The U.S. Supreme Court on Friday agreed to hear a bid by President Joe Biden’s administration to revive a federal law that makes it a criminal offense to encourage illegal immigration after it was struck down by a lower court as a violation of free speech rights. Circuit Court of Appeals invalidating the law for infringing on rights guaranteed under the U.S. Constitution’s First Amendment. The dispute is similar to one that the Supreme Court heard, but did not resolve, in 2020. The 9th Circuit upheld Hansen’s other convictions and ordered that he be resentenced. Biden’s administration urged the Supreme Court to hear the case, faulting the appeals court for invalidating an “important tool for combating activities that exacerbate unlawful immigration.”The case will be heard during the court’s current term, with a ruling due by June 2023.
Dec 9 (Reuters) - The U.S. Supreme Court on Friday agreed to hear a bid by President Joe Biden's administration to revive a federal law that makes it a criminal offense to encourage illegal immigration after it was struck down by a lower court as a violation of free speech rights. ICE accidentally leaked personal info of more than 6,000 immigrants who applied for protections. The agency said the leak, which they said was "unintentional," was left up for five hours. Human rights organization Human Rights First notified the agency of the massive leak on Monday, the Los Angeles Times reported. Immigration advocates said the leak created grave security risks for the migrants, even if the data was deleted. "ICE cannot be trusted with people's data," Oliver Merino, a coordinator for the Immigrant Legal Resource Center, told Insider.
In a terrorism advisory bulletin, the Department of Homeland Security on Wednesday raised concerns about potential threats to the LGBTQ, Jewish and migrant communities from violent extremists inside the United States. Americans motivated by violent ideologies pose a “persistent and lethal threat,” a senior DHS official told reporters in a briefing on the bulletin. The bulletin was the latest summary of national terrorism threats, a document that has been updated about every six months since the insurrection at the U.S. Capitol on Jan. 6, 2021. “Certainly the Jewish community seems particularly targeted in recent days by that kind of activity in our discourse,” the official said. The previous National Terrorism Advisory System bulletin issued by the DHS in June raised concerns about potential violence surrounding the November midterm elections.
Hard as it is to believe, the mayor of Washington, D.C., might soon be elected with votes from illegal immigrants or the staff at the Chinese embassy. Last month the D.C. City Council passed a bill to expand the franchise in local elections to any adult with 30 days of residency. Mayor Muriel Bowser did not sign or veto it, so the bill was officially enacted Monday without her signature. New York City passed a noncitizen voting law that a court ruled this year was a violation of the state Constitution. No such limitation appears in the D.C. bill, meaning illegal aliens and foreign college students would be able to vote, and that’s not all.
The Hidden Consensus on Immigration

In 2013, the Senate passed a bipartisan immigration bill that would have coupled a pathway to citizenship for millions of unauthorized noncitizens with a major increase in future immigrant admissions. Republicans in the House of Representatives wanted nothing to do with the plan, which faced intense opposition from conservative voters. Ever since, the partisan battle over immigration has proven utterly intractable, and the split decision in this year’s midterm elections suggests that the stalemate will continue. But it doesn’t have to be this way: The fact is, Americans agree in key respects about how to fix our broken immigration system. It is worth underscoring that the system really is badly broken.
WASHINGTON — Republican Kris Kobach has won the race to serve as Kansas's attorney general, NBC News projected Thursday. As the state's attorney general, Kobach will have the power to prosecute voter fraud and enforce other election laws. He told the Associated Press in October that “there’s no question” voter fraud occurred in 2020 and that Americans will never know “how many fraudulent ballots were cast." As the vice chair of Trump's election commission, he was charged with investigating claims of voter fraud in the 2016 election. The panel found no major evidence of voter fraud and the committee was dissolved in 2018.
Noncitizens are not eligible to vote in California congressional elections, despite the claim resurfacing online ahead of November’s midterm elections. “By law noncitizens cannot vote in California elections. California law requires that voters be both U.S. and California citizens,” Joe Kocurek, a spokesperson for the California Secretary of State told Reuters via email. Noncitizens cannot vote in congressional elections in California. San Francisco voters passed an ordinance allowing noncitizens to vote in school board elections only.

A law set to go into effect in 2023 in Massachusetts would enable immigrants with non-legal status to obtain a driver’s license. The bill would eliminate a restriction that says a driver’s license cannot be issued unless a person has lawful presence in the United States. “This bill [HB 4805] also fails to include any measures to distinguish standard Massachusetts driver’s licenses issued to persons who demonstrate lawful presence from those who do not. Cecilia Calabrese, a Republican candidate for Massachusetts State Senate, wrote on Twitter: “Because in Massachusetts when you get a Driver’s License you are AUTOMATICALLY registered to vote! Unlawful voter registration and unlawful voting are both deportable offenses (see “falsely claiming citizenship” and “unlawful voters”) (here).
