Federal prosecutors charged Hunter Biden, the president’s son, with lying about his drug use when he purchased a handgun in 2018. The indictment could lead to a high-profile trial of Biden next year, coinciding with his father’s re-election campaign. That agreement would have resolved the Justice Department’s long-running investigation without Biden serving prison time. Prosecutors could still file charges against Biden in that case. I watched him and I thought of Mitch McConnell clinging to a different lectern in a different city two weeks earlier, his physical struggle unquestionable but his thirst for dominance still unquenched. I thought of all the other Republicans — Mark Meadows, Peter Navarro, Lindsey Graham, the list is endless — who prostituted themselves for Trump. McCarthy right now is the main character in that story. And what a pathetic character he is. It wasn’t that the accumulated evidence had finally crossed some threshold or reached some tipping point.

The Justice Department asked the Supreme Court on Thursday to pause a novel and sweeping ruling from a federal appeals court barring many kinds of contacts between administration officials and social media platforms. A unanimous three-judge panel of the U.S. Court of Appeals for the Fifth Circuit ruled last week that officials from the White House, the surgeon general’s office, the Centers for Disease Control and Prevention, and the F.B.I. had most likely crossed constitutional lines in their bid to persuade platforms to take down posts about the coronavirus pandemic, claims of election fraud and Hunter Biden’s laptop. The panel, in an unsigned opinion, said the officials had become excessively entangled with the platforms or used threats to spur them to act. The panel entered an injunction forbidding many officials to coerce or significantly encourage social media companies to remove content protected by the First Amendment.

CNN —The initiation of an impeachment investigation against a president ought to be an earthshaking moment in the nation’s history. Republicans could use an impeachment investigation of the president to fuel public suspicion over Hunter Biden’s cascading controversies. But the coming impeachment investigation represents a gamble for Republicans since it could cause a backlash in moderate districts that their majority depends on. Ian Sams, a White House spokesman for oversight and investigations, blasted the impeachment investigation as “extreme politics at its worst.”But the strain of an impeachment inquiry is hardly the way the White House would have preferred to prepare for election year. CNN —The White House plans to send a letter to top US news executives on Wednesday, urging them to intensify their scrutiny of House Republicans after Speaker Kevin McCarthy launched an impeachment inquiry into President Joe Biden, despite having found no evidence of a crime. “It’s time for the media to ramp up its scrutiny of House Republicans for opening an impeachment inquiry based on lies,” Ian Sams, a spokesperson for the White House Counsel’s Office, wrote in the letter, according to a draft copy obtained by CNN. The correspondence comes one day after McCarthy announced that he had directed three House committees to begin an impeachment inquiry into Biden. In its letter Wednesday, the White House will ask news organizations to be more clear-eyed in their coverage of the impeachment inquiry, and not to fall prey to the traps of false equivalency in reporting. The Republican House-led investigations into Biden have yet to provide any direct evidence that the president financially benefited from Hunter Biden’s career overseas.

While McCarthy has already publicly threatened to launch an inquiry, sources say that McCarthy has sent even stronger signals about his intentions behind closed doors. Punchbowl first reported McCarthy’s expected message on an impeachment inquiry. But Tuesday’s news will mark a real effort by McCarthy to start moving ahead and get House Republican skeptics on board with proceeding. In 2019, Mr. Biden repeatedly said he had “never discussed” and had “never spoken to” Hunter about his business dealings, and Republicans have produced no evidence that he was ever briefed on specific transactions or deals. House Republicans have uncovered proof that the elder Mr. Biden was aware of and met some of his son’s business partners, raising questions about whether the president’s statements were misleading. In Hunter Biden’s book, he recounted how his father called him after Hunter joined the board of the Ukrainian energy company Burisma and warned, “I hope you know what you’re doing” — an acknowledgment of at least one conversation apparently unrelated to the details of any business dealings.

CNN —House Republicans are not only facing resistance from within their own ranks to impeach President Joe Biden, they’re also getting a cool reception from another key constituency: Senate Republicans. Moreover, a number of Senate Republicans liken the Biden impeachment efforts to the two impeachments of then-President Donald Trump that they sharply criticized, even though the situations are markedly different. CNN —Special counsel David Weiss intends to seek an indictment against President Joe Biden’s son, Hunter Biden, relating to gun charges by the end of the month, the Justice Department said Wednesday. However, after his plea deal to resolve two tax charges fell apart in court, the future of the gun deal has been in limbo. Hunter Biden’s gun-related legal troubles relate to a firearm he purchased in October 2018. In addition to the gun case, Weiss is still weighing whether to charge Hunter Biden with tax crimes. Hunter Biden’s tax-related legal jeopardy emerged after he repeatedly missed IRS deadlines to pay his taxes on time.

There were signs, subtle but unmistakable, that Hunter Biden’s high-stakes plea agreement with federal prosecutors might be on shaky ground hours before it went public in June, according to emails sent by his legal team to the U.S. attorney’s office in Delaware. When one of Mr. Biden’s lawyers sent over the draft of the statement they intended to share with the news media, a top deputy to David C. Weiss, who had overseen the inquiry since 2018, asked to remove two words describing the status of the investigation, according to interviews and internal correspondence on the deal obtained by The New York Times. “Concluded” and “conclusion” should be replaced with the weaker “resolved,” the deputy said. Six weeks later, the federal judge presiding over a hearing on the agreement would expose even deeper divisions and the deal imploded, prompting Mr. Weiss to seek appointment as special counsel with the freedom to expand the inquiry and bring new charges. The deal’s collapse — chronicled in over 200 pages of confidential correspondence between Mr. Weiss’s office and Mr. Biden’s legal team, and interviews with those close to Mr. Biden, lawyers involved in the case and Justice Department officials — came after intense negotiations that started with the prospect that Mr. Biden would not be charged at all and now could end in his possible indictment and trial.
