Hollywood producers are taking their latest contract proposal public as talks between the studios and writers union remain heated. The Alliance of Motion Picture and Television Producers overnight publicly revealed the latest proposal, which they delivered to the writers on Aug. 11. The offer addresses residuals and compensation, artificial intelligence, and increased transparency regarding the streaming business — the top issues for the writers. Still, the negotiations appear far from over: Soon after the proposal was made public, the writers union released its latest update and said the parties have engaged in further discussions since the Aug. 11 offer. The union said the studios' latest offer still includes "limitations and loopholes and omissions" that fail to protect Hollywood writers.

On Thursday, a bankruptcy judge approved Diamond's request to bring in mediators as it is negotiates with creditors to reach a reorganization plan. Two judges from the U.S. Bankruptcy Court in the Southern District of Texas — Judges David Jones and Marvin Isgur — will preside as mediators. Last week, Diamond won court approval to extend the period of time it has to come up with a reorganization plan. Diamond has until Sept. 30 to file a reorganization plan, weeks ahead of the opening of the 2023-24 NBA and NHL seasons. Besides shedding its hefty debt load, Diamond is looking to reset some of its rights deals with teams to reflect so-called market rates.

The decline of traditional TV continues, even as the prices of streaming services rise. Total traditional TV usage — comprised of broadcast and pay-TV — dropped below 50% in July for the first time ever, according to Nielsen's monthly streaming report, The Gauge. Usage among pay-TV customers fell to 29.6% of TV, while broadcast dropped to a 20% share during the month. Many consumers left the traditional TV bundle due to its steep prices. Lackluster streaming subscriber growth hasn't helped much in their bid for profitability, Macquarie noted in its report.

Fox Corp. Chief Legal and Policy Officer Viet Dinh will step down from his post, months after the company agreed to pay a $787.5 million settlement to Dominion Voting Systems. The departure comes after Dinh advised the company through the lawsuit with the voting machines company, which was halted just short of a trial with the April settlement. It's clear to the four major U.S. professional sports leagues that Disney 's ESPN is potentially interested in them taking an equity stake in the network. Talks have had few specifics, said the people, but may heat up as ESPN attempts to reach a rights renewal deal with the NBA. Sources say Disney is targeting 2025 as a potential launch date for an unbundled-from-cable ESPN streaming service. Disney is joining the streaming fight against password sharing. While Iger said Disney should see some effects from the rollout in 2024, the initiatives to prevent password sharing won't be completed next year. Disney follows the lead of Netflix , which began rolling out a new account sharing policy earlier this year. Disney has three streaming services under its umbrella: the flagship Disney+, Hulu and ESPN+. As the company eliminates password sharing, it does not know how the action will affect subscriber growth, Iger said.

Disney 's ESPN is launching a betting sportsbook, putting the sports entertainment unit deeper into the wagering world. U.S. gambling company Penn Entertainment said it is partnering with ESPN to rebrand and relaunch its sportsbook as ESPN Bet. ESPN Bet will take over Penn's Barstool Sportsbook and become ESPN's exclusive operation. As part of the deal, Penn will pay ESPN $1.5 billion in cash over the 10-year period. Paramount Global agreed to sell book publisher Simon & Schuster to private equity giant KKR for $1.62 billion, the media company said Monday as it reported earnings. KKR's entry into the book publishing space comes months after Paramount scrapped its initial agreement to sell Simon & Schuster to rival Penguin Random House — which was valued at $2.2 billion — after a federal judge rejected the merger and it raised red flags with the government. Paramount executives said during Monday's earnings call that the proceeds of the Simon & Schuster sale would be used in the company's ongoing effort to pay down debt. Paramount reported revenue of $7.62 billion for the quarter, down about 2% year-over-year, as the company's TV segment was once again dragged down by lower advertising revenue.

The discussions have been ongoing in recent months, and Sixth Street Partners has expressed interest as an investor, the person said. The discussions with potential equity investors are not tied to FSU's potential push to leave the conference, according to the person familiar with the matter. The move leaves Netflix's standard with ads plan, which is priced at $6.99 a month, as its cheapest option.
