CNN —Harvey Weinstein has pleaded not guilty to one count of a criminal sex act in the first degree after he was indicted by a grand jury earlier this month. The indictment was unsealed after it was initially announced during a court hearing last Thursday. An attorney for the woman whose grand jury testimony served as the basis of the new indictment said she intends to testify at trial. Prosecutors in New York began presenting the case to the grand jury in August. His conviction was overturned by the New York Court of Appeals in April, citing violation of Weinstein’s constitutional rights at trial.

Prosecutors revealed last week that Weinstein had been indicted on additional sex crime charges that weren't part of the case that led to his now-overturned 2020 conviction. While bracing for the new charges, Weinstein also is awaiting retrial after New York state's highest court this spring overturned his 2020 conviction on rape and sexual assault charges involving two women. CNN —A critical witness in the original trial of disgraced Hollywood producer Harvey Weinstein has announced she will testify in his upcoming retrial on criminal charges. After Weinstein’s conviction was overturned earlier this year, Mimi Haley, a former production assistant on The Weinstein Company’s “Project Runway,” said she wasn’t sure if she wanted to go through it all again. Haley alleged that Weinstein had pinned her down and forced her into a sex act in 2006 at his Manhattan apartment. Last week, he was indicted in Manhattan in connection to new sexual assault allegations, according to prosecutors. If he is cleared to attend the hearing, Weinstein is expected to be arraigned on the new indictment.

Circuit U.S. Court of Appeals sounded unconvinced Monday that the TikTok “sale or ban” law, signed by President Joe Biden in April, was unconstitutional. TikTok and ByteDance have since condemned the practice and said that three employees involved were terminated, with an additional employee resigning. Pincus also said that the data TikTok collects from American users is anonymized and is comparable to other Chinese companies, like major e-commerce platforms. TikTok creators and users in the U.S. have responded overwhelmingly negatively to the proposed ban. Trump then expressed support for TikTok following Biden’s passage of the national security package that included the provision to ban TikTok.

Is TikTok trying to secretly influence Americans at the behest of the Chinese government? And an analysis of the ownership structure of TikTok parent company ByteDance, obtained by NBC News, argues that the company is deeply entangled with some of China’s major government propaganda organs. The most recent one, published last month, found that TikTok suppresses anti-China content compared to YouTube and other social media platforms. In recent years, according to media reports, Chinese government entities have increasingly taken golden shares in technology companies. “This report establishes that TikTok algorithms actively suppress content critical of the Chinese Communist Party (CCP) while simultaneously boosting pro-China propaganda and promoting distracting, irrelevant content,” the researchers wrote.

The law Biden signed seeks to ban TikTok on Americans’ personal devices unless its Chinese parent company, ByteDance, quickly sells TikTok to someone else — which may effectively end the app as we currently know it. TikTok will not get the luxury of a full trial to argue for its continued existence in its current form. But it won’t be alone: A group of TikTok creators also suing the Biden administration will go next, with 10 minutes to speak. Court filings show that TikTok and US national security officials had hammered out a draft proposal to address the security concerns. The question is whether all that amounts to enough influence over ByteDance and TikTok to gain access to US TikTok users’ data, in spite of the guardrails promised by Project Texas.

ATLANTA — The judge overseeing the election interference case against Donald Trump and several co-defendants in Georgia has thrown out three counts in the indictment — including two counts brought against the former president. “President Trump and his legal team in Georgia have prevailed once again,” he said in a statement. But a lawyer for Trump confirmed that McAfee’s decision would also apply to Trump. The case is currently on hold as Trump and other defendants appeal McAffee’s decision not to disqualify Fulton County District Attorney Fani Willis. In March, the same judge dismissed six other counts in the indictment, including three against Trump because the indictment lacked sufficient detail.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump. Trump's appeal is set to be heard in oral arguments at the Georgia Court of Appeals in December.

The 4-3 decision by North Carolina's high court came hours after the Michigan Supreme Court ruled that Kennedy's name had to stay on that state's ballot over his objections. CNN —Hawaii’s most controversial nature spot has once again become a center of concern, with 14 people recently arrested for accessing the Haiku Stairs on the island of Oahu according to officials. Eight of the 14 were arrested on September 3, although it’s not clear if they were hiking together. The Haiku Stairs, sometimes called the “stairway to heaven,” were closed to the public in 1987. In 2021, the Honolulu City Council voted to remove the Haiku Stairs. A local group called Friends of the Haiku Stairs is pushing back against the stairs’ removal, arguing that the $2.5 million process is too expensive.

WASHINGTON — The Supreme Court on Wednesday rebuffed a Biden administration plea seeking to revive the latest plan to tackle federal student loan debt. The court in a brief order denied an emergency request filed by the administration seeking to lift a nationwide injunction imposed by an appeals court. The Education Department issued a regulation finalizing its Saving on a Valuable Education, or SAVE, plan in July 2023, the month after the Supreme Court ruled the administration lacked authority to implement Biden's earlier loan forgiveness program. They say it should be blocked for the same reason that the Supreme Court blocked Biden's earlier plan.

The Department of Veterans Affairs has clawed back billions of dollars that countless veterans were given as incentives to leave the military, including when it needed to downsize, according to new data obtained by NBC News. Disabled veterans have been told in the last 12 fiscal years to return nearly $3 billion in special separation pay — lump-sum incentives that were offered when the U.S. had to reduce its active-duty force or release slightly injured service members, the data shows. The justification of the recoupment rule carried over in the 1990s when other forms of special separation payments — unrelated to disabilities — were authorized. Those payments, including the Special Separation Benefit (SSB), were designed instead to help the Defense Department manage its force size. He was told to pay back the money in 2017 after he filed for VA disability for PTSD and other conditions.
