Gabriel Weinberg of DuckDuckGo said that Google’s deals to make its search engine the default on browsers and other platforms blocked its ability to compete effectively. DuckDuckGo, with only 2.5 percent of the U.S. market for search, tried to negotiate with other companies to make its privacy-focused search engine a default. But it was continually turned down because of Google’s deals with those tech partners, he said. “We ultimately decided after three years of trying this that it was a quixotic exercise because of the contracts,” Mr. Weinberg said. Executives at Apple, Microsoft and Verizon are also expected to testify in the trial, which could reshape how consumers get information online.

CNN —Hunter Biden sued the Internal Revenue Service on Monday, alleging its agents illegally released his tax information and that the agency failed to protect his private records. He is seeking, among other things, all documents involving the disclosure of the tax information, $1,000 for each unauthorized disclosure and attorneys fees. The lawsuit, which was filed in federal court in Washington, DC, does not name the two IRS agents turned whistleblowers as defendants. The IRS agents went public with their allegations concerning the Justice Department’s handling of investigation into Hunter Biden earlier this year. CNN —Trump-era Justice Department official Jeffrey Clark, who was charged in the Georgia election subversion indictment, will face off in court Monday against Fulton County prosecutors at a hearing over his attempt to move his case to federal court. Clark’s participation in any legal, factual, or policy deliberations at the Justice Department were in his role as a senior official of that Department,” his lawyers wrote. CNN —Ovidio Guzman Lopez, son of Mexican drug lord Joaquin “El Chapo” Guzman, has been extradited from Mexico to the United States, the US Department of Justice has announced. Guzman was flown to Chicago and landed Friday afternoon, Northern District of Illinois Assistant US Attorney Joseph D. Fitzpatrick told CNN. Following his arrest in Culiacán, chaos erupted in the city with authorities asking citizens to shelter at home as law enforcement clashed with cartel members in various parts of the city. In his statement following the extradition, Attorney General Garland paid tribute to the law enforcement officials involved. “The fight against the cartels has involved incredible courage by United States law enforcement and Mexican law enforcement and military service members, many of whom have given their lives in the pursuit of justice,” Garland said.

The federal prosecutors who charged former President Donald J. Trump with a criminal conspiracy over his attempts to overturn the 2020 election obtained 32 private messages from his Twitter account through a search warrant this winter as part of their investigation, court papers unsealed on Friday said. Questions have lingered about what prosecutors were looking for in Mr. Trump’s Twitter account ever since it was revealed last month that the government had served the warrant on Twitter in January. In an earlier release of documents, prosecutors disclosed that they had obtained some private messages from Mr. Trump’s account but not how many. Mr. Trump’s posts on the platform in the chaotic months after the election were mentioned several times in the indictment that the special counsel, Jack Smith, filed against him in Washington last month. What remains unclear is whether Mr. Smith’s team sought the warrant for Mr. Trump’s account merely to confirm that he had posted the messages that appeared in public, or whether they suspected that some private data in the account might also be important.

CNN —Google went on the offensive Thursday in a closely watched antitrust case dealing with the tech giant’s digital advertising dominance, questioning the motives of the Justice Department’s top antitrust official. Google’s filing targets Jonathan Kanter, the US assistant attorney general for antitrust, and his widely reported past legal representation of Google-parent Alphabet’s corporate rivals, such as Microsoft, Yelp and News Corp, among others. Google’s attorneys argue that Kanter’s past clients create an ethical conflict and should raise doubts about the US government’s overall lawsuit. They also cited evidence in the case that, prior to joining DOJ, Kanter lobbied in a personal capacity for the agency to pursue an antitrust case against Google. The Biden administration has sought to limit the scope of discovery to prevent Google from gathering evidence about Kanter’s advocacy, according to Thursday’s filing.

The two cases, stemming from the efforts of Mr. Trump and his allies to overturn the results of the 2020 election, rely on many of the same facts, documents and witnesses. But as Monday’s court skirmishes demonstrated, the approaches of the two prosecutors in charge of the investigations — Jack Smith, the Justice Department’s special counsel, and Fani T. Willis, the district attorney in Fulton County — could not be more different. Mr. Smith took over the two federal Trump investigations with a promise to move rapidly in hopes of wrapping up legal proceedings before the 2024 election, and the indictment handed down against Mr. Trump on Aug. 1 included just four counts. While it referred to six unindicted co-conspirators, only Mr. Trump was charged. By contrast, the indictment brought by Ms. Willis includes 41 counts against the former president and encompassed allegations against his long roster of co-defendants.

Since Mr. Trump is charged with, among other crimes, conspiracy to defraud the United States and to deprive people of the right to have their votes counted, Mr. Smith would clearly be right in arguing that the Alvarez decision doesn’t apply. Characterizing Mr. Trump’s words as “speech incident to criminal conduct” would neatly solve Mr. Smith’s First Amendment problem, but at a substantial cost to the prosecution. To win a conviction, the government must persuade 12 jurors to peer inside Mr. Trump’s head and find beyond a reasonable doubt that he knew he was lying when he claimed to be the winner of the 2020 election. If Mr. Trump actually believed his false assertions, his speech was not “incident to criminal conduct.”How can Mr. Smith persuade 12 jurors that no reasonable doubt exists that Mr. Trump knew he was lying? But there also will likely be evidence that fervent supporters of Mr. Trump’s efforts fed his narcissism with bizarre false tales of result-changing electoral fraud, and frivolous legal theories justifying interference with Mr. Biden’s certification as president-elect.

Compare the United States with Europe, where authorities have more successfully resisted the consolidation of major industries. The economist Thomas Philippon wrote in a 2019 book about the decline of competition in the United States that the American economy would be roughly $1 trillion larger than it is today if the United States had simply maintained the level of competition that prevailed in 2000. The turn toward stringency reflects some of what has been learned in recent years about the effects of corporate concentration, for example, in a new emphasis on protecting workers. The guidelines treat the economic analysis of corporate concentration as a valuable source of information, rather than the measuring stick by which decisions are made. Mr. Kanter said his department is focused on protecting competition because that is the goal that Congress enshrined in law and he is in the law enforcement business.

The Justice Department also pointed to online posts from the company's billionaire owner Musk as example of "discriminatory public statements." Musk described the Justice Department lawsuit against SpaceX as "weaponization of the DOJ for political purposes." Clarke also said SpaceX recruiters and high-level officials "actively discouraged" asylum recipients and refugees from seeking work opportunities at the company. The United States seeks fair consideration and back pay for asylum recipients and refugees who were deterred or denied employment at SpaceX due to the alleged discrimination, the Justice Department said.
