Trump's legal team argued against his gag order in his upcoming election interference trial. AdvertisementA panel of three judges on Monday appeared highly skeptical of arguments from Donald Trump's legal team seeking to revoke a gag order that bars him from attacking potential witnesses in his election interference criminal case. Depending on "the context," Lauro argued, Trump would be permitted to pressure possible witnesses not to cooperate with prosecutors. The gag order in the election interference case is separate from a gag order in another ongoing civil trial against Trump in New York. He found that Trump violated it earlier in November, though an appeals court on Thursday temporarily lifted the order.

The justices turned away Chauvin's appeal that he filed after a Minnesota appellate court upheld his 2021 murder conviction and rejected his request for a new trial. His attorney also said one juror may have concealed possible bias by failing to disclose during the jury selection process that he had attended "an anti-police 'George Floyd' rally." Attorneys for Minnesota did not respond to Chauvin's petition asking the Supreme Court to hear his appeal. The Minnesota Court of Appeals in April rebuffed Chauvin's appeal, upholding his conviction and rejecting his request for a new trial. Minnesota's top court in July denied Chauvin's request to review the case, prompting his appeal to the U.S. Supreme Court.

NEW YORK (AP) — A New York appeals court judge on Thursday paused a gag order that barred Donald Trump from commenting on court staffers in his civil fraud trial. In his decision, Judge David Friedman of the state’s intermediate appeals court cited constitutional concerns about restricting Trump’s free speech. He issued a stay of the gag order, allowing Trump to comment freely about court staff while a longer appeals process plays out. Trump’s lawyers filed a lawsuit against the trial judge, Arthur Engoron, late Wednesday challenging the gag order as an abuse of power. Trump's lawyers — who, separately, sought a mistrial Wednesday — contend that Engoron's orders are unconstitutionally suppressing free speech, and not just any free speech.

The state's highest court, the Court of Appeals, will hear arguments this week over whether to order a new map for 2024, as Democrats have asked, or to maintain the current map, as Republicans have argued. The new map was made possible by the state Supreme Court, after two conservative judges won election in 2022. The court's previous Democratic majority had thrown out a Republican map as an illegal gerrymander. UTAH: DEMOCRATS COULD GAIN ONE SEATThe state Supreme Court is weighing whether a Republican-drawn map that divided Democratic-leaning Salt Lake County into four districts violated the state constitution. Justice Department special counsel Jack Smith urged a federal judge charged with overseeing Donald Trump’s criminal election interference case in Washington that allowing the trial to be broadcast live on television would “create a carnival atmosphere” that the former president desires. HARRISBURG, Pa. (AP) — Pennsylvania voters will make a decision with implications for the future of voting and abortion rights in a presidential battleground state when they choose the winner in Tuesday's election for an open state Supreme Court seat. McCaffery is a former Philadelphia prosecutor and judge who sits on a statewide appellate court, the Superior Court. McCaffery positioned himself as a defender of abortion rights and other rights that he said Democrats had fought for but were under threat from the U.S. Supreme Court’s conservative majority. Democrats also made abortion rights a key avenue to attack Carluccio. Carluccio said a debate over abortion rights didn’t belong in the race since state law makes abortion legal through 24 weeks.

Ivanka Trump is set to testify on November 8 in a civil fraud trial against her family. Doing so would make her "suffer undue hardship" as she must travel from Florida to New York, he said. In the filing, Moskowitz wrote that Trump would "suffer undue hardship and irreparable harm" if a stay of the testimony order was not granted. Meanwhile, James filed a letter to the appellate court slamming Ivanka Trump's request for a stay in the testimony order, calling Moskowitz's principal arguments "utterly meritless."

CNN —Ivanka Trump on Friday withdrew her appeal of a judge’s order requiring her to testify at her father’s civil fraud trial next week after an appellate court refused to pause her testimony. Ivanka Trump’s testimony comes after she was previously dismissed as a co-defendant in the New York case against former President Donald Trump, two of his adult sons and his company. On Thursday night, an appeals court denied Ivanka Trump’s request to postpone her testimony until her lawyers could make arguments before the panel that she shouldn’t be required to appear. They represent the moral and philosophical foundations for the concrete constitutional rules of culture war that directly apply on campus. One of the most powerful and compelling arguments for free speech in American history was born out of mob suppression. In 1860, Frederick Douglass wrote his “Plea for Free Speech in Boston” after a violent mob shut down an antislavery event. Every college and university — public or private — that receives federal funds has an affirmative duty to protect students’ civil rights. In the recent past, schools have sometimes been too enthusiastic about stopping harassment, defining the term so broadly that university anti-harassment policies actually violate students’ free speech rights.

CNN —A higher court on Thursday denied Ivanka Trump’s request to postpone her upcoming testimony in her father’s civil fraud trial, shortly after she claimed she’d suffer “undue hardship” if forced to appear during a school week. With the appeal, Trump sought to block New York Judge Arthur Engoron’s previous order for her to testify until an appeal could be heard by the New York appellate court. The appeal also asked the court to pause the entire fraud trial against former President Donald Trump, two of his adult sons and his company until her appeal could be heard. Ivanka Trump’s two adult brothers – Donald Trump Jr. and Eric Trump, who both helped run the Trump Organization while their father was in the White House – made back-to-back appearances in court earlier Thursday. Engoron last week ordered Ivanka Trump to testify Wednesday in the trial, denying a motion from her attorney to quash a subpoena.

Former President Donald Trump faces a key week ahead, and yet again the drama won’t be on the campaign trail but in the courtroom as the GOP front-runner’s children prepare to testify before a judge. Ivanka Trump was initially listed as a co-defendant, but a New York appeals court dismissed that status, finding that the claims against her were too old. Chutkan had imposed a narrow gag order on Trump earlier this month, barring him from making public statements targeting prosecutors, court staff and potential witnesses. But she paused the gag order to allow Trump’s defense team time to argue why his speech should not be restricted. The ACLU has sided with Trump, arguing that the gag order is a violation of First Amendment free speech protections.

New York (CNN) — Ivanka Trump must testify at her father’s New York civil fraud trial, the judge overseeing the case ruled on Friday. Ivanka Trump’s attorney had argued that she should not be forced to appear after an appellate court removed her as a defendant in the case. Many housing advocates are also disappointed that Newsom vetoed a bill — AB 309 — to create "social housing" on government-owned land. Resnikoff, whose organization endorsed the effort, noted that the state's current fiscal conditions make it very hard to pass housing policy that requires funding. Advocates are quick to point out that California housing policy has impacts far beyond its borders. How effectively California deals with its housing affordability issues also directly impacts other states' housing markets. The migration of California residents to places from Texas to Oregon has put additional pressure on those states to provide even more housing.

ORLANDO, Fla. (AP) — A ruling prohibiting the enforcement of a new Florida law targeting drag shows will stay in place for the time being, according to a federal appeals court decision. Circuit Court of Appeals on Wednesday upheld a lower court's granting of a preliminary injunction stopping the law from being enforced until a trial is held in Orlando, Florida to determine its constitutionality. The law was challenged by the owner of a Hamburger Mary’s restaurant and bar in Orlando, which regularly hosts drag shows, including family-friendly performances on Sundays that children were invited to attend. The restaurant owner said the law was overbroad, was written vaguely and violated First Amendment rights by chilling speech. Venues that violated the law faced fines and the possibility for their liquor licenses to be suspended or revoked.
