The SEC in 2016 warned companies that non-GAAP measures that replace GAAP-based methods with individually tailored disclosure could violate its rules. That is up from 11 companies in letters released in January and February 2022. The SEC has long expressed concerns about companies placing too much emphasis on their non-GAAP disclosures compared with GAAP disclosures. Changing how certain non-GAAP measures are calculated can be embarrassing and even costly for companies, accountants said. Graham Holdings said it isn’t violating SEC guidance because it didn’t substitute an alternative recognition or measurement method for the related adjustments.
Feb 27 (Reuters) - The U.S. Energy Department on Monday said it will lend Li-Cycle Holdings Corp (LICY.N) $375 million as it builds a battery recycling facility in New York set to become one of the country's largest sources of lithium by next year. Senator Chuck Schumer, a New York Democrat who serves as Senate majority leader, had long advocated for Li-Cycle to receive the funding. Li-Cycle's Rochester, New York, processing facility is slated to open later this year at a cost of roughly $485 million. The Rochester facility will break down that black mass into lithium and other metals. The Energy Department in the past month has agreed to lend $2 billion to Li-Cycle peer Redwood Materials and $700 million to ioneer Ltd's (INR.AX) Rhyolite Ridge lithium mining project.

Feb 22 (Reuters) - Italian tyremaker Pirelli (PIRC.MI) said on Wednesday it expects revenues this year of some 6.6-6.8 billion euros, at least in line with the better-than-expected figure for 2022. Revenues at the group totalled 6.62 billion euros ($7.03 billion) in 2022, beating a target of about 6.5 billion euros which was set only in November as an upgrade on an earlier estimate. The supplier of luxury car brands like Ferrari and Porsche said its adjusted earnings before interest and taxes (EBIT) stood at 977.8 million euros in 2022, up from 815.8 million euros a year before. The result was driven by higher pricing and as measures put in place to weather rising costs offset the hit from raw material costs and other inflation. China's Sinochem Holdings Corp, the biggest investor in Pirelli, last week denied a report that it planned to sell its 37% stake in the company.
That move prompted us to reduce our exposure to any potential post-earnings downside by trimming Coterra and Pioneer late last week. Fourth-quarter production Coterra Energy's oil-and-gas production came in above the high end of the company's guidance and edged out analysts' estimates, too. Notably, Pioneer doesn't hedge its oil production, making its realized pricing closer to that of the underlying commodity. 2023 outlook Guidance provided by Coterra and Pioneer echoed that of Devon: Softer production but higher capital expenditures in 2023. But it beat on expectations for oil production, which should please investors given the high margins of crude production.

It's unclear whether Bed Bath can capitalize on the breathing room to turn around its business, which has been battered by competition from other online and brick-and-mortar retailers. A spokesperson for Hudson's Bay declined to comment, while Bed Bath & Beyond did not respond to requests for comment. To secure the Hudson's Bay investment, Bed Bath offered a deal that guarantees the hedge fund a lucrative return in most circumstances. It is not clear how much of the stock Hudson's Bay has converted and sold since it inked the deal with Bed Bath on Feb. 6. The deal is very dilutive for other Bed Bath investors, who will end up owning 80% less if the company survives.

The loans were backed by shares in Adani Ports, Adani Green Energy and Adani Transmission, which have collapsed in value. While the Adani Group has vehemently denied the allegation made by Hindenburg Resarch as “baseless” and “malicious,” investors remain unconvinced. Adani companies will be reporting quarterly results this week. Moody’s said Friday that the plunge in the shares of Adani companies was likely to reduce the group’s ability to raise capital. Another agency, S&P, cut the outlook for its ratings on two companies, Adani Ports and Adani Electricity, to negative from stable, citing the risk of higher funding costs or reduced access to capital.
While the Adani Group has condemned the report as “baseless” and “malicious,” investor questions about its claims linger, and the fallout is growing. Gautam Adani is a 60-year-old tycoon who founded the Adani Group more than 30 years ago. The firm said it had taken a short position in Adani Group companies, meaning it would benefit from a drop in their value. Stocks of most Adani Group companies slumped again on Friday. Indian banks that hold Adani Group assets could also be affected if the value of those holdings continues to drop.
TOKYO, Feb 2 (Reuters) - Japan's Panasonic Holdings Corp (6752.T) cut its annual operating profit forecast by 12.5% on Thursday after lower-than-expected third-quarter earnings, hit by headwinds from a slowing global economy and persistently high raw materials prices. The conglomerate slashed its operating profit forecast to 280 billion yen ($2.18 billion) for the financial year to Mar. 31, from 320 billion yen, in part due to a less rosy outlook for its industry segment this quarter. Panasonic's third-quarter result, with its operating profit rising 16% to 84.4 billion yen in the three months ended Dec. 31, fell short of a mean estimate of 95.31 billion yen profit from nine analysts. Most investors were focused on more clarity and details about U.S. Inflation Reduction Act benefits for Panasonic's EV battery cell production, such as the size and sustainability of subsidies, the analysts added.

Mizuho's third-quarter net profit more than doubled to 209.3 billion yen compared to the same period last year, when results at the country's No. 3 lender were weighed down by loan loss provisions for KKR & Co's (KKR.N) auto parts supplier Marelli Holdings Co.Japan's second-largest bank, Sumitomo Mitsui Financial Group Inc (8316.T), on Monday reported a 42.6% jump in third-quarter net profit. Yi'an P&C Insurance was among nine firms Chinese regulators seized from the Tomorrow Holdings conglomerate in July 2020. McDonald's Holding Company Japan Ltd (2702.T) said it would raise prices on about 80% of its menu from Jan. 16, citing currency fluctuations as well as surging costs for materials, labour, transportation, and energy. The hikes follow previous increases in March and September last year, as Japan grapples with inflation and a slide in the yen that has made imported ingredients more expensive. The price for a single cheeseburger will go up to 200 yen ($1.49) this month from 140 yen a year ago. The cost of the signature Big Mac hamburger will go up to 450 yen from 410 yen previously.
