Special Counsel Robert Hur's report says some unflattering things about Biden's memory. Voters will have a binary choice to make, and plenty of them are still ready to reject Trump again. download the app Email address Sign up By clicking “Sign Up”, you accept our Terms of Service and Privacy Policy . Yet that same poll shows former President Donald Trump leading Biden by 47% to 42% — not a good result for Biden, but not unsalvageable. Biden Not Charged by Special Counsel for Mishandling Documents

Special Counsel Robert Hur said he opted against bringing criminal charges after a 15-month investigation because Biden cooperated and would likely be difficult to convict. Hur's conclusion ensures that Biden, unlike his expected 2024 presidential rival Donald Trump, will not risk prison time for mishandling sensitive government documents. Biden has also sought to draw a contrast with Trump on issues of personal ethics and national security. Trump has described the four criminal prosecutions he faces — including one for his handling of classified documents — as politically motivated. The White House said Biden's attorneys found a small number of classified documents and turned them over after discovery.

But he always believed history would prove him right," Hur wrote in his nearly 400-page report. Ultimately, President Obama sent 30,000 more troops that left the country by 2012. According to Hur, Biden kept "a classified handwritten memo he sent President Obama over the 2009 Thanksgiving holiday, and related marked classified documents." The special counsel report found that Biden willfully retained classified information, including top secret documents, and knew he was in possession of some documents as far back as 2017. House Oversight Committee Republicans, who have separately investigated Biden’s handling of classified documents, criticized Hur’s report before it was even released or delivered to Congress. “Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” Hur wrote. “Among the places Mr. Biden’s lawyers found classified documents in the garage was a damaged, opened box containing numerous hanging folders, file folders, and binders,” the report said. The photos included in Trump’s charging documents showed how he allegedly stored classified documents in various places at his Mar-a-Lago estate, including a ballroom, bathroom shower and his bedroom.

Perhaps the biggest takeaway from Special Counsel Robert Hur's report is that President Joe Biden is struggling with memory issues. Hur's report, while not recommending any criminal charges over Biden's handling of classified documents, included seemingly grave warnings about the president's mental acuity. During a portion dealing with classified documents pertaining to Afghanistan, the report noted that the 81-year-old president "would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory." Washington CNN —Special counsel Robert Hur released a searing report Thursday that concluded President Joe Biden willfully retained and disclosed classified military and national security information but recommended he not face charges after a yearlong investigation into his handling of classified documents. According to the report, Biden – during the 2023 interview – did not remember when his son Beau died nor the years he was vice president. "My memory has not gotten worse," Biden told reporters in a nationally televised address at the White House hours after Hur released his report. But moments later, Biden referred to Egypt's president as the "president of Mexico." "How in the hell dare he raise that," Biden said of Hur. The main legal takeaway from Hur's report was the special counsel's decision not to criminally charge Biden despite what Hur said was the president's willful retention of classified documents and disclosure of of some classified material to the ghostwriter of his 2017 memoir. Biden said, "I've seen the headlines since the report was released about my willful retention of documents.

By Kanishka SinghWASHINGTON (Reuters) - Robert Hur, the special counsel appointed to investigate whether President Joe Biden improperly handled sensitive government documents, is a former high-ranking Justice Department official with experience in prosecuting sensitive leak investigations. On Thursday, he concluded that probe and found that Biden retained classified materials about Afghanistan after leaving the vice presidency in 2017 but said he will not be criminally charged. Hur was appointed by Donald Trump in 2018 as the chief federal law enforcement officer in Maryland and left that position in early 2021. Under Hur, the Maryland U.S. attorney's office prosecuted the case of former National Security Agency contractor Harold Martin, who stole huge amounts of classified material from U.S. intelligence agencies. A graduate of Stanford Law School and Harvard College, Hur served as top aide to then-Deputy Attorney General Rod Rosenstein before his appointment as the U.S. attorney in Maryland.

An independent special counsel poured kerosene on concerns about Joe Biden’s age with pointed language about the president’s poor memory after concluding Biden had willfully mishandled classified documents – and that his failing memory makes him impossible to convict. ► He appears poised for a win at the Supreme Court. Feeding the frenzy about Biden’s ageIn concluding Biden should not be prosecuted, Special Counsel Robert Hur, a former Trump-appointed US Attorney in Maryland, offered a political indictment of the president’s fitness. Still, larger Trump-related questions loom for the Supreme Court, such as whether Trump enjoys absolute immunity from prosecution. "There's some attention paid to some language in the report about my recollection of events," Biden said in a hastily called news conference at the White House. How in the hell dare he raise that?” Biden said, turning emotional as he often does when he speaks of Beau Biden, who died of a brian tumor in 2015. The report said Biden would not be charged, noting there was not sufficient evidence to prove he had willfully intended to retain the documents. The report was written by special counsel Robert Hur, a Trump appointee brought in by Attorney General Merrick Garland to investigate Biden in this case. Before the unredacted report was released, Biden lawyer Robert Bauer sent a scathing letter to Hur on the personal comments about Biden.

Two verbal slip-ups in the last few days are again bringing the concerns about the president’s cognition to the forefront. A January NBC poll of 1,000 registered voters found that three quarters of all voters, including half of Democrats, had concerns about Biden’s physical or mental health. The White House did not immediately provide a response to this story. In last year’s physical, Biden’s physician said an “extremely detailed” neurologic exam found no findings that would be consistent with stroke, multiple sclerosis or Parkinson’s disease. As with his previous physical in 2021, the White House did not say whether Biden underwent any cognitive tests, which some doctors recommend for older adults.

CNN —A probe that spared President Joe Biden from criminal charges paradoxically dealt him a threatening political blow. The president’s defenders often get frustrated when the political conversation is dominated by Biden’s age – rather than Trump’s repeated challenges to the rule of law. In another CNN poll last week, 46% of Democrats were concerned about Biden’s age. Hur’s report rebuked Biden for willfully retaining classified information, including top secret documents after he left the vice presidency. North Carolina Republican Sen. Thom Tillis was kinder but his comments over Biden’s age were also cutting.

The special counsel investigating President Biden’s handling of classified material after leaving the vice presidency in 2017 concluded in a report released today that “no criminal charges are warranted.”Robert Hur, the special counsel, found that Biden had “willfully” retained and disclosed some sensitive material, including notebooks with entries “implicating sensitive intelligence sources and methods.” Hur criticized the president for sharing some of the classified information with a ghostwriter, but added that the evidence “does not establish Mr. Biden’s guilt beyond a reasonable doubt.”For Biden, Hur’s decision not to prosecute was a long-awaited legal exoneration, but the special counsel’s report still turned out to be a political nightmare. In passages explaining his reasons not to pursue a trial, Hur said that Biden had presented himself as a “well-meaning, elderly man with a poor memory” and described interviews in which Biden could not recall when he served as vice president or what year his son Beau Biden died. A lawyer for Biden criticized parts of the report as “inaccurate and inappropriate.” In a statement, Biden appeared to suggest that his memory lapses were hiccups during five hours of interviews held in the days after Israel was attacked. But Hur’s comments resurfaced widespread worries about the president’s age.

WASHINGTON (AP) — Special Counsel Robert Hur on Thursday released his long-awaited report on President Joe Biden's handling of classified documents, concluding that Biden had “willfully” retained and disclosed highly classified materials when he was a private citizen. The special counsel report will hardly be helpful to Biden on that count. Biden’s memory was significantly limited” in interviews with the special counsel office as well as with a ghostwriter that Biden worked with. In his interview with the special counsel’s office, Hur writes, Biden twice appeared confused about when his term as vice president ended. Still, Trump can now cite special counsel Robert Hur’s finding that Biden retained and disclosed highly classified materials.

President Joe Biden "willfully retained and disclosed classified materials after his vice presidency," according to a special counsel's final report released Thursday. But the special counsel, Robert Hur, said he was declining to prosecute Biden over his handling of classified documents about military and foreign policy in Afghanistan, and other material. "Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen," Hur wrote. "We conclude that no criminal charges are warranted in this matter," the report said. WASHINGTON (AP) — The Justice Department special counsel investigating President Joe Biden's handling of classified documents has completed his inquiry and a report is expected to be made public soon, Attorney General Merrick Garland told lawmakers in a letter Wednesday. Garland did not detail the conclusions of the report from special counsel Robert Hur, but did say that he was committed to disclosing as much of it as possible once the White House completes a review of the document for potential executive privilege concerns.

U.S. President Joe Biden takes questions from reporters on classified documents as he delivers remarks on the economy and inflation in the Eisenhower Executive Office Building in Washington, D.C., on Jan. 12, 2023. Neither President Joe Biden nor anyone else is expected to be criminally charged in an investigation into how classified documents ended up in Biden's Delaware home and a private office, NBC News reported Tuesday. A senior law enforcement official told NBC that a report on that probe by Department of Justice special counsel Robert Hur will be made public in the coming days. By law, such documents should have been sent to the National Archives after Biden ceased being vice president in early 2017. The White House declined to comment when contacted by NBC News, as did a spokesman for the president's personal attorney Bob Bauer.

Since his appointment in January, Special Counsel Robert Hur has interviewed roughly 100 of Biden’s aides, colleagues and family members, including his son, Hunter, culminating in a two-day interview with the president last month.

There has been no public indication that he or anyone else in his orbit intentionally mishandled classified documents. And Republican front-runner Donald Trump, indicted by a different Justice Department special counsel over his own mishandling of classified documents, has repeatedly claimed Biden has received special treatment. Ian Sams, a spokesperson for the White House counsel’s office, said in a statement that the interview with Biden was voluntary.
