never included on Trump’s financial statements. Birney, who was a senior financial analyst in 2016 when he joined Trump Org., still works there, now as vice president of financial operations. He reiterated his previous testimony that Weisselberg or former controller Jeffrey McConney would determine what methods were used to value assets that were included on Trump’s financial statements. Birney also testified that Weisselberg directed him to use low capitalization rates and top of the market comparable recent sales to value some of Trump’s assets.

CNN —The former controller of the Trump Organization says that Eric Trump directed him to make certain decisions that led to the inflated valuations of several Trump properties. Jeff McConney, also a co-defendant of former President Donald Trump, Eric Trump and Donald Trump Jr., testified Friday as the first week of the civil fraud trial came to an end. (Attorneys for Eric Trump have argued he was not aware that any phone conversations with McConney were used to formulate value assets in the financial statements for Trump properties.) McConney testified that he did not know at the time that Trump had deeded away his right to develop the property beyond its use as a social club in 2005. He said he did this at the direction of Eric Trump, who oversaw the project.

CNN —A New York appeals court judge on Friday rejected Donald Trump’s attempt to stop the ongoing $250 million civil fraud trial, but temporarily halted the process of breaking up his businesses. We’re not seeking anything but a fair trial and these errors permeate the ongoing trial,” Trump attorney Christopher Kise said in court Friday, referring to “an avalanche of errors” in the summary judgment ruling. “And tellingly, they waited until after Mr. Trump decided to stop attending the trial,” the letter says. Trump attorneys and his co-defendants notified the appellate court that they’ve agreed with the New York Attorney General Letitia James’ office to discontinue the suit. Engoron handed down the summary judgment ruling last week, causing the appellate court to deny Trump’s request for a stay as moot because Engoron ruled as they requested.

CNN —Judge Arthur Engoron rebuked Donald Trump after the former president attacked his clerk in a social media post on Tuesday and forbade the parties from making any future comments about his staff. Trump looked straight ahead at the judge as he issued the order. The New York attorney general is seeking to bar Trump from doing business in the state. Monday, Trump also went after the clerk in his comments outside the courtroom, though he didn’t mention her by name. The post, which Trump included as an image in his own Truth Social post, did not allege that the clerk was Schumer’s girlfriend, merely that the two were “palling around.” Trump added the baseless “girlfriend” claim.

In front of the cameras and on his social media site, Trump attacked New York Attorney General Letitia James for bringing the case against him. CNN —Former President Donald Trump will be in attendance Monday in a New York courtroom for the start of the civil fraud trial against him, his eldest sons, their companies and Trump Organization executives. What’s the impact of the fraud ruling? While Trump can opt to waive his presence at the civil trial, attorneys for the former president have indicated that he is eager to testify in court. Two criminal cases against Trump are scheduled for trial in March in New York and Washington, DC. Smith’s case alleging Trump mishandled classified documents is slated to go to trial in Florida federal court in late May.

New York CNN —Donald Trump, his adult children, and his closest business advisers could be called to testify during the civil fraud trial expected to begin next week in New York. The former president is listed on the witness lists submitted by the New York attorney general and Trump’s legal team. Attorneys for both sides need to be inclusive on their witness lists of any potential person they might want to call, or the judge could exclude the testimony. Also on both lists are Donald Trump Jr. and Eric Trump, who are both defendants in the case, and numerous current and former Trump Organization employees, including former chief financial officer Allen Weisselberg. The New York attorney general’s office identified 28 witnesses they could call in the case, including Michael Cohen and Ivanka Trump.

CNN —A New York judge has found Donald Trump and his adult sons liable for fraud, saying the Trumps provided false financial statements for roughly a decade. Judge Arthur Engoron’s ruling came days before the civil case involving the New York attorney general’s office and the former president was set to go to trial. Engoron granted Attorney General Letitia James’ motion for summary judgment, finding Trump, his sons, and others “to be liable as a matter of law for persistent violations” of New York state law. He found the financial statements the Trumps provided to lenders and insurers for about a decade to be false and said they repeatedly engaged in fraud. In the order, the judge rejected Trump’s deposition testimony in which the former president said that the financial statements were not fraudulent because they contained disclaimers.

Menendez and his wife, Nadine Arslanian Menendez, are accused of accepting “hundreds of thousands of dollars in bribes” in exchange for the senator’s influence, according to the newly unsealed federal indictment. This is the second set of corruption charges levied against Menendez by the Justice Department in a decade. CNN —A federal magistrate judge has denied Hunter Biden’s request to appear virtually for his first court hearing in the federal gun case against him and set his arraignment for September 26. The initial court appearance and arraignment for President Joe Biden’s son will be held at 10 a.m. ET on Tuesday before Magistrate Judge Christopher J. Burke. The deal fell apart under scrutiny from another federal judge, who had taken several recesses to allow the attorneys to regroup and see if they could resolve disagreements. Given the seriousness of the felony gun charges, prosecutors say the magistrate judge should assess Biden in person before deciding his conditions of release.

CNN —President Joe Biden’s son, Hunter Biden, plans to plead not guilty to federal gun charges, he said in a court filing Tuesday. He is also asking for his initial court appearance to be held remotely. In a letter to Magistrate Judge Christopher Burke, attorney Abbe Lowell said Hunter Biden will plead not guilty to the three felony gun charges relating his possession of a revolver in 2018 whether the appearance is held over video or in person. Hunter Biden was previously fingerprinted and had his mug shot taken when he was in court in July when his plea deal collapsed. Because it was in federal court, the photo was not made public.

CNN —Hunter Biden sued the Internal Revenue Service on Monday, alleging its agents illegally released his tax information and that the agency failed to protect his private records. He is seeking, among other things, all documents involving the disclosure of the tax information, $1,000 for each unauthorized disclosure and attorneys fees. The lawsuit, which was filed in federal court in Washington, DC, does not name the two IRS agents turned whistleblowers as defendants. The IRS agents went public with their allegations concerning the Justice Department’s handling of investigation into Hunter Biden earlier this year. After the judge would not sign off on the deal, talks broke down between US attorney David Weiss’ office and Hunter Biden’s attorneys.

(Hunter Biden possessed the gun for about 11 days in 2018.) Lowell on Thursday said the earlier deal means the gun charges should not be allowed. In addition to the gun case, Weiss is still weighing whether to charge Hunter Biden with tax crimes. Count Two accuses Hunter Biden of lying to the federally licensed gun dealer in Wilmington where he bought the gun. Count Three accuses Hunter Biden of illegally possessing the gun while using drugs or being addicted to drugs, which is a federal crime.

New York CNN —Ryan Salame, a former top executive of FTX, the now-bankrupt cryptocurrency trading platform, is expected to plead guilty to criminal charges in a New York courtroom on Thursday afternoon, a person familiar with the matter has told CNN. The plea comes less than one month before Sam Bankman-Fried, co-founder of the digital currency exchange, is set to go on trial. Salame, served as the chief executive of FTX and was a top lieutenant of Bankman-Fried, who is set to go to trial on October 2 facing numerous wire fraud and conspiracy charges. Prosecutors have said Salame played a role in the alleged scheme involving political donations. They want to show the jury a private message Salame sent to a family member in November 2021, explaining that he was a straw donor that Bankman-Fried used to make political donations.

CNN —A federal judge ruled that the jury hearing E. Jean Carroll’s defamation lawsuit will only need to decide how much money Donald Trump will have to pay her, after the judge found the former president was liable for making defamatory statements. Judge Lewis Kaplan said that a federal jury’s verdict earlier this year against Trump will carry over to the defamation case set to go to trial in January involving statements Trump made in 2019 about Carroll’s sexual assault allegations. “The truth or falsity of Mr Trump’s 2019 statements therefore depends – like the truth or falsity of his 2022 statement – on whether Ms Carroll lied about Mr Trump sexually assaulting her,” the judge ruled Wednesday. “The jury’s finding that she did not therefore is binding in this case and precludes Mr Trump from contesting the falsity of his 2019 statements.”Kaplan ruled the trial set for January 15 will be limited to damages. Although her initial lawsuit was filed in 2019, the judge previously allowed Carroll to include comments Trump made at a CNN town hall earlier this year.

CNN —Special counsel David Weiss intends to seek an indictment against President Joe Biden’s son, Hunter Biden, relating to gun charges by the end of the month, the Justice Department said Wednesday. However, after his plea deal to resolve two tax charges fell apart in court, the future of the gun deal has been in limbo. Hunter Biden’s gun-related legal troubles relate to a firearm he purchased in October 2018. In addition to the gun case, Weiss is still weighing whether to charge Hunter Biden with tax crimes. Hunter Biden’s tax-related legal jeopardy emerged after he repeatedly missed IRS deadlines to pay his taxes on time.

CNN —A federal judge in Delaware dismissed two tax misdemeanor charges against Hunter Biden that were filed as part of his now-defunct plea deal, paving the way for special counsel David Weiss to potentially bring more charges in another jurisdiction as part of his continuing probe. After the plea deal collapsed earlier this month, Weiss’ prosecutors asked District Judge Maryellen Noreika to dismiss the charges in Delaware, so new charges could potentially be brought in California or Washington, DC. Hunter Biden’s lawyers agreed that the charges should be dismissed, because they were only brought in Delaware as part of the earlier plea agreement. The two charges brought in Delaware were misdemeanors, for failing to pay taxes on time in 2017 and 2018. That part of the investigation into potential violations of the Foreign Agent Registration Act, led by the FBI, has been part of the Hunter Biden probe for years.

CNN —Federal prosecutors in Manhattan filed another indictment against FTX co-founder Sam Bankman-Fried Monday, dropping another count against him. Prosecutors had previously indicated their plans to drop the one count of conspiracy to make unlawful campaign contributions against Bankman-Fried last month in a letter to the court. Prosecutors maintain that Bankman-Fried conducted an illegal campaign finance scheme in connection to the charges that are moving forward to trial. “The defendant’s use of customer deposits to conduct a political influence campaign was part of the wire fraud scheme charged in the original indictment. Bankman-Fried’s attorneys said they reserve the right to challenge evidence prosecutors may seek to use.

New York CNN —Sam Bankman-Fried, the alleged crypto grifter, is about to learn which of two profoundly divergent paths he’ll take on the road to trial. One path allows him to continue his house arrest in the comfort of his parents’ California home. If his bail is revoked, Bankman-Fried will be immediately remanded to a notorious federal detention center in Brooklyn. Bankman-Fried, who has pleaded not guilty to multiple conspiracy and fraud charges, is set to go to trial in October. But the company came unglued in the span of a week last November — as concerns about its financial ties to Bankman-Fried’s crypto hedge fund, Alameda Research, spurred investors and customers to yank their funds.
