WASHINGTON — Rep. Nancy Mace, R-S.C., said Tuesday that her effort to ban transgender women from using female bathrooms at the U.S. Capitol is a direct response to the election of Sarah McBride, who is set to be the first openly transgender person in Congress. Mace introduced a resolution Monday to prohibit any lawmakers and House employees from “using single-sex facilities other than those corresponding to their biological sex." She was asked by reporters Tuesday if the move was in response to McBride. Mace said she would like to see her resolution incorporated into the House Rules package for the next Congress. House Speaker Mike Johnson, R-La., said Tuesday that Republicans are trying to resolve the issue but that they will make accommodations for McBride.

WASHINGTON — The administrator of the Federal Emergency Management Agency, Deanne Criswell, is set to face questions from House lawmakers on Tuesday about the federal government's response to Hurricanes Helene and Milton that caused catastrophic damage in the Southeast. “And FEMA leadership didn’t take action against this supervisor until the press exposed this discrimination," his remarks say. Florida Attorney General Ashley Moody filed a lawsuit against Criswell and Washington last week over the incident. More than 220 people died from Hurricane Helene in late September, which hit Florida, Georgia, Tennessee, Virginia, North Carolina and South Carolina. Nebraska’s Dan Osborn is returning to work Tuesday as a steamfitter after his unsuccessful Senate run, but his political career isn’t over. Osborn, who ran as an independent, is launching a political action committee, called the Working Class Heroes Fund, to support working-class candidates of all parties. And he isn’t ruling out another run for office after his loss to GOP Sen. Deb Fischer. Osborn said his PAC will support candidates of any party, and he said he didn’t expect to have many policy litmus tests, apart from supporting campaign finance overhaul and rejecting corporate donations. His Senate campaign raised $7.9 million through mid-October, according to the latest campaign finance reports, and he said it ultimately raised more than $14 million.

The Pennsylvania Supreme Court on Monday ordered election officials in the state to stop counting mail-in ballots marked with the wrong date or missing dates from their outer envelopes. The court order specifies that Bucks, Montgomery and Philadelphia counties, where Republicans argue that officials have opted to count mail-in ballots with errors on their outer envelopes, must adhere to the high court's earlier rulings, which said undated or misdated mail-in ballots should not be counted. “David McCormick and the national Republicans are working to throw out provisional ballots cast by eligible Pennsylvania voters and accepted by county boards. McCormick leads Casey by 17,408 votes with 99.7% of the vote in and 24,000 ballots still to be counted. WASHINGTON — Rep. Nancy Mace, R-S.C., introduced a resolution Monday that would ban transgender women from using female bathrooms in the Capitol just weeks before Democratic Rep.-elect Sarah McBride of Delaware is set to become the first out transgender member of Congress. McBride, who won the race for Delaware’s lone House seat this month, slammed the measure Monday. Mace said Monday that she plans to reintroduce the measure in the next Congress, when Republicans will retain control of the House. In the days following President-elect Donald Trump’s victory, some Democrats blamed their party’s position on transgender rights as contributing to Vice President Kamala Harris’ defeat. Those Democratic lawmakers said the party went too far and pandered to what they called "the far left" while trying not to offend anyone.

A small handful of Republican senators would be needed to defect in order to block Gaetz’s nomination when the party controls the Senate majority next year. GOP senators could pay a price for a prolonged confirmation fightIf Trump sticks with his pick, Republican senators feeling the MAGA movement’s pressure could be forced to defend Gaetz for weeks. CNN —Two women who claim they were paid for sex by former Rep. Matt Gaetz provided House ethics investigators with “numerous” photos related to time they spent with the Florida Republican, a lawyer for the women said Tuesday, including from an alleged 2019 trip to New York. The women additionally provided the House Ethics Committee with selfies Gaetz is said to have sent them, according to their lawyer. They also testified that they sent nude photos to Gaetz, sometimes at his request, Leppard said. Leppard’s account of the testimony provides more insight into the evidence the House committee collected in its probe, which was conducted in addition to a criminal investigation by the Justice Department. “What I’m telling you is just a fraction of the evidence that’s available, of the thousands of documents” the House obtained, Leppard said.

President-elect Donald Trump on Tuesday pushed his fellow Republicans in the Senate to stop Democrats from confirming any more of President Joe Biden's judicial nominees. The Senate has confirmed 216 of Biden's nominees to the federal judiciary. Biden has put forward 261 total judicial nominees, the White House said in a Nov. 8 press release announcing his 56th round of hopefuls. Incoming Senate Majority Leader John Thune, R-S.D., told ABC News he would continue to bog down the nomination process. "I was on the Senate floor until almost midnight last night voting to confirm President Biden's judicial nominees," Sen. Patty Murray, D-Wash., wrote on X.

But even with Trump’s gains among men, women still had greater leverage to decide the election’s outcome. Both the exit polls and VoteCast showed her winning 57% of white women with at least a four-year college degree. Solid majorities of Black, Latina and college-educated White women described Trump in the exit poll as “too extreme,” as did over two-fifths of the White women without a college degree. But among the White women without a college degree who described Trump as “too extreme,” almost 1 in 5 voted for him anyway. Though many women are expressing unease about mass deportation, Trump’s claim that immigrants are driving crime may provide him considerable leeway to pursue his agenda, particularly among the blue-collar White women who proved most receptive to that argument.

And Gaetz himself has been making calls to GOP senators and visiting his own loyalists in the House GOP. The pressure is all building ahead of a planned Wednesday meeting of the House ethics panel, which is expected to discuss the fate of the report. But privately, Republicans on the panel are signaling that they could bury the report as Gaetz and Trump are making direct appeals. In a call last week to GOP Sen. Josh Hawley, Gaetz urged him “to give him a shot,” Hawley told CNN. Meanwhile, nearly 100 House Democrats are calling on the House Ethics Committee to “immediately” release the report.

Congressional lawmakers will soon debate expiring tax breaks and new promises from President-elect Donald Trump. With a majority in the House of Representatives and Senate, Republican lawmakers can pass sweeping tax legislation through "reconciliation," which bypasses the Senate filibuster. But choosing priorities could be difficult, particularly amid the federal budget deficit, policy experts said Tuesday at a Brookings Institution event in Washington. Legislators will be "representing their districts, not their party," Howard Gleckman, a senior fellow at the Urban-Brookings Tax Policy Center, said Tuesday in a panel discussion at the Brookings event.

In the last Congress, Democrats repeatedly helped Republicans keep the government open and propped up Speaker Mike Johnson when he faced a challenge to his leadership post. He even tapped other senior House Democrats to echo his message to the Biden team, according to another person familiar with the efforts. Still, unlike some in his party, Jeffries is not in despair, according to multiple people familiar with his thinking. But Democrats say Jeffries — alongside Senate Majority Leader Chuck Schumer, who will serve as minority leader in the next Congress — might be the best person to at least try. But the decline in support for Ms. Harris in some of the country’s most liberal areas is particularly notable. For example, in Fulton County, which contains most of Atlanta, Ms. Harris gained about 4,500 votes, but Mr. Trump gained more than 7,400. He similarly outran Ms. Harris where she made gains in Wake County, N.C., Lancaster County, Pa., and Montgomery County, Texas. In Milwaukee County in swing-state Wisconsin, Ms. Harris lost 1,200 voters compared with Mr. Biden’s total in 2020, while Mr. Trump gained more than 3,500. In today’s edition, national political reporter Ben Kamisar examines how House Republicans are growing increasingly aligned with Donald Trump. “One of the main takeaways from this cycle is that the Democratic Party has a lot of work to do on how we’re reaching voters,” Democratic strategist Christina Freundlich said. It’s one more thing a narrow House Republican majority will have to work through early next year. The remaining House Republicans are going to have to summon a different level of unity than they have managed recently to move the party’s legislative agenda. Martin O’Malley, a onetime presidential candidate, announced he’d enter the race for Democratic Party chair, but many more names are already circulating.

Vice President Kamala Harris and Democrats convinced frequent voters and highly engaged voters to stick with them in the 2024 presidential election. “One of the main takeaways from this cycle is that the Democratic Party has a lot of work to do on how we’re reaching voters,” Democratic strategist Christina Freundlich said. 'We simply stopped communicating to many voters'Democrats overperforming with highly engaged voters — but struggling with less-engaged voters — reflects America’s political realignment over the past decade, as Democrats have made gains among college-educated and more frequent voters, while Republicans have won over more working-class and less-frequent voters. Media consumption also underscores the political split between highly engaged voters and less-engaged ones. Schale, the Democratic strategist from Florida, argues that Democrats “simply stopped communicating” with huge swaths of voters.

WASHINGTON — Congress faces a Dec. 20 deadline to fund the government and avert a shutdown, and Speaker Mike Johnson says House Republicans will probably push the fight into early 2025 rather than reach a full-year funding deal this year. And then then we should be actually working on the next year’s appropriations.”But even if they push the fight to early 2025, Republicans won’t have full control over spending decisions. Government funding legislation is subject to the 60-vote threshold in the Senate, which top Republicans have promised to preserve. That means they’ll have to reach a deal with Democrats, who currently control the Senate and want to pass full-year funding this year, not in 2025. “The bottom line is we’ve got to control spending and not allow there to be a runaway spending bill in December,” he said.

CNN —“Impoundment” is another word that Americans may need to learn in the vernacular of President-elect Donald Trump’s second term. Trump took the time to record a video about impoundment during the Republican primary season, and he promised seizing control over spending from Congress would be a top priority if he was elected. Impoundment occurs when Congress appropriates money that the president then declines to spend. As a result of these standoffs, Congress passed a law to curtail a president’s use of impoundment, particularly for policy reasons. The Impoundment Control Act of 1974 did a lot more than that, however.
