The Federal Trade Commission on Friday sued three large U.S. health companies that negotiate insulin prices, arguing the drug middlemen use practices that boost their profits while "artificially" inflating costs for patients. It comes three days after Express Scripts sued the FTC, demanding that the agency retract its allegedly "defamatory" July report that claimed that the PBM industry is hiking drug prices. Faster delivery is prompting more and more people to turn to Amazon to buy paper towels and other everyday items. The growing prevalence of one- and same-day delivery has made Amazon a much more convenient to place to shop for everyday essentials. "If people buy everyday essentials on Amazon, they're more likely to buy other products too," said Jeff Marks, the Club's director of portfolio analysis. This added convenience in ordering everyday essentials from Amazon comes at a challenging time for physical retailers known for selling those same products. The company likes "to be in the consideration set for consumers" in the everyday essentials since it helps drive market share gains, Olsavsky said.

Advertisers plan to withdraw from X in record numbers

A global survey by market research firm Kantar found that a net 26% of marketers plan to decrease their spending on X in 2025, the biggest recorded pullback from any major global ad platform. Only 4% of marketers overall think X ads provide “brand safety” — certainty that their ads won’t appear alongside extreme content — compared with 39% for Google ads, Kantar said in a report Thursday. The findings suggest that Musk’s charm offensive at the world’s largest annual advertising festival, Cannes Lions, in June hasn’t succeeded. According to the report, YouTube remains the ad platform marketers most prefer, while, for consumers, Amazon and TikTok share the top spot. Brazil blocked X over the weekend following an order by the Supreme Court because Musk refused to appoint a new legal representative in the country.

A federal judge in Texas has ruled against Media Matters and its request to dismiss a lawsuit filed by Elon Musk's X. Because of U.S. District Judge Reed O'Connor's decision on Thursday, X's lawsuit against the nonprofit media watchdog and two of its staff members will proceed to trial on April 7. Attorneys representing X claimed the Media Matters report was "intentionally deceptive" and financially damaged the company. Media Matters and X didn't immediately respond to requests for comment. In August, O'Connor dismissed a request by Media Matters to force Musk to list Tesla as an interested party in X's lawsuit against the nonprofit.

The judge overseeing X's lawsuit against advertisers has recused himself following a news report that showed he owned shares of Tesla . In a recusal notice dated Aug. 13, U.S. District Judge Reed O'Connor in Texas backed out of X's case against the World Federation of Advertisers, which was filed last week. X, formerly known as Twitter, is owned by Elon Musk, who is also the CEO and largest shareholder in Tesla. On Monday, NPR reported that O'Connor had owned shares of Tesla in 2022, the date of his last available disclosure, posing a potential conflict of interest. In X's lawsuit, the company accused a number of advertisers of engaging in antitrust behavior when they stopped ad campaigns on the site.

New York CNN —A major ad industry group is shutting down, days after Elon Musk-owned X filed a lawsuit that claimed the group illegally conspired to boycott advertising on his platform. The end of GARM marks a temporary victory for Musk and X CEO Linda Yaccarino, even though a judge hasn’t made a ruling yet. “Everyone can see that advertising on X is a treacherous business relationship for advertisers,” they said. Following that, brands’ faced issues where their ads were placed next to illegal or harmful content, the group said in a statement. GARM said its group reduced such ads from 6.1% in 2020 to 1.7% in 2023.

New York CNN —Elon Musk’s X has accused a group of major advertisers of antitrust violations in a new lawsuit claiming the group conspired to “boycott” advertising on the platform. The lawsuit claims an influential ad industry group organized “to collectively withhold billions of dollars in advertising from Twitter” because the group was concerned that the platform had deviated from brand safety standards after Musk’s acquisition in late 2022. Elon Musk's social media platform X has sued a group of advertisers, alleging that a "massive advertiser boycott" deprived the company of billions of dollars in revenue and violated antitrust laws. The company formerly known as Twitter filed the lawsuit Tuesday in a federal court in Texas against the World Federation of Advertisers and member companies Unilever, Mars, CVS Health and Orsted. Musk posted about the lawsuit on X on Tuesday, saying "now it is war" after two years of being nice and "getting nothing but empty words." X CEO Linda Yaccarino said in a video announcement that the lawsuit stemmed in part from evidence uncovered by the U.S. House Judiciary Committee which she said showed a "group of companies organized a systematic illegal boycott" against X. The Republican-led committee had a hearing last month looking at whether current laws are "sufficient to deter anticompetitive collusion in online advertising."

X filed a lawsuit on Tuesday against the Global Alliance for Responsible Media, a coalition of major advertisers, claiming that it had violated antitrust laws by coordinating with brands to dissuade them from spending money on the social media platform. “The illegal behavior of these organizations and their executives cost X billions of dollars,” wrote Linda Yaccarino, X’s chief executive, in an open letter to advertisers. “People are hurt when the marketplace of ideas is undermined and some viewpoints are not funded over others as part of an illegal boycott.”With the lawsuit, X effectively declared war on advertisers, which provide the bulk of the social media company’s revenue. Since Mr. Musk acquired the company and promised to usher in a new era of unfettered free speech, many advertisers have limited their spending on X, concerned by reports of rising hate speech and misinformation there. In its fiscal third-quarter earnings report to investors in late June, pharmacy chain Walgreens announced plans to close a "significant" number of its 8,600 U.S. stores. "Pharmacy chains used to really be the heart of communities," said GlobalData retail managing director Neil Saunders. Walgreens leans heavily on its back-of-store pharmacy revenue to make up for weakness in retail, an arena which itself has struggled with shrinking margins. "CVS has sized this at about a billion dollars a year, and CVS and Walgreens have kind of similar-sized pharmacies."
