Former US President Donald Trump attends his trial for allegedly covering up hush money payments linked to extramarital affairs, at Manhattan Criminal Court in New York City, on May 16, 2024. Jurors in the criminal hush money trial of former President Donald Trump are set to begin deliberating a potential verdict Wednesday, after they receive instructions from a judge in a New York courtroom. Trump's lawyer and a prosecutor gave closing arguments all day Tuesday and into the early evening. The case marks the first time a former U.S. president has faced criminal charges. Cohen testified at trial in Manhattan Supreme Court that he paid Daniels at Trump's direction to buy her silence about an alleged one-time sexual tryst with Trump in 2006.

If Donald J. Trump is convicted, it will be up to Justice Juan M. Merchan to decide whether his punishment will include prison time. Mr. Trump is charged with 34 counts of falsifying business records related to the coverup of a $130,000 hush money payment that was made to the porn star Stormy Daniels in the days leading up to the 2016 election. But if Mr. Trump is convicted on more than one count, Justice Merchan would likely impose the punishment concurrently, meaning he would have Mr. Trump to serve prison time on each of the counts simultaneously. Incarceration is not a given: Justice Merchan could instead opt to impose a sentence of probation, with no prison time. Mr. Trump would then be required to regularly report to New York City’s Probation Department.

Deliberations began today after the judge overseeing Donald Trump’s trial in New York, Juan Merchan, delivered an array of legal instructions to guide the jury. During that time, they sent a couple of notes to the judge, including a request to hear his instructions again. Merchan said that the requests would be addressed tomorrow, when the jury returns for a second day of deliberations. While the jury could reach a verdict as soon as tomorrow, it also could take several more weeks, or they could fail to reach a verdict at all. Trump has been charged with 34 felony counts of falsifying business records on the eve of the 2016 election, and the jurors’ verdict on each count must be unanimous.

CNN —Donald Trump, who built a mystique as the brash epitome of power, has never been more powerless to dictate his own fate. In order to convict Trump, jurors must first decide that he falsified financial documents and did so with the express purpose of committing another crime. That was evidenced, today by the Biden campaign themselves holding a rally here,” Don Trump Jr. said. “You cannot convict President Trump,” Blanche said, before repeating himself for emphasis while impressing on the jury the gravity of the historic deliberation that lies before them. “You may say, who cares if Mr. Trump slept with a porn star 10 years before the 2016 election?

Mr. Bragg has accused Mr. Trump of concealing a federal campaign finance violation and a state election-law crime. The defense argued that Mr. Trump was a victim of extortion, led by Mr. Cohen. The defense’s main witness was a lawyer linked to Mr. Trump’s circle, Robert J. Costello, who in 2018 had acted as Mr. Cohen’s back channel to Mr. Trump’s legal team. They are the first jury in the 235-year history of the United States to be confronted with that weighty question. The payment was made to keep her silent about allegations that she and Trump had a sexual encounter (which Trump denies) ahead of the 2016 presidential election. Merchan then offered a detailed explanation of the legal rules that the jury must apply to make those determinations. This time it was for the judge to re-read the jury instructions to them, another indicator of the care they are taking in deliberations. We will see how long their deliberations take, but this afternoon’s developments suggest that it will not be an instant process.

The defense did not call Mr. Weisselberg either, nor did Mr. Trump take the stand in his own defense. And for weeks, Mr. Weisselberg’s absence has loomed large over Mr. Trump’s case, the first criminal trial of an American president. And when Mr. Trump was sworn in as president in 2017, he entrusted Mr. Weisselberg, along with Donald Trump Jr. and Eric Trump, with running his company. Mr. Trump, Mr. Cohen told the jury, “approved” of the arrangement and knew that they would falsify records to cover it up. Over the course of their decades together, Mr. Cohen knew, Mr. Trump and Mr. Weisselberg had become more or less symbiotic.

But it was in another courthouse just down the street that Mr. Trump’s wily mentor, Roy Cohn, pulled off one of his greatest legal feats. It was Mr. Cohn who taught Mr. Trump how to manipulate the law, and other people, to his advantage. Mr. Trump always admired Mr. Cohn’s bravado and belligerence; Mr. Cohn’s whole worldview seemed to validate the young developer’s crassest instincts. “If you need somebody to get vicious,” Mr. Trump once said, “hire Roy Cohn.” His legal strategy boiled down to: Delay and deny. Mr. Trump’s lawyers have aggressively sought every delay possible and called for mistrials or new judges on a regular basis.

Closing arguments start Tuesday in the Manhattan hush-money trial of former Donald J. Trump, signaling the final stages of the first criminal trial of an American president. Both prosecutors and defense lawyers will make their final cases for his guilt or innocence before jurors deliberate Mr. Trump’s fate. While opening statements are restricted to evidence, the prosecution and the defense will use closing arguments to argue how and why the evidence, testimony and law support a specific verdict. Closing arguments are expected to last for most or all of Tuesday and perhaps beyond. After closing arguments, the judge, Juan M. Merchan, will provide instructions to the 12 members of the jury that are meant to guide their deliberations.

Donald Trump could have gone any number of directions on Friday morning in his first speech after becoming a felon. A better human being might have expressed some remorse or a modicum of respect for the jury’s verdict, but that’s not who he is. In fact, what was remarkable about the speech at Trump Tower was how little effect the conviction seems to have had on his permanent vocabulary of grievance. The usual journalistic cliché for speeches like this one is “rambling,” but at least on a ramble you actually go someplace, if slowly. Trump, on the other hand, had no apparent destination.

CNN —After months of either ignoring or poking fun at former President Donald Trump’s criminal trial, the Biden campaign on Tuesday decided for the first time to stage a news conference about Trump’s record outside the courthouse where closing arguments were taking place. In their view, Trump’s trial would speak for itself, reintroducing the former president and the chaos that surrounds him to voters who may have tuned him out. “The entire news media is camped out here, day in and day out,” campaign communications director Michael Tyler said, explaining the choice to address reporters outside the lower Manhattan courthouse. Biden campaign officials are still grappling with the reality, this person said, that a substantial part of the population still doesn’t see that the choice on Election Day will be between Biden and Trump. “We knew Trump was out of control when he was president,” De Niro says over a shot of Trump behind the Resolute Desk.

CNN —Donald Trump’s first criminal trial has arrived at its dramatic final act with lawyers for both sides primed on Tuesday to hammer home their cases before jurors consider a verdict that could make history. They argued during the trial that there was no evidence of criminal intent. The trial has not gripped the attention of the country as it might have were television cameras allowed in the courtroom. And Trump used his multiple criminal indictments to his political advantage in clearing the Republican nominating field. The time off only seems to have escalated Trump’s fury as one of the defining weeks of his life dawns.

This is not the first time Alito has found himself in hot water over displaying a controversial flag on his property. CNN —A panel of New York State appellate judges denied Donald Trump’s appeal to move his criminal trial — which has been going on for six weeks — out of Manhattan to another county. All of Trump’s emergency appellate requests to delay the trial were denied at the time, and since then, the court has denied Trump’s motions on the underlying issues. Five days before the trial got underway, Trump’s lawyers had asked the appeals court to delay the trial pending an appellate ruling on these issues. That request was denied after an emergency hearing on April 10, and the order issued on Thursday now dismisses the petition. Trump can ask the appeals court to consider the issues in a direct appeal after a final judgment in the trial, the ruling says.

Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.
