WASHINGTON — Senate Judiciary Committee Chairman Dick Durbin called on the Supreme Court to create a code of conduct as its new term begins Monday. Durbin for about a dozen years has, without success, asked the Supreme Court to adopt an enforceable code of conduct. Supreme Court justices are the only federal judges who are exempt from the official ethics rules. The Supreme Court has been under scrutiny this year because of media reports about justices receiving luxury travel, gifts, and other benefits. Durbin earlier this year asked Chief Justice John Roberts to appear before the Judiciary Committee to discuss Supreme Court ethics after the articles were first published.

CNN —The Supreme Court returns to Washington to face a new term and the fresh reality that critics increasingly view the court as a political body. Earlier this year, Roberts declined an invitation to appear before the Democratic-led Senate Judiciary Committee to discuss Supreme Court ethics, citing separation of powers concerns. Even if he did believe a formal ethics code is necessary, it’s unclear whether he would need a unanimous vote to move forward. Instead, they say, critics of the court are manufacturing a controversy to delegitimize the institution and staunch the flow of conservative opinions. Last week, she told an audience in Indiana that she thought it would be a “good” idea if the court were to adapt the ethics code used by lower court justices to fit the Supreme Court.

Bob Menendez of New Jersey defiantly pushed back against federal corruption charges and the erosion of Democratic support in his home state Monday, saying cash authorities found in his home was from his savings account and on hand for emergencies. He said that he believed he'd be exonerated and that prosecutors sometimes get the facts wrong. In Washington, where the U.S. Senate is closely divided, some of Menendez’s Democratic colleagues have stopped short of calling for his resignation, notably Majority Leader Chuck Schumer, of New York, and Majority Whip Dick Durbin, of Illinois. Menendez has, however, stepped down as chairman of the influential Senate Foreign Relations Committee, Schumer said on Friday, when the indictment was unsealed. CNN —The initiation of an impeachment investigation against a president ought to be an earthshaking moment in the nation’s history. Republicans could use an impeachment investigation of the president to fuel public suspicion over Hunter Biden’s cascading controversies. But the coming impeachment investigation represents a gamble for Republicans since it could cause a backlash in moderate districts that their majority depends on. Ian Sams, a White House spokesman for oversight and investigations, blasted the impeachment investigation as “extreme politics at its worst.”But the strain of an impeachment inquiry is hardly the way the White House would have preferred to prepare for election year. In recent weeks, U.S. consumers have seen high-profile food recalls for an unappetizing reason: They're contaminated with foreign objects that have no place on a dinner plate. “Extraneous materials” triggered nine recalls in 2022 of more than 477,000 pounds of food regulated by the U.S. Department of Agriculture’s Food Safety and Inspection Service — triple the number of recalls tied to food contaminated with toxic E. coli bacteria. Trader Joe’s wouldn’t elaborate on how material got into the foods that led to its recent recalls. In recent years, firms have become increasingly cautious and are recalling products more frequently than before, said Nathan Mirdamadi, a consultant with Commercial Food Sanitation, which advises the industry about food safety. Consumers who find foreign materials in food should notify manufacturers, experts said, but also realize that recalls are likely to stick around.

A simmering dispute between branches of government over Supreme Court ethics reform boiled over Friday when Justice Samuel Alito publicly rejected a senator’s call to recuse himself from an upcoming case due to a perceived conflict of interest. After Alito was interviewed for a report in the opinion pages of The Wall Street Journal and expressed the view that Congress has no authority over the high court, Democratic Sen. Dick Durbin of Illinois in August urged Chief Justice John Roberts to take steps to ensure that the prominent conservative justice recuse himself from cases concerning legislation that regulates the high court. He also asked for Alito’s recusal in the case of Moore v. United States – a major tax case in which the petitioners are represented in part by one of the authors of the report in the Journal. Durbin, the chairman of the Senate Judiciary Committee, has been among lawmakers leading a push for ethics reform at the high court that has come to a head amid bombshell reports in recent months questioning the ethics of some justices.
