CNN —A New York state judge has the future of Donald Trump’s business empire in his hands. The civil lawsuit from New York Attorney General Letitia James, a Democrat, is seeking $370 million from Trump and the other defendants (the figure was originally $250 million). The back and forth between the judge, Trump and the former president’s lawyers during the trial was repeatedly heated. “What evidence do you have – I just haven’t seen it – that they knew that there was fraud?” Engoron asked. Furthermore, Trump says, companies like Deutsche Bank wanted to do business with Trump Org.

A letter from Donald Trump's court monitor in his fraud trial suggests he lied about a $48 million loan. The team also provided a memo from the Trump Org's legal department stating that the loan was paid off. The Daily Beast first reported on Sunday the note from Jones is a clue Trump used a fake $48 million loan as a vessel to avoid paying income taxes. CNN —While former President Donald Trump’s path through Republican primaries is clearing up, he faces looming unanswered questions in multiple different courts. Engoron had already ordered the dissolution of Trump’s New York real estate empire, which is on hold pending Trump’s appeal. The US Supreme Court has, for now, declined to take up the case, because justices wanted this particular appeals court panel to weigh in. Trump will remain on the ballot for Colorado’s primary pending the Supreme Court decision. While the situation is unlikely, at least for now, to kill the case against Trump, Willis’ position at the helm is very much in question.

But an Associated Press analysis of nearly 70 years of similar cases showed Trump’s case stands apart: It’s the only big business found that was threatened with a shutdown without a showing of obvious victims and major losses. “This sets a horrible precedent,” said Adam Leitman Bailey, a New York real estate lawyer who once sued a Trump condo building. But AP’s review of nearly 150 cases reported in legal databases found that in the dozen cases calling for “dissolution,” victims and losses were key factors. The New York attorney general who filed the lawsuit, Letitia James, said that helped the ex-president receive lower interest rates. In fact, the bank made its own estimates of Trump’s personal wealth, at times lopping billions from Trump’s figures, and still decided to lend to him.

Donald Trump on Monday lashed out at the financial monitor overseeing the Trump Organization and urged a judge to fire her days after she reported a range of issues — and flagged a questionable $48 million loan — in the former president's New York civil business fraud case. New York Attorney General Letitia James has asked Engoron to order that Jones continue to monitor the Trump Organization for at least five years as part of his judgment in the case. Robert made that argument three days after Jones submitted a report to Engoron accusing the Trump Organization of providing incomplete, inconsistent or incorrect information about its financial disclosures. In a footnote in that report, Jones said she identified a loan between Trump himself and an entity related to Trump Chicago Tower that later turned out not to exist. She also seeks five-year bans with the same conditions for Donald Trump Jr. and Eric Trump, who took over the Trump Organization after their father became president in 2017.

“I will tell you that the last thing you want is to see multiple law enforcement officials with guns drawn pointing at my parents and thinking that something happened,” the former South Carolina governor told NBC. It’s been in the headlines recently because of a spate of incidents involving public officials. When prominent public officials are victims of swatting, one can’t always prove a cause-and-effect relationship between inflammatory rhetoric posted online or delivered during a speech and a caller’s reckless false emergency call to 911. We need tougher laws to protect public servants, and some states are increasing penalties for perpetrators of swatting. Swatting increases the likeliness of inadvertent harm to the public by the very people whose job it is to protect us.

After a monthslong trial, the attorney general, Letitia James, asked for a penalty of roughly $370 million, which would come on the heels of a separate jury verdict in a defamation case requiring Mr. Trump to pay $83.3 million. The new accusations against Mr. Trump’s family business, the Trump Organization, came late last week in a report from an outside monitor whom Justice Engoron assigned in late 2022 to keep an eye on the company. The monitor, Barbara Jones, a former federal judge, has overseen how the company represents its finances to lenders. Her report highlighted several paperwork issues at a family company trying to shake a legacy of sloppiness: missing disclosures, typos, math errors and questions about a $48 million loan between Mr. Trump and one of his companies. Ms. Jones, now a law firm partner, told the judge that collectively, the issues “may reflect a lack of adequate internal controls.”

He spoke to his lawyers, his words sometimes quite audible to the packed courtroom. He wrote instructions for his defense team that he shoved their way. He walked in late at one point, and at another, while a lawyer suing him was speaking to the jury, he stalked out. His use of the defense table as a stage also provided clues to the public, and a reminder to his own legal team, of how he might handle himself if and when any of the four criminal cases he is facing go to trial. And in recent months he sat for many days of the trial a few blocks away at 60 Centre Street, where Justice Arthur F. Engoron of State Supreme Court oversaw the fraud trial against Mr. Trump and his company.

After his two recent confrontations with the judges, Mr. Trump held news conferences before cheering supporters in the lobby of his building at 40 Wall Street. Ms. Carroll’s defamation trial is being heard by a nine-person jury in Federal District Court, with Judge Kaplan overseeing the proceedings. On Monday, Trump's attorney Alina Habba said he intends to take the witness stand in his defense. Trump's two driving impulses — to fight the system and to take the witness stand — will create the judicial equivalent of a car wreck, experts told Business Insider. Alternatively, Trump can get on the witness stand and "try to testify in a narrative fashion," Jones said. Carroll's trial does have a jury, making it harder to "unring that bell" of forbidden testimony, Jones said. Or wager that he'll inflict wounds on himself by taking the witness stand?

Swatting Is a Political Problem - The New York Times

In a year with so much political and legal tension, law enforcement is seeing a disturbing trend: targeting public officials with swatting, or false emergency calls intended to draw a heavily armed police response. Recent incidents involving officials who have taken stands seen as hostile to Donald Trump and bomb threats in multiple state capitols are signs of a troubling escalation in political violence. In addition, swatting diverts law enforcement resources from real emergencies. But more insidiously, these tactics are tools of intimidation, designed to silence voices in the political process. The frequency and visibility of these incidents suggest that swatting and political violence require prosecutors to prioritize their efforts to stop it.

Martin Shkreli, former chief executive officer of Turing Pharmaceuticals AG, exits court in New York, US, on Wednesday, Oct. 4, 2023. What does former President Donald Trump have in common with "Pharma bro" Martin Shkreli? A penchant for harshly trolling their enemies online and an attorney general who wants both of them banned for life from their preferred business. The ruling stemmed from an antitrust lawsuit James, the Federal Trade Commission, and six other states filed against Shkreli. James, in that case, asked Judge Arthur Engoron to ban Trump for life from the New York real estate industry and to bar his sons, Donald Trump Jr. and Eric Trump, from that sector for five years, along with fining them $360 million.

The testy clashes have come to be expected as Trump's lawyers carry into the courtroom the bombastic, and often antagonistic, style that defines his campaign trail demeanor. There's no doubt that the lawyers, with some exceptions, have struggled to score major points with judges and in fact have often provoked their ire. Both cases have been defined by contentious exchanges between judges and Trump and his lawyers. In November, for instance, they pushed unsuccessfully for a mistrial in the fraud case, accusing Judge Arthur Engoron of “tangible and overwhelming” bias. Chutkan has repeatedly admonished Trump’s lawyers for political arguments, once telling attorney John Lauro during debate over whether restrictions could be placed on Trump's speech that though she knew he had a “message” to convey, she didn't want campaign rhetoric in court.

Donald J. Trump doesn’t change. The judges’ different approaches to the tempestuous storm that entered their courtrooms — and the different results — could offer lessons beyond the two New York cases. They may provide guidance for the judges set to oversee Mr. Trump’s four potential criminal trials, who will want to keep the 45th president from transforming his legal proceedings into political spectacles. “The thing you’ve got to do primarily is set rules and enforce them,” said John S. The former president publicly fulminated against Judge Lewis Kaplan as “nasty” and a “Trump-hating guy” and bucked courtroom etiquette. Trump accused Kaplan of being heartless for not suspending the trial so that he can attend the funeral of his mother-in-law. But Haley has only implicitly criticized Trump’s assault on democracy, false claims of electoral fraud and tumultuous term in office. This attitude is consistent with Trump’s apparent belief that rules that apply to other Americans don’t constrain him. “That aside, it’s just remarkable how much the former president has gotten away with in court.

Former U.S. President Donald Trump arrives to speak to the press after attending the civil fraud trial against the Trump Organization in New York State Supreme Court, in New York City on Jan. 11, 2024. The top court in New York State on Tuesday rejected an appeal by former President Donald Trump of a gag order imposed on him in his civil business fraud trial. The New York Court of Appeals dismissed Trump's challenge to the order "upon the ground that no substantial constitutional question is directly involved." The court also dismissed Trump's motion to stay the gag order "as academic," likely because the trial is over. The gag order barred Trump from making public statements about the staff of Manhattan Supreme Court Judge Arthur Engoron.

CNN —New York’s top court has dismissed an appeal from Donald Trump’s lawyers to remove the gag order placed on the former president in the New York Attorney General’s civil fraud trial. New York’s appellate court had reinstated the order from Judge Arthur Engoron, which prohibited Trump and his attorneys from making public statements about the courtroom staff in the $370 million trial that wrapped up this month, in November, 2023. Tuesday, the New York’s Court of Appeals dismissed the appeal, stating that “no substantial constitutional question is directly involved.”The order, initially issued by Engoron in October, bars Trump from making public statements about court staff after Trump made numerous comments about a clerk, who the former president said is biased against him. The judge had twice fined Trump for violating the order. The judge last year found that Trump is liable for fraud in the civil case, and he plans to issue a full decision in the bench trial by the end of this month on damages and six additional claims.
