The ruling comes in a lawsuit by Democrats that originally sought $2.4 million in damages from all 10 Republicans who submitted a document to Congress falsely declaring Trump as the 2020 election winner in Wisconsin. But Dane County Circuit Judge Frank Remington said they can be questioned, although he put limitations on the Evers interview. The fake elector plan hatched in seven battleground states was central to the federal indictment filed against Trump earlier in August that alleged he tried to overturn results of the 2020 election. Trump's attorney Chesebro, who is a defendant in the Wisconsin lawsuit, pleaded guilty to a felony charge of conspiracy to commit filing false documents after being charged with participating in efforts to overturn Trump’s loss in Georgia. Trump has continued to spread falsehoods about the 2020 election.

The defense’s questions were effectively pre-cleared by the judge, as Trump was not allowed to re-litigate the verdict from last year. Trump attorney Alina Habba first asked her client whether he stood by his testimony in a previous deposition denying Carroll’s allegations. Habba then asked, “Did you deny the allegation because Ms. Carroll made an accusation.”“That’s exactly right, yes I did.” Trump replied. Habba asked Martin whether she felt that Carroll enjoyed the attention that came with her lawsuits against Trump. In the first trial, Martin said she was having issues with Carroll at the time she sent the messages and later felt bad about it.

CNN —Donald Trump’s attorneys are joining calls for the dismissal of Fulton County District Attorney Fani Willis in the 2020 election subversion case against the former president and his co-defendants in Georgia, pointing to alleged misconduct between Willis and her lead prosecutor. The filing also points to public comments Willis recently made defending her choice to select the lead prosecutor, Nathan Wade, arguing that she violated Georgia rules for prosecutors. In comments Willis made at Atlanta’s Big Bethel A.M.E. Church earlier this month, the DA defended her team of prosecutors in the case, calling into question why only one of the three prosecutors was being attacked. The district attorney’s office declined to comment on the latest filing. Trump’s attorneys claim that Willis made a “calculated effort to foment racial bias” against the defendants with her comments, which run the risk of prejudicing the public and prospective jurors.

The testy clashes have come to be expected as Trump's lawyers carry into the courtroom the bombastic, and often antagonistic, style that defines his campaign trail demeanor. There's no doubt that the lawyers, with some exceptions, have struggled to score major points with judges and in fact have often provoked their ire. Both cases have been defined by contentious exchanges between judges and Trump and his lawyers. In November, for instance, they pushed unsuccessfully for a mistrial in the fraud case, accusing Judge Arthur Engoron of “tangible and overwhelming” bias. Chutkan has repeatedly admonished Trump’s lawyers for political arguments, once telling attorney John Lauro during debate over whether restrictions could be placed on Trump's speech that though she knew he had a “message” to convey, she didn't want campaign rhetoric in court.

Carroll is due to testify Wednesday in the second federal civil trial over her claims against Trump, who denies them all. ATLANTA (AP) — Fulton County District Attorney Fani Willis on Sunday defended the qualifications of a special prosecutor she hired for her case against Donald Trump and others over efforts to overturn the 2020 election in Georgia after a defense lawyer accused Willis of professional impropriety. At the church, Willis did not address the allegations of an improper relationship. They are paid the same hourly rate and no one has questioned the qualifications of the two white lawyers, she said. Merchant's filing offered no proof of the alleged relationship or trips that she said that Willis and Wade had taken together. Pete Skandalakis, a former district attorney who is executive director of the Prosecuting Attorneys’ Council, said district attorneys do not have to seek permission before hiring a special prosecutor.

NEW YORK (AP) — Former President Donald Trump can wait a week to testify at a New York defamation trial where he could face millions of dollars in damages after a jury concluded that he sexually abused a columnist in the 1990s, a federal judge said Sunday. The judge also noted that he has learned that Trump, even while seeking to postpone the trial, had scheduled an evening campaign appearance on Wednesday in Portsmouth, New Hampshire. He said Trump's lawyers notified the judge on Friday that Trump planned to attend the trial. This month's trial, long delayed by appeals, stems from defamatory comments the judge said Trump made about Carroll in 2019 and last May, a day after the jury announced its verdict. Habba said Trump also can testify about the circumstances of his comments and how they related to comments in Carroll’s "continuous parade of interviews and publicity."

Fulton County DA Fani Willis was accused of having an "improper" relationship with a prosecutor. Willis appointed the prosecutor, Nathan Wade, to oversee the RICO case against Trump. The motion seeks to dismiss the indictment and disqualify Willis and Wade and their offices from further prosecuting the case. Willis said she hired three special prosecutors for the election case: a white man, a white woman, and a Black man. If Willis financially benefited from her relationship with Wade, that may be an ethics violation," he said.

As a sophisticated international lender, the bank did its own risk analysis, apart from Trump's net-worth statements, the defense has argued. New York CNN —Former President Donald Trump is abandoning his effort to move the so-called hush money trial from New York state court to federal court. In a brief filing submitted to a New York-based appeals court, Trump said he was no longer appealing a lower-court ruling that rejected his bid to get the case transferred to federal court. Trump has pleaded not guilty to 34 counts of falsifying business records to conceal the reimbursement of hush money payments made to adult film star Stormy Daniels. In July, US District Judge Alvin Hellerstein denied Trump’s request to move the New York case to federal court, ruling that the payments to Daniels and alleged subsequent falsification of business records were not related to Trump’s presidential duties. Hush money paid to an adult film star is not related to a President’s official acts,” the judge wrote.

Trump’s defense lawyers, in a flurry of legal motions, have argued that the case by Special Counsel Jack Smith "attempts to criminalize core political speech and political advocacy." At trial, legal experts say Trump will likely not be allowed to argue to a jury that his conduct was protected by his First Amendment right to free speech because such legal questions are resolved by the judge. Those claims complement his political case as an anti-establishment crusader whose movement is opposed by powerful foes seeking to silence him. Criminal defendants can use the defense to argue they sought legal opinions and did not intend to break the law. Three former Trump lawyers have already pleaded guilty in Georgia, including Kenneth Chesebro, who drafted memos crafting the fake elector scheme.

The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s attacks in a vacuum weren’t particularly remarkable – he’s used the same barbs throughout the course of the trial, which he’s attended repeatedly as a spectator. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.
