In the filing, Moskowitz wrote that Trump would "suffer undue hardship and irreparable harm" if a stay of the testimony order was not granted. Meanwhile, James filed a letter to the appellate court slamming Ivanka Trump's request for a stay in the testimony order, calling Moskowitz's principal arguments "utterly meritless."

CNN —A higher court on Thursday denied Ivanka Trump’s request to postpone her upcoming testimony in her father’s civil fraud trial, shortly after she claimed she’d suffer “undue hardship” if forced to appear during a school week. With the appeal, Trump sought to block New York Judge Arthur Engoron’s previous order for her to testify until an appeal could be heard by the New York appellate court. The appeal also asked the court to pause the entire fraud trial against former President Donald Trump, two of his adult sons and his company until her appeal could be heard. Ivanka Trump’s two adult brothers – Donald Trump Jr. and Eric Trump, who both helped run the Trump Organization while their father was in the White House – made back-to-back appearances in court earlier Thursday. Engoron last week ordered Ivanka Trump to testify Wednesday in the trial, denying a motion from her attorney to quash a subpoena.

Ivanka Trump asked a New York appeals court to pause the $250 million fraud trial of her family and its business empire as she appeals a judge's order requiring her to testify in the case next week. New York Attorney General Letitia James urged the appeals court to reject that request, calling it a "drastic" and baseless move that "would upend an ongoing trial." Ivanka Trump was originally listed as a co-defendant as well, but she was removed earlier this year on statute of limitations grounds by a New York appeals court earlier. In Thursday's filing to the appeals court, Ivanka's attorney argued that she is "beyond the jurisdiction" of Engoron's court and that the judge made "multiple errors" when he declined to quash subpoenas for her testimony. Ivanka Trump "has firsthand knowledge of issues that are central to the ongoing trial," James wrote.

Eric Trump has continued to attend the trial since, paying close attention to testimony about spreadsheets filled with valuations and the fine print of insurance deals. Donald Trump's adult sons, Eric and Don Jr., both took the stand at his fraud trial on Thursday. Ivanka Trump and Donald Trump himself are scheduled to testify next week. Less than an hour after prosecutors wrapped up the first son's testimony, Eric Trump took the stand and insisted he, too, had nothing to do with the documents. In January 2017, just days before taking office, President-elect Donald J. Trump announced a couple of promotions. “My two sons — who are right here, Don and Eric — are going to be running the company,” he told a group of reporters. “They are going to be running it in a very professional manner.”Nearly seven years later, Mr. Trump’s sons are alongside him as defendants in a civil case that accuses them of a decades-long fraud. Eric Trump is expected to follow, and the former president and Ivanka Trump are likely to testify next week. The presence of Mr. Trump’s children at the trial underscores how, along with wealth and positions of influence, they inherited the legal troubles that have trailed their father for years.

Former President Donald Trump faces a key week ahead, and yet again the drama won’t be on the campaign trail but in the courtroom as the GOP front-runner’s children prepare to testify before a judge. Ivanka Trump was initially listed as a co-defendant, but a New York appeals court dismissed that status, finding that the claims against her were too old. Chutkan had imposed a narrow gag order on Trump earlier this month, barring him from making public statements targeting prosecutors, court staff and potential witnesses. But she paused the gag order to allow Trump’s defense team time to argue why his speech should not be restricted. The ACLU has sided with Trump, arguing that the gag order is a violation of First Amendment free speech protections.

On Friday, Trump's NY fraud-trial judge ruled Ivanka Trump must testify next week. Lawyers for the New York attorney general's office, who plan to call Ivanka Trump to the witness stand on Friday at their ongoing, $250 million Trump fraud trial, agree it was quite the deal. Her testimony at the non-jury trial could prove highly damaging to her father and two eldest brothers, Donald Trump, Jr., and Eric Trump – Trump Organization vice presidents who, like their father, are defendants in James' lawsuit. "Ivanka Trump tried to negotiate the number down to 2 billion," Wallace said in openings, "before agreeing to 2.5 billion." But during the same period, Donald Trump's net worth statements valued the exact same unit at $20.8 million.

New York (CNN) — Ivanka Trump must testify at her father’s New York civil fraud trial, the judge overseeing the case ruled on Friday. Ivanka Trump’s attorney had argued that she should not be forced to appear after an appellate court removed her as a defendant in the case. The judge also said Ivanka Trump should have submitted an affidavit asserting that she does not live or work in the state presently. Ivanka Trump was still identified by the New York attorney general’s office as a potential witness they could call in the case. Another Trump attorney, Cliff Robert, said Eric Trump is willing to be the corporate representative for the Trump Organization because he’s going to be testifying at trial anyway.

NEW YORK (AP) — Days after former President Donald Trump got a taste of the witness stand, his New York civil business fraud trial is turning to the question of whether his daughter Ivanka will have to testify, too. Ivanka Trump has been dismissed from the case, and lawyers for her family and its business contend that she shouldn't have to take the stand. It's unclear how soon Judge Arthur Engoron will decide, or when Ivanka Trump would testify if ordered to do so. Ivanka Trump's lawyer argued in court papers that it's unreasonable to make her take the stand. Ivanka Trump announced in January 2017, ahead of her father's inauguration, that she was stepping away from her Trump Organization job.

Donald Trump is set to testify Nov. 6 at his New York civil fraud trial, following his three eldest children to the witness stand in a case that threatens to disrupt their family's real estate empire, state lawyers said Friday. It was already expected that the former president and sons Donald Jr. and Eric would testify. The case could strip Trump of some of his corporate holdings and marquee properties such as Trump Tower. In a surprise preview, Donald Trump ended up briefly testifying Wednesday to answer Engoron's questions about whether an out-of-court comment was aimed at his law clerk.
