A federal appeals court on Thursday rejected a request by Hunter Biden to toss the pending criminal gun case against him, saying that his appeal was premature. The ruling clears the way for Hunter Biden's trial in the case to start on June 3 in U.S. District Court in Delaware. Biden is the son of President Joe Biden. The appeals panel, whose decision was unanimous, did not rule on the merits of Biden's arguments that the indictment should be dismissed. If Biden is convicted at trial, he could renew the arguments for dismissal with the same appeals court that it declined to consider in its order Thursday.

I’m old enough to remember when Democrats impeached another President for supposedly withholding foreign aid that had been approved by Congress. The Government Accountability Office, a nonpartisan watchdog, formally concluded that the Trump administration broke the law in withholding congressionally approved aid to Ukraine. Biden relied on a bipartisan coalition to pass a $95 billion foreign aid package for Ukraine, Israel, and Taiwan. That said, while Biden will need bipartisan support to keep the government funded in September, he likely will not ask for more Ukraine aid anytime soon

Trump denies having a sexual encounter with Daniels and has pleaded not guilty. It was expected that the cross would be even tougher today and, indeed, Necheles furiously attacked Daniels from the get-go. In the most pointed back-and-forth of the day, Necheles attacked Daniels’ recollection of the circumstances surrounding her alleged sexual encounter with Trump in 2006. It also reinforced Daniels’ Tuesday testimony that she felt a power imbalance with Trump at the time of the encounter. I interviewed him on these identical facts for the first Trump impeachment and I expect he, like Daniels, will exceed expectations.

Merchan sanctioned Trump for violating his gag order for nine posts and reposts on his Truth Social site and campaign website, targeting witnesses and jurors in his Manhattan prosecution. In his written order, summarized from the bench at the start of the trial on Tuesday, the judge also warned Trump that if he persists in violating the gag order, he faces jail time. Perhaps the new sanctions — or those likely to come in response to the newest four allegations of gag order violations — will be the end of it. As I have previously explained, Trump’s argument that the gag order infringes his First Amendment rights is specious. In any event, even if Trump believes those things, that is no excuse under New York law to violate a court order.

And the case Manhattan District Attorney Alvin Bragg brought is, at heart, a documents case – Trump has been charged with 34 counts of felony record falsification, actions allegedly taken to cover up hush money payoffs connected to the 2016 election. But as demonstrated by longtime Trump assistant Rhona Graff’s testimony Friday afternoon, the methodical nature of the testimony and evidence doesn’t mean it will be dull for the jury. The US Supreme Court, after refusing to hear the claim on an expedited basis, took up the case after a lower court tore Trump’s immunity claim to shreds. We asked for your questions about the immunity claim, some of which I’ve tried to answer below with help from CNN’s reporting and Supreme Court reporters. When Smith asked justices to expedite the case and consider Trump’s immunity claim before an appeals court, they declined. If Trump’s immunity claim is upheld by the Supreme Court, what can anybody or any government body do to challenge the decision?
