Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

WASHINGTON — The Supreme Court on Wednesday allowed the Biden administration at least in the short term to enforce its latest attempt to curb climate-harming carbon emissions from coal- and gas-fired power plants that contribute to climate change. The Supreme Court is often skeptical of major agency actions but it has bucked that reputation in recent weeks. Under the proposed rule, the EPA wants to require “carbon capture,” a technique that uses solvents to remove carbon dioxide from a power plant’s emissions. The appeals court in July declined to block the regulation, saying the major questions doctrine did not apply on this occasion. In court papers, the challengers sought to portray the new regulation as being essentially the same as the one the Supreme Court struck down.

CNN —Special counsel Jack Smith told a federal judge on Wednesday that the Supreme Court’s decision limiting some obstruction charges against those who stormed the US Capitol on January 6, 2021, should not apply to Donald Trump in the election subversion case against the former president. One primary reason the obstruction charge against Trump should stand, prosecutors argue, is that – unlike in the case involving a rioter that was before the Supreme Court – Trump is directly accused of creating false evidence though the plot to insert fake electors in the certification process. Trump is arguing the ruling should result in Judge Tanya Chutkan throwing out the case against him. “The defendant’s supplement ignores entirely that the superseding indictment includes allegations that involve the creation of false evidence,” prosecutors wrote Wednesday, namely, “the fraudulent electoral certificates.”Smith also urged the judge to ignore Trump’s claims of presidential immunity, calling them “deeply flawed” and “irrelevant” to the issue at hand and should wait to be argued in separate filings. Sean "Diddy" Combs wants to go to trial on sex trafficking charges next spring, the embattled hip-hop mogul's lawyers informed a judge Wednesday. "Mr. Combs continues to assert his right to a speedy trial and intends to request a trial date in April or May 2025, and as consistent with the Court’s trial schedule," the jailed rapper's lawyers wrote. Combs was charged last month with sex trafficking, racketeering and transportation to engage in prostitution in a sweeping indictment by the Southern District of New York. Combs' preference was mentioned in a joint letter from his lawyers and prosecutors. In the joint letter, U.S. government prosecutors said they have started submitting to defense lawyers some of the "voluminous" evidence in the case, including "several terabytes of electronic material" regarding Combs.

Roberts was shaken by the adverse public reaction to his decision affording Trump substantial immunity from criminal prosecution. By contrast, the modern day Democrats’ historic success at winning the popular vote hasn’t translated into nearly as much governing power for them. Over this record run of popular vote success, Democrats have already twice lost the Electoral College – and thus the White House – while winning more votes. Amazingly, Republicans won unified control of government in two elections when Democrats won a plurality of the national presidential vote: 2000 and 2016. CNN —The Supreme Court on Tuesday signaled a willingness to uphold a Biden administration regulation on “ghost guns,” mail-order kits that allow people to build untraceable weapons at home and that are turning up at crime scenes with greater frequency. The difference here, she said, is that the ghost guns are marketed to be built into guns and serve no other conceivable purpose. President Joe Biden’s administration told the court in briefing that police departments have faced an “explosion of crimes involving ghost guns” in recent years. In 2017, police submitted about 1,600 ghost guns recovered at crime scenes for tracing. After that decision, a lower court stepped in to block the regulations as applied to two manufacturers.

The Georgia Supreme Court on Monday reinstated the state’s six-week abortion ban while it reviews an appeal from the state of a lower court ruling that had struck down the law. The state Supreme Court's decision, however, left in place the lower court’s ruling blocking a separate provision of the law that had given state prosecutors broad access to the medical records of abortion patients without due process protections. The state's near-total abortion ban, known as the LIFE Act, was signed by Republican Gov. Brian Kemp in 2019 but didn’t take effect until July 2022, after it faced a legal challenge and the U.S. Supreme Court’s reversal of Roe v. Wade. Last week, a judge in Fulton County, Georgia, struck down the state’s six-week abortion, allowing the procedure to resume and almost immediately making it legal up to 22 weeks of pregnancy.

WASHINGTON — The Supreme Court on Monday rejected an appeal brought by X, Elon Musk's social media company, declining to decide whether prosecutors should have been able to obtain data from former President Donald Trump's Twitter account without him being notified. The case arose as part of special counsel Jack Smith’s investigation into Trump over alleged election interference in 2020, which the Supreme Court stymied earlier this year by ruling that presidents have broad immunity from prosecution for official acts taken in office. Smith has already obtained the data at issue in the appeal brought by X, as Twitter is now known following Musk’s takeover of the social media company. A federal judge approved the warrant, as well as a nondisclosure order that prevents X from telling Trump or anyone else about it. During the litigation, Smith agreed that Trump could be notified about the warrant.

WASHINGTON — The Supreme Court on Monday turned away a Biden administration appeal in a dispute over emergency room abortion care in Texas, leaving in place a lower court victory for the Republican-led state. Circuit Court of Appeals in favor of Texas on the question of whether a federal law concerning emergency room care in some cases trumps state abortion restrictions. In the meantime, a lower court ruling that allows emergency room doctors to perform abortion in some situations remains in place. The administration appealed to the Supreme Court, but asked the justices to hold the case until it decided the Idaho dispute. Over the summer, Solicitor General Elizabeth Prelogar urged the court to throw out the appeals court ruling so that new developments could be considered afresh.
