CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.

We should call it an “election interference” trial going forward. Assistant District Attorney Joshua Steinglass skillfully advanced the election interference theory by structuring his evidentiary points in chronological order within that frame. Trump’s alleged 2020 attempt to overthrow our government distorts perceptions of how serious the charges related to the 2016 election are. How can we call this an election interference trial, they ask, if the election was already over when the 34 alleged document falsification crimes occurred? Donald Trump on Saturday took aim at two likely witnesses in his upcoming New York hush money trial, testing the boundaries of a gag order that prohibits such public statements. The social media post is the latest challenge to the limits of a gag order that forbids Trump from making public statements about likely witnesses and jurors. In the weeks since, Trump has repeatedly gambled on the limits of the gag order. It would not be the first time Trump has faced consequences for disobeying a gag order. In a separate trial in October, Judge Arthur Engoron fined Trump $10,000 for gag order violations.

CNN —Three months ago, Donald Trump took the stand before a jury of nine in a New York courtroom without his typical bombast or ranting. “The record will reflect that Mr. Trump just rose and walked out of the courtroom,” Judge Lewis Kaplan announced, in case any jurors had missed it. “I mean, our whole case was about the fact that Donald Trump is unable to follow the law, unable to follow the rules. But just having political views about Trump, for or against, won’t be a reason for potential jurors to be dismissed. When Kaplan asked jurors a series of questions individually, Trump turned in his chair to watch each person speak.

CNN —Lawyers for Donald Trump have filed another appeal in the hush money case to challenge the order by the trial’s judge denying him from arguing he has presidential immunity. Trump’s attorneys also are challenging Judge Juan Merchan’s “refusal” to recuse himself from the trial and a previous ruling related to how dockets are made publicly. In a brief two-page notice of petition filed on Wednesday, Trump’s lawyers alleged the judge exceeded his authority in those rulings and have asked the appeals court to hold a hearing on May 6. The court filing posted on the public docket does not indicate that Trump is seeking an emergency hearing before the appeals court to delay the trial in this notice of petition. Trump’s lawyers earlier this week asked the appeals court to stop the trial over pretrial publicity and the gag order.
