Why a Sale of TikTok Would Not Be Easy

Legislation that could eventually mandate a sale of TikTok is moving forward. The House on Wednesday approved the bill to ban TikTok unless ByteDance sells the app to a buyer the government signs off on. Under the legislation, the president will need to agree that the sale meets those conditions. ByteDance and TikTok have not said how they would handle a sale, if it’s required. But legal experts say that in the case of a sale, ByteDance would likely need to decide between selling all of TikTok globally versus trying to cordon off its U.S. business.

But that glosses over the deeper TikTok security problem, which the legislation does not fully address. Those algorithms, which guide how TikTok watches its users and feeds them more of what they want, are the magic sauce of an app that 170 million Americans now have on their phones. But TikTok doesn’t own those algorithms; they are developed by engineers who work for its Chinese parent company, ByteDance, which assembles the code in great secrecy in its software labs. But China has issued regulations that appear designed to require government review before any of ByteDance’s algorithms could to be licensed to outsiders. Few expect those licenses to be issued — meaning that selling TikTok to an American owner without the underlying code might be like selling a Ferrari without its famed engine.

House Democrats Robert Garcia, D-Calif. and Jamie Raskin, D-Md, sent a letter to SpaceX demanding transparency from the defense contractor following reports of potentially illegal purchases and use of Starlink satellite internet equipment by Russia in occupied territories of Ukraine. The congressmen also announced a probe of SpaceX by the Democratic House Committee into the company's safeguards and procedures for preventing illegal exports and use of its Starlink equipment and services. The Washington Post first reported on the probe and March 6 letter to SpaceX president and chief operating officer Gwynne Shotwell. In a statement on Thursday, the congressmen wrote, "Russia's use of Starlink satellite terminals would be in contravention of U.S. export controls that prohibit Russia from acquiring and utilizing U.S.-produced technology." The new probe by House Democrats follows news on Wednesday that a man in New Jersey was arrested on charges of allegedly trafficking 675 SpaceX Starlink terminals which were purchased with stolen credit card accounts or hacked Starlink billing accounts.

Citi has identified European stocks it says are similar to the high-flying " Magnificent Seven " U.S. technology stocks, but trade at cheaper valuations leaving more room for them to rise. Citi's resulting Super Seven picks are Novo Nordisk , ASML , LVMH , SAP , Schneider Electric , Richemont and Ferrari . All of the stocks stocks also trade in the United States. Despite the rally over the past year, Citi points out that as a group, the Super Seven have lagged the Magnificent Seven, with 70% less appreciation since early 2023, leaving more upside potential. Looking ahead, Citi said the Super Seven was well positioned to continue outperforming should current "narrow" market conditions persist, and cautioned against selling stocks on the basis of a narrow market leadership.

Starbucks and the union that represents employees in roughly 400 of its U.S. stores announced Tuesday that they were beginning discussions on a “foundational framework” that would help the company reach labor agreements with unionized workers and resolve litigation between the two sides. The union greeted the development as a major shift in strategy for Starbucks, which has taken steps to resist union organizing at the company since the campaign began in 2021, moves that federal labor regulators have said violated labor law hundreds of times. It said that, as a gesture of good faith, it was providing unionized workers with benefits it introduced in 2022 but withheld from union stores, like an option for customers to tip via credit card. Representatives of both Starbucks and the union, Workers United, said that while details must be worked out, they hoped to be back at the bargaining table in the coming weeks. Negotiations between the two sides had largely lapsed over the past several months.

Super Micro Computer has soared more than 182% since the start of the year, but the chipmaker has even more upside potential ahead thanks to artificial intelligence tailwinds, according to Rosenblatt. Another key factor in Super Micro's growth story is its liquid cooling solutions for data centers, Mosesmann added. Traditional chipmakers have been less adept in this segment, which opens the door for Super Micro to achieve "heightened hyper-scale engagement," according to the analyst. The NumbersWalmart said its comparable store sales were up 4 percent in the three months that ended in late January compared with the year before. Airbus, the European aerospace giant, plans to deliver around 800 commercial aircraft this year, including the popular single-aisle A320neo, its main competitor to the 737 Max. Airbus pulled in a record 2,094 commercial aircraft orders last year, partly on a surge in demand for narrow-body and mid-sized jets from India and other rapidly growing countries. That added to the company’s extensive backlog of 8,598 commercial aircraft at the end of 2023. By contrast, Boeing delivered 528 commercial airplanes and recorded 1,576 net orders. The company added a special dividend, on top of its usual payout, as its net cash exceeded €10 billion.

CHARLESTON, W.Va. (AP) — Cleveland-Cliffs announced Thursday that it is shutting down a northern West Virginia tin production facility indefinitely and plans to lay off 900 workers after the International Trade Commission voted against imposing tariffs on tin imports. The trade commission also voted to stop a duty investigation into tin products shipped from South Korea. Cleveland-Cliffs said it will offer either severance packages or opportunities for workers in Weirton to be relocated to its other facilities. The trade commission ruling was shocking and made it “impossible for us to viably produce tinplate.”Goncalves added that the trade commission’s decision “is a travesty for America, middle-class jobs, and our critical food supply chains. Thousands of ride-hailing and delivery workers in the U.S. and the U.K. went on strike on Valentine's Day, calling for higher pay and other changes to their working conditions. GREEN RIVER, Utah (AP) — A plan to extract lithium — the lustrous, white metal used in electric vehicle batteries — in southeast Utah is adding to an anxiety familiar in the arid American West: how the project could affect water from the Colorado River. The company has also acquired rights to freshwater from the Green River nearby, leading to questions about how groundwater and river water are connected, and how its plans to produce lithium could affect the environment. The Green River is a tributary of the Colorado River, the over-tapped powerhouse of the West upon which 40 million people rely. So far, Anson has acquired rights for 2,500 acre-feet of water from the Green River. “There’s a difficulty turning anything down in a community like Green River,” he said.
