The Alabama attorney general's office told federal appeals court judges last week that nitrogen hypoxia is "the most painless and humane method of execution known to man." The execution would be the first attempt to use a new method since lethal injection was introduced in 1982. Three states — Alabama, Mississippi and Oklahoma — have authorized nitrogen hypoxia as an execution method. The Alabama attorney general's office noted that Smith, when previously fighting lethal injection, had suggested nitrogen as an alternative execution method. Courts require inmates challenging their execution method to suggest an alternative method.

Storms have walloped the Pacific Northwest, Midwest, Plains, South and Northeast with low temperatures, heavy snow, ice storms, freezing rain and high winds for the past two weeks. Tina Kotek on Thursday declared a statewide emergency following deadly ice storms. Trees and power lines already coated with ice could topple if they get more, the National Weather Service warned. “Stay safe out there over the next several days as our region tries to thaw out,” the weather service said. The National Weather Service said there could be a thaw next week, when the forecast calls for above-average temperatures across almost the whole country.

Some of those states have some of the highest poverty rates in the country, including Mississippi, with the highest rate, and Louisiana, where I grew up, with the second highest. When Louisiana rejected the lunch program, a Democrat was still the governor; on Jan. 8, a Republican took over. According to KFF, a nonprofit organization focused on health policy, seven of those states — Alabama, Florida, Georgia, Mississippi, South Carolina, Texas and Wyoming — are among those that have not fully extended Medicaid to the poor under the Affordable Care Act. Imagine withholding funding for food that would keep children healthy, while denying people medical care when they get sick. The cruelty of it is almost incomprehensible, but I’m convinced that this is all part of the punitive posture of so many of today’s Republicans — which in this case is meant to punish poverty, to intensify hardships: their version of an economic “scared straight” program.

MONTGOMERY, Ala. (AP) — Attorneys for the first inmate slated to be put to death with nitrogen gas have asked a federal appeals court to block the execution scheduled later this month in Alabama. Kenneth Eugene Smith’s attorneys on Monday asked the 11th U.S. The question of whether Alabama will ultimately be allowed to attempt the nation’s first execution using nitrogen gas could end up before the U.S. Supreme Court. Smith’s attorneys appealed a judge’s Jan. 10 decision to let the execution go forward. The low-oxygen environment could cause nausea leading Smith to choke to death on his own vomit, his attorneys argued.

Portland General Electric warned that the threat of freezing rain Tuesday could delay restoration efforts. Freezing rain and sleet was expected continue across portions of the Southeast into Tuesday morning. The US Department of Labor is proposing a $212,646 fine against a Mississippi poultry processor after a 16-year-old sanitation worker was pulled into a chicken deboning machine and killed. The child became the second worker killed in just over two years at the plant. Mar-Jac Poultry, which could not immediately be reached for comment, operates facilities in Mississippi, Alabama, and Georgia. Mar-Jac Poultry told NBC News in October that the company has followed all safety procedures in the incident involving the teen worker. The DOL said the poultry processor currently is also under a separate child labor investigation by its wage and hour division.

New York CNN —The United Auto Workers union says it has started an effort to organize workers at 13 non-union automakers with US factories. The union said there are about 150,000 employees at 36 nonunion auto plants operated by the companies it is targeting in this campaign. That is slightly more than the union’s representation at the three unionized automakers, which have about 145,000 UAW members between them. But if a union organizing campaign is successful, the union will be made up of workers from the company. The union has filed complaints accusing many of the automakers of unfair labor practices during those earlier organizing efforts.
