Here’s what you need to know for the high-stakes hearing:What does the 14th Amendment say? The 14th Amendment says Americans who take an oath to uphold the Constitution but then “engaged in insurrection” are disqualified from holding future public office. A liberal-leaning watchdog group called CREW filed the lawsuit in September in Colorado state court. The US Supreme Court is reviewing a decision from the Colorado Supreme Court, which said in a landmark 4-3 ruling in December that the “insurrectionist ban” applies to Trump. It would be unprecedented to apply the 14th Amendment “insurrectionist ban” to a presidential candidate.

The appeals court has set up a very fast schedule for Donald Trump to appeal their ruling rejecting his claims of immunity from criminal prosecution. The court is giving Trump until February 12 to file an emergency stay request with the Supreme Court, which would stop the clock while his attorneys craft a more substantive appeal on the merits. If he is successful with that, the criminal trial will not resume until after the high court decides what to do with his request for a pause. If Trump does not appeal the ruling, the case would be sent back to the trial-level court in Washington, DC, as soon as next week for his trial to continue. Special counsel Jack Smith’s office declined to comment.

Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. The cases are entirely separate – this is a criminal prosecution against Trump, and the upcoming Supreme Court case is a civil attempt to remove Trump from state ballots. Further, the appeals court’s findings and explanations in Tuesday’s ruling are not binding on the Supreme Court.

But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court and result in further delays. The judges gave Trump until February 12 to ask the Supreme Court to pause the ruling. The appeals court took center stage in the immunity dispute after the Supreme Court in December said it was at least temporarily staying out of it, rejecting a request from Smith's team to take up the matter quickly and issue a speedy ruling. But the court could yet still decide to act on a Trump team appeal, adding to the uncertainty of a trial date. The high court declined the request, leaving the matter with the appeals court.

In New Hampshire, more than 4-in-5 Haley voters said Trump would not be fit to serve again if convicted and that Biden had legitimately won. In that poll, two-thirds of Haley voters in Iowa said they would not vote for Trump in a general election; that number soared past three-fourths of her voters in New Hampshire. One key reason: fully 93% of all GOP-leaning voters said they disapproved of Biden’s performance as president. Madrid believes Biden’s record on immigration is the biggest obstacle to him harvesting support among the Republicans uneasy about Trump. Lake doesn’t agree that any single issue is critical for Biden with the kind of GOP voters who have rallied to Haley.

With the 2024 presidential campaign shaping up as a likely rematch between Biden and Trump, immigration has moved to the forefront as one of the president's biggest potential liabilities. “If that bill were the law today, I’d shut down the border right now and fix it quickly,” Biden said last weekend. WASHINGTON (AP) — Former President Donald Trump's political operation amassed about $130 million in the final months of last year but after spending heavily, headed into 2024 with more than $42 million to start the election year. New campaign finance reports filed Wednesday showed that across four committees that make up Trump's political operation, he ended 2023 having spent about $86 million, with tens of millions of that being diverted to pay legal expenses. Trump's main campaign committee closed out the year with about $33 million. That includes fundraising numbers for the Democratic National Committee, which partners with the incumbent president. For example, Biden, through a joint agreement with the Democratic National Committee, can collect checks from individual donors worth almost as much as $1 million, far greater sums through a joint operation with the Democratic National Committee.

CNN —The Colorado voters trying to disqualify Donald Trump from the state ballot told the Supreme Court on Friday that the violence the former president provoked on January 6, 2021, qualifies as an insurrection under the terms of the Constitution and bars him from holding future office. In the early pages of their 60-page filing, they also countered Trump lawyers’ warning of the “bedlam” that could follow if the justices were to allow states to block his name from upcoming primary ballots. The voters’ lawyers wrote that the mob “infiltrated the (US Capitol) building through shattered windows” and “erected gallows” outside, while chanting “Hang Mike Pence.” They noted that video of the day was on file at the court. The Supreme Court agreed earlier this month to hear the case of Trump v. Anderson, accepting the former president’s appeal of the Colorado Supreme Court decision that removed him from that state’s ballot. The Colorado trial judge disagreed, and her findings were upheld by Colorado’s high court, which concluded that he “intended that his speech would result in the use of violence.”

CNN —Democrats should not make the mistake of underestimating former President Donald Trump. Moreover, they note, Haley was able to win independent voters who theoretically would be more amenable to President Joe Biden than Trump in the fall. Moreover, the number of Republicans who keep saying they won’t vote for Trump under any circumstances, gives Democrats hope that on Election Day, many voters in the GOP won’t turn out. But these arguments downplay the threat Trump will pose to Biden in November by ignoring several fundamentals. PORTLAND, Maine (AP) — A Maine judge on Wednesday paused an election official’s decision on former President Donald Trump’s ballot status to allow time for the U.S. Supreme Court to rule on a similar case in Colorado. Two-thirds of Republican voters don’t think President Joe Biden’s 2020 victory was legitimate, despite all evidence to the contrary. Iowa caucusgoers, unlike most of the country, overwhelmingly support banning most or all abortions nationwide. Iowa voters could be asked on the general election ballot to make clear there is no right to abortion guaranteed in their state’s constitution. While Trump held a commanding lead among Iowa caucusgoers without college degrees, college graduates were more closely divided among Trump, former South Carolina Gov. But she made clear this week that she would ultimately support Trump if he’s the nominee.

First, he believes going after the signature achievement of President Obama plays well with his base. But there’s another, deeply unsettling possible motive: A racial component may be at play in Trump’s attacks on the legacy of the first Black president.
