The winners from the TikTok battleThe countdown to TikTok disappearing from the United States is about to start. The Senate overwhelmingly passed legislation to force the divestment of the video app by its Chinese owner, ByteDance, within a year or be banned. Barring the app from U.S. shores could take months, or even years — if it actually happens. The road ahead is complicated, and any disruptions to the app could bolster its American rivals. Analysts at Bernstein have estimated that, should TikTok be banned, Meta could draw up to 60 percent of TikTok’s American ad revenue, while YouTube could take another 25 percent or so.

The social network TikTok, owned by the Chinese company ByteDance, has launched a new application in France and Spain, called TikTok Lite, which allows its users to get paid by watching videos, it announced on April 10, 2024. Users aged 18 or older can "collect points by discovering new content or completing certain actions," the social network said. TikTok will voluntarily suspend its new app TikTok Lite's reward programme while it works to address EU concerns, the company said on X social media platform on Wednesday. The European Commission had given the ByteDance-owned company until today to address its concerns about the potentially addictive nature of the reward programme for children or face a temporary suspension of the feature.

President Joe Biden signed a bill into law on Wednesday that would ban TikTok if its not sold within the year. The measure is folded into a law that says the United States will provide aid to Israel, Ukraine, and Taiwan. TikTok representatives have already responded. "This unconstitutional law is a TikTok ban, and we will challenge it in court," the company wrote in a Wednesday statement on X following Biden's signing. "This ban would devastate seven million businesses and silence 170 million Americans."

Washington CNN —President Joe Biden on Wednesday signed into law an aid package providing crucial military assistance to Ukraine, capping months of negotiations and debate. The aid package, passed by the Senate late Tuesday evening and worth $95 billion in total, includes nearly $61 billion in aid to Ukraine, $26 billion for Israel and $8 billion for the Indo-Pacific. Hardline House conservatives opposed further US funding to Kyiv and threatened to oust Johnson over his handling of the negotiations. Conservatives in Congress have opposed additional assistance for what they view as an unwinnable war. Earlier this year, Biden signaled his intentions to make significant immigration-related concessions if Congress were to move forward with the aid bill.

President Joe Biden on Wednesday signed into law measures to provide aid to Israel, Ukraine and Taiwan, as well as force Chinese TikTok parent company ByteDance to sell the social media platform. It should have been easier and it should've gotten there sooner," Biden said Wednesday after signing the bill. Biden had signaled his intention to sign the bill into law after the House passed the proposal on Saturday. The law earmarks roughly $60 billion in aid for Ukraine, $26 billion for Israel and $8 billion for security in Taiwan and the Indo-Pacific.

Not only would that deal another huge blow to China’s tech ambitions, it would further deepen the divide between two digital worlds centered around the rival economic superpowers. Congress on Tuesday approved legislation that could compel ByteDance to sell TikTok or face a national ban. That leaves few options for ByteDance to secure the future of TikTok in the US, its biggest market with 170 million users. “This includes everything from who owns and operates data centers, to space-based internet satellites, to undersea cables and, of course semiconductors.”In that sense, the TikTok ban has its silver lining for Beijing. Growing challenges for Chinese appsThe TikTok legislation was included in a wide-ranging foreign aid package meant to support Israel, Ukraine and Taiwan.

Maybe…Earlier attempts to ban or force a sale of TikTok often haven't stood up in court. Other parties, like TikTok creators, may launch separate legal challenges in the coming weeks, as they have done in the past. AdvertisementTrump's 2020 order to ban TikTok was halted by a federal judge who said it likely exceeded executive authority. While the bill is framed around forcing US ownership of TikTok, it's likely to result in a ban, which strengthens the free-speech argument. Congress hasn't proven that an outright sale or ban of TikTok is the only way to protect national-security interests.

In recent months, the company has foreshowed it plans to challenge the law on First Amendment grounds. Krishnan said even the national security argument will not withstand legal scrutiny because the Chinese government could easily purchase the same data on Americans through the open market. TikTok’s looming legal challenge will be one of several that could eventually reach the US Supreme Court that could completely redefine online speech. Other high-profile cases that will determine whether social media companies can moderate content on their platforms are also likely to be decided this year. “The rules for online speech are being written by the Supreme Court this year,” Persily said.

CNN —The Senate will take up the House-passed $95 billion foreign aid package this week, as the legislation nears its final congressional action after both sides of Capitol Hill have struggled for months to send aid to Ukraine, Israel and Taiwan. The legislation ties together four bills that the House voted on separately in a rare Saturday session, providing nearly $61 billion in aid for Ukraine, over $26 billion for Israel and more than $8 billion for the Indo-Pacific. Aid for Ukraine and Israel has been stalled after House and Senate Republicans demanded action on border security first, leading to months of negotiations in the Senate on a border package tied to foreign aid. “The Senate now stands ready to take the next step,” Senate Majority Leader Chuck Schumer declared Saturday afternoon. Senators were supposed to be in recess this week, marking the Passover holiday, but they elected to return and wrap up work on the foreign aid package instead.

Chinese-owned ByteDance will be forced to sell TikTok to a US company or face a nationwide ban. AdvertisementThose who want the app banned argue that TikTok may be forced into giving over user data to the Chinese government. A ban would be "devastating" for her, she said, because years of her work would be "deleted forever." AdvertisementA TikTok spokesperson told BI in March that the legislation has a "predetermined outcome," which is a total ban of TikTok in the US. Read previewDigital regulators in Europe are clamping down on a new feature by TikTok that rewards users for consuming videos and interacting with creators, citing addiction concerns among children. The European Commission said on Monday that it had opened formal proceedings against TikTok Lite, a spinoff version of the TikTok app that uses less mobile data and launched in Spain and France in March. Users can earn such points on the Lite app by watching videos for up to 85 minutes daily. "We suspect TikTok 'Lite' could be as toxic and addictive as cigarettes 'light,'" said Thierry Breton, commissioner for the internal market in the EU. "The TikTok Lite rewards hub is not available to under 18s, and there is a daily limit on video watch tasks," the spokesperson said.

Senators passed a crucial procedural vote with wide bipartisan support, signaling that the foreign aid package has the strength to pass a final vote. The funding includes roughly $60 billion for Ukraine aid, $26 billion for Israel and $8 billion for Taiwan and Indo-Pacific security. Spending-wise, the legislation is similar to the $95 billion foreign aid bill passed by the Senate in February, which has been effectively shelved in the House in the weeks since. TikTok has pushed back on this proposal since the House passed it over the weekend. Those political threats, along with an increasingly razor-thin House Republican majority led Johnson to effectively table the Senate's $95 billion foreign aid bill for weeks.

Washington CNN —Congress finalized legislation on Tuesday that could lead to a nationwide TikTok ban, escalating a massive threat to the company’s US operations. What does the TikTok legislation do? The earlier TikTok bill had been passed by the House, but it stalled in the Senate. In a procedural move, House Republicans this month attached the revised TikTok bill to the foreign aid package in hopes of forcing the Senate to vote on the TikTok legislation. Bundling the bill with the foreign aid — a top US priority — fast-tracked the TikTok bill and made it more likely to pass.

A bill that would force a sale of TikTok by its Chinese owner, ByteDance — or ban it outright — was passed by the Senate on Tuesday and is expected to be signed quickly into law by President Biden. Now the process is likely to get even more complicated. Congress passed the measure citing national security concerns because of TikTok’s Chinese ties. The measure is likely to face legal challenges, as well as possible resistance from Beijing, which could block the sale or export of the technology. It’s also unclear who has the resources to buy TikTok, since it will carry a hefty price tag.

CNN —TikTok will file a court challenge if Congress passes legislation paving the way to a nationwide ban of the app, a top executive told employees in an internal memo obtained by CNN. He invited employees to an internal town hall scheduled for Wednesday “for additional context.”The memo was earlier reported by The Information. The legislation calls for forcing TikTok’s Chinese parent, ByteDance, to sell the app within 270 days — otherwise it would be illegal for US app stores to offer TikTok for downloads. The legislation also would allow Biden to extend that deadline by another 90 days if he determines there’s been progress toward a sale. Foreshadowing its legal strategy, TikTok has already publicly opposed the bill as an infringement on its users’ First Amendment rights.
