Opinion | Dobbs Overturned Much More Than Roe v. Wade

Most of my writing this week was on the recent elections in Iowa and New Hampshire, but most of my reading was focused elsewhere. In particular, I want to highlight this report from Jessica Valenti, published in her excellent newsletter, on proposed travel bans for abortion care in Tennessee and Oklahoma. The Tennessee ban, proposed by State Representative Jason Zachary, would make it a felony to take a minor out of state to obtain an abortion. I have written about how abortion bans implicate a broad set of rights tied to our personal and bodily autonomy, including the right to travel between states. The federal government, by contrast, was a limited government of enumerated powers — a government that could take only such action as allowed by the Constitution.

Read previewA study published on Wednesday in JAMA Internal Medicine estimated that over 64,000 pregnancies were caused by rape in the 14 states with abortion bans since July 2022. Samuel Dickman, Planned Parenthood Montana's medical director, along with his team, attempted to quantify the number of rape-related pregnancies in states with abortion bans triggered by the overturning of Roe v. Wade. As it stands, 14 states have implemented total abortion bans following the Dobbs decision. BISMARCK, N.D. (AP) — A North Dakota judge ruled Tuesday that he won’t block a part of a state law that doctors say puts them at risk of prosecution if they perform an abortion to save a patient’s life or health. Republican state Sen. Janne Myrdal, who brought the 2023 bill revising revising the laws, welcomed the judge's ruling. The judge granted a preliminary injunction blocking the ban from taking effect in 2022, a decision the state Supreme Court upheld in March. In June, the clinic filed an amended complaint, joined by several doctors in obstetrics, gynecology and maternal-fetal medicine. ___This story has been corrected to show that The Red River Women’s Clinic sued the state in 2022, not last year.

On the 51st anniversary of Roe v. Wade, the Supreme Court case that enshrined a woman’s right to an abortion, Biden and Harris announced new rules and guidance about contraceptives and abortion and a national tour by Harris to call attention to the issue. Biden and Harris, as well as Democrats down the ticket are positioning themselves as the protectors of abortion rights and casting the Dobbs decision that left abortion access to the states as harmful to women. And Democrats have seen a series of victories in races and credit their position on abortion rights with getting voters to the polls. But, ballot measures to ensure abortion rights were passed in California, Michigan, Vermont while voters in Kansas, Kentucky and Montana voted down proposals that would have rolled back protections. Democrats hope the issue will propel Biden and Harris to victory in 2024.

Support for abortion rights drove women to the polls during the 2022 midterm elections, delivering Democrats unexpected success. Still, Democrats believe abortion will be a key motivator for base voters and help expand their coalition. Biden aides and allies point to recent elections that have overwhelmingly shown that, when voters can choose, they have chosen to safeguard abortion rights. According to an Associated Press-NORC Center for Public Affairs Research poll, among Democrats, nearly nine in 10 say abortion should generally be legal. But it also underscores a pervasive fear among Republican candidates and voters alike that vocalizing their desire to further restrict abortion rights in 2024 might be politically dangerous.

WASHINGTON (AP) — More than a year after a generational victory for their movement, opponents of abortion rights are rallying in the nation's capital on Friday with an eye on presidential elections that could be heavily influenced by abortion politics. Thousands of protesters are expected on the National Mall for an hour of speeches and a march past the U.S. Capitol and the Supreme Court. Friday's March for Life is the second such event since the June 2022 Supreme Court ruling that ended the federal protection for abortion rights enshrined in Roe v. Wade. Most abortion opponents did not expect the overturning of Roe v. Wade and the passage of state abortion bans to lead to the expansion of legal abortion in much of the United States. Opponents of abortion are now on the defensive. That’s largely because their strategy has focused on passing bans, which have been politically polarizing and have alienated members of the Democratic Party — a party that only a few decades ago included many supporters of the pro-life cause. It didn’t have to be this way. As a historian of the anti-abortion movement and abortion politics, I wrote in early 2021 that the end of Roe may “only marginally reduce the number of legal abortions” in the United States and “at worst, may lead to a pro-choice Democratic backlash that will expand the number of legal abortions.”

MINNEAPOLIS (AP) — MyPillow chief executive and prominent election denier Mike Lindell said Friday that Fox News has stopped running his company's commercials, disputing the network's assertion that it is simply because he hasn't paid his bills. Lindell went public by tweeting that Fox, which had been one of MyPillow's biggest advertising outlets, had canceled him. Several big-box retailers, including Walmart, have discontinued his products, and lawyers who were defending him against defamation lawsuits by voting machine companies quit. In an interview with The Associated Press, Lindell acknowledged that MyPillow owes money to Fox. He said MyPillow has long spent an average of $1 million a week to run its ads on Fox.

DocuSign shares rose as much as 15% and closed up 12% on Friday after the Wall Street Journal reported the e-signature software company tapped advisors about a possible sale. Talks are still preliminary, the Journal reported, citing people familiar with the matter. A DocuSign representative didn't immediately respond to a request for comment on the report. DocuSign went public in 2018 and saw business boom during the pandemic as demand soared for technology that allowed people to work together on documents remotely. Young voters could be pivotal in an election year where the race is expected to be very close between presumptive nominees Biden and Republican front-runner Donald Trump. While young voters tend to favor Democrats, even a small drop in turnout among those voters – or a shift toward Republicans – could make a dispositive difference in battleground states. Biden has a dramatic disadvantage, compared with Trump, on the economy, even as young voters report overwhelmingly that their own financial situations are solid. That's on track with Biden's performance among young voters in 2020, when exit polls showed Biden took 60% of the youth vote, compared to 36% of young voters who voted for Trump. Electoral results since the Dobbs v. Jackson Women’s Health Organization decision should tell a lot of people in the Republican Party something they absolutely do not want to hear: Even rank-and-file G.O.P. voters are not as pro-life as we might have thought when Roe v. Wade was the law of the land. That trend was confirmed last month in Ohio — the latest sign that the Republican Party needs to figure out a new way of addressing abortion. Many conservatives may call themselves pro-life, but in practice, that may be a more aspirational statement than an accurate reflection of hard policy views. DENVER (AP) — Denver Broncos safety Kareem Jackson said he's flying to New York to meet with NFL Commissioner Roger Goodell on Wednesday to get more clarity about his latest suspension and the way the league enforces its player safety rules. He's missed three games so far and will miss three more, costing him a total of $837,000 in lost wages. Previously, he's said he knows he's drawing extra scrutiny from the league for his spate of fouls. “So, hopefully something comes from this meeting — I don't think much will, because I don't even think they know," Jackson added. CNN —Idaho asked the Supreme Court on Monday to allow its state abortion ban that imposes penalties on doctors who perform abortions to take full effect despite federal requirements for emergency room doctors. But a district court blocked the law in hospital emergency rooms that receive Medicare funding, holding that the state law interferes with a federal Medicare statute. The United States sued, claiming that a provision of a federal Medicare statue – the Emergency Medical Treatment and Labor Act (EMTALA) preempts Idaho’s law in emergency rooms. The federal law requires hospitals to provide stabilizing care to emergency room patients regardless of their ability to pay. Now the state, represented by a conservative legal group that opposes abortion, is asking the Supreme Court to step in on an emergency basis to put the district court ruling on hold while appeals play out.

(AP) — Justin Simmons gave another impassioned defense of suspended Denver Broncos teammate Kareem Jackson on Wednesday, calling for the NFL to provide more clarity and consistency in the rules intended to protect the health and safety of players. The NFL on Tuesday upheld its four-game suspension of Jackson for lowering his helmet to hit Vikings quarterback Joshua Dobbs in Denver's 21-20 win Sunday night. “I mean, the fact that he’s going to miss the next four games in a crucial part of our season is unbelievable,” Simmons said. “And for a play that if that’s routinely going to be called, why was it not called on that one play? “We're trying our best to adapt to the rules while we’re in the game,” Simmons added.

Asked why he felt that way, Brady added: “I think the coaching isn’t as good as it was. “I think the rules have allowed a lot of bad habits to get into the actual performance of the game.
