Asian American groups are sounding the alarm after the House this week passed a bill seeking to revive the highly controversial, Trump-era surveillance program the China Initiative. “Originally a Trump-era initiative sold as a national security measure, the China Initiative instead turned out to be a witch hunt,” leaders from civil rights groups Asian Americans Advancing Justice | AAJC, Stop AAPI Hate, and the Asian American Scholar Forum said in a joint statement. The groups added that the initiative devastated families and impeded the United States’ ability to retain and attract academic talent. Asian American advocacy groups have long been warning of the security program’s “chilling” effects. The White House wrote that image-based sexual abuse “has skyrocketed,” disproportionately affecting women, children and LGBTQ people. More nonconsensual sexually explicit deepfake videos were uploaded online in 2023 than all previous years combined. Even though Latinos in the U.S. have become more aware of the word "Latinx," about half of the Hispanic population still has never heard of the gender-neutral alternative, the Pew Research Center found in a study published Thursday. The number of Latinos who have heard of "Latinx" has nearly doubled since 2019, when only 23% of the Hispanic population reported being aware of it. Now, almost half of the U.S. Latino population (47%) say they have heard of "Latinx," according to the study. The share of the Hispanic population who use "Latinx" to describe themselves remained statistically unchanged from 2019 to 2023. Only 3% of the Hispanic population nationwide used the word to describe themselves in 2019, which rose to 4% in 2023.

MEMPHIS, Tenn. — Opening statements were expected Wednesday in the federal trial of three former Memphis police officers charged with federal civil rights violations in the January 2023 beating death of Tyre Nichols. Police video released that month showed the five officers, who also are Black, beating Nichols as he yelled for his mother about a block from his home. The officers said Nichols was pulled over for reckless driving, but Memphis’ police chief has said there is no evidence to substantiate that claim. The three officers now facing trial, along with Martin and Mills, were fired for violating Memphis Police Department policies. They had been members of a crime suppression team called the Scorpion Unit, which was disbanded after Nichols’ death.

A federal judge issued an injunction Tuesday partially blocking the enforcement of a New Hampshire law that bars some transgender students from competing on school sports teams that align with their gender identity. Last month, two transgender teenage girls and their families sued New Hampshire education officials, arguing that the measure violates Title IX civil rights rules, which prevent sex discrimination in federally funded education programs and activities. The Biden administration expanded Title IX rules in April to include protections for students on the basis of sexual orientation and gender identity. Moreover, the expansion of the Title IX rules is temporarily blocked in at least 10 states and faces ongoing court challenges in roughly 10 others. MEMPHIS, Tenn. — Jury selection was scheduled to begin Monday in the federal trial of three former Memphis officers charged with violating the civil rights of Tyre Nichols, the 29-year-old man whose fatal beating was caught on police cameras while also triggering protests and calls for police reform. Officers caught up with Nichols and pummeled him in a Memphis neighborhood, police video showed. An autopsy report showed Nichols died from blows to the head and that the manner of death was homicide. The three officers now facing trial, along with Emmitt Martin III and Desmond Mills Jr., were fired after Nichols’ death for violating Memphis Police Department policies. Mills and Martin both have pleaded guilty in federal court and they could testify in the trial.

BOSTON — A Massachusetts man has been sentenced to 18 months in prison for threatening to kill a group of Asian Americans and repeatedly hitting one of them with his car. “This defendant targeted this man solely because he was Asian American. He yelled “go back to China” and threatened to kill them before repeatedly hitting one of them, a Vietnamese man, with his car. There had been a dramatic spike in verbal, physical and online attacks against Asian Americans and Pacific Islanders since the start of the coronavirus pandemic, which was thought to have originated in China. “There are bad people who do bad things and good people that do a bad thing,” the attorney wrote in the sentencing memorandum.

A 37-year-old Tennessee man was charged over alleged social media threats against President Joe Biden, Vice President Kamala Harris and former President Barack Obama, according to a press release from the Department of Justice. Kyl Alton Hall was indicted Tuesday on two counts of threatening a sitting president or vice president and one count of a threat to a former president. The U.S. Secret Service investigated the case, which will be prosecuted by the national security and civil rights unit in the local U.S. attorney’s office. A spokesperson for the Secret Service did not immediately respond to a request for comment. The charges come the same week that all three officials — Biden, Harris and Obama — appeared in Chicago to speak at the Democratic National Convention, where Harris accepted her party’s presidential nomination.

A judge in Kentucky has dismissed core charges against two former Louisville police officials involved in the raid that ended in Breonna Taylor's death. Judge Charles R. Simpson III of western Kentucky's U.S. District Court on Thursday said Taylor's death was triggered by the actions of her boyfriend, who opened fire when police arrived outside her Louisville apartment March 13, 2020. "Those violations resulted in Ms. Taylor’s death," he said in a statement at the time. Jaynes and Meany weren't at the raid, and her death was more directly tied to Walker's decision to open fire, the judge wrote. "The Court finds that the warrantless entry was not the actual cause of Taylor’s death," he wrote in his decision.

A second former Memphis police officer is expected to change his not guilty plea on Friday in connection to alleged civil rights violations that ended in the beating death of Tyre Nichols, court documents revealed. A change of plea hearing for former officer Emmitt Martin has been set for 2 p.m. CT in the courtroom of U.S. District Judge Mark Norris, records showed. Back in November, another former Memphis officer, Desmond Mills Jr., changed his plea to guilty to federal charges of excessive force and obstruction of justice. Officers reportedly pulled over Nichols for reckless driving, but Memphis police later said there was no evidence to support a stop.

CNN —A second former Memphis police officer facing federal civil rights charges in the violent arrest and beating death of Tyre Nichols changed his plea to guilty on Friday in federal court. Mills and Martin are among five former officers charged in the death of Nichols, a 29-year-old Black man. He admitted he “willfully used unreasonable force against Tyre Nichols,” “aided and abetted” other officers in assaulting Nichols and “failed to intervene” in other officers’ use of force. Police said the unit was permanently deactivated shortly after Nichols’ death. The beating and Nichols’ death led to protests and vigils in Memphis and other major US cities, reigniting the contentious debate over policing and the ways that law enforcement treat Black people.

A federal court in Louisiana has dealt a serious blow to the Biden administration’s effort to protect communities heavily affected by toxic industrial pollution. Title VI of the 1964 Civil Rights Act allows the E.P.A. to investigate whether state programs that receive federal money are discriminating on the basis of race, color or national origin. But the judge’s ruling effectively means that the federal government is limited to taking action against specific agency decisions that are intentionally discriminatory. That means the state cannot be held liable for actions like allowing several chemical plants, refineries and other industrial operations in minority communities.

A high school English teacher is suing a Wisconsin school district, alleging it did not renew his contract last year because he refused to use the preferred names of two transgender students. Argyle School District Superintendent Randy Refsland said in an email Tuesday night that he could not comment because the matter was being litigated in court. But after one of the students expressed unhappiness with the situation — the student's father was described as a fellow district teacher — the district demanded adherence to the policy of using students' preferred names and pronouns, according to the suit. Greul said that this fight over first names and pronouns will be crucial for "everyday Americans across the country." A 2022 report on pronouns by the Minnesota Department of Health says that the correct use of preferred pronouns "saves lives."
